Introduction Mentally retarded people are a very delicate part of our society, they are the people who

are unable to understand the things happening around, or the consequences of the acts done by them or to them. So it is the responsibility of the society moreover of the government to take care of them, protect their interest and make them feel safe and secured. Also must take measures to bring them in the mainstream of the society. The case becomes more critical when it comes to a mentally retarded pregnant women, it was for the first time in the case of Suchita Srivastava that this issue regarding the consent of the mentally retarded pregnant women was discussed. Such provision are briefly discussed in MTP,1971. It was vry clearly given that such women have such rights but were later contradicted. The issue regarding the abortion of a child is itself a moot issue n becomes more critical when it comes to that of mentally retarded pregnant women. But if we observe it from the point of right to life n liberty , or right to bear a child
