The following is the text of a defence speech given by Zaki Jeshkin on 26/6/2002 before the second state security

court in Adanah regarding the issue of i!b ut"Tahrir

Bismillah ir-Rahman ir-Raheem The chiefs of the second state security court in Adanah. All praise be to Allah, the Lord of the worlds and peace and blessings be upon our chosen master Muhammad and his family, companions and those who followed him with righteous deeds until the Day of udgment and those who wor! to establish the righteous "hilafah state. Members of the court, # am accused of being a member of $i%b ut-Tahrir. The fact that # am from $i%b ut-Tahrir is correct. # do not deny that # am from $i%b ut-Tahrir. &n the contrary # am proud of this. $ow can a Muslim not be proud of adhering to an order of Allah' $i%b ut-Tahrir is a political party established on the ideology of #slam. The fundamental element on which $i%b ut-Tahrir is established is the detailed #slamic rules it has adopted. Thus, $i%b ut-Tahrir is not (ust a name in theory but rather it constitutes an adherence to the )haree*ah rules +ah!aam shar*iyyah,. ust as # am proud and # than! Allah when # implement an order of Allah such as when # pray, in the same way # am proud and # than! Allah that # am from $i%b ut-Tahrir which is an order of Allah +subhana wa ta*ala,. $i%b ut-Tahrir is a political party whose ideology is #slam. #slam is the secret of its life, and politics is its manifestation. The aim of $i%b ut-Tahrir is the establishment of the righteous "hilafah state -ia the intellectual and political struggle in order to resume the #slamic way of life. $i%b ut-Tahrir was established based on the saying of Allah +subhana wa ta*ala,.

Let there arise out of you a group of people in-iting to all that is good +#slam,, en(oining the # $good and forbidding the e-il. And it is they who are successful.* /0.123 This noble ayah obliges the presence of at least one political party which calls to #slam and en(oins the good and forbids the e-il. The e-idence that it is obligatory on this group to wor! for the establishment of the righteous #slamic "hilafah is the saying of Allah +subhana wa ta*ala,.

4$a-e you seen those +hypocrites, who claim that they belie-e in that which has been sent down to you, and that which has been sent down before you, and they wish to go for (udgment +in their disputes, to the Taghut +false (udgment, while they ha-e been ordered to re(ect it. But )haytan wishes to lead them far astray*. /3.526 And $is +subhana wa ta*ala, saying.

4Do they then see! the (udgment of +the Days of, #gnorance' And who is better in (udgment than Allah for a people who ha-e firm belief.* /7.726 And the saying of the Messenger in the noble hadeeth.

48hosoe-er dies without a bay*ah +pledge of allegiance, on his nec! he shall die the death of ahiliyyah.* Members of the court, As for the accusation that $i%b ut-Tahrir is a terrorist organi%ation and that # am a terrorist, $i%b ut-Tahrir has ne-er underta!en any acts of -iolence which can be termed as terrorist. This is because the Messenger +sallalahu alaihi wa sallam, did not use acts of -iolence before the establishment of the #slamic )tate. This is despite the fact the Messenger +sallalahu alaihi wa sallam, suffered much harm in Ma!!ah and he had the ability to respond with material force, howe-er he did not ta!e this path and chose to be steadfast and patient. This was despite the fact that he prayed whilst being surrounded by idols9 he did not brea! a single one. This indicates that it is not allowed to underta!e material actions before the establishment of the #slamic state and we are obliged to emulate the Messenger +sallalahu alaihi wa sallam, due to the saying of Allah +subhana wa ta*ala,.

4And whatsoe-er the Messenger +Muhammad /saw6, gi-es you, ta!e it, and whatsoe-er he forbids you, abstain from it.*/7:.;6 #t is because $i%b ut-Tahrir strictly follows the method of the Messenger +sallalahu alaihi wa sallam, it does not underta!e any acts of -iolence. #t has restricted its wor! to the intellectual and political struggle, and the reason for that is the )haree*ah rule +$u!m shar*i,. $ad the Messenger of Allah +sallalahu alaihi wa sallam, used material actions before the establishment of the "hilafah state then $i%b ut-Tahrir would not ha-e hesitated in using material action in compliance with the )haree*ah rule. <rom all this, it becomes clear that the labelling of $i%b ut-Tahrir as a terrorist group is a clear and baseless fabrication and # strongly re(ect any such accusation. Members of the court, 8hy am # being tried' #s it because # am from $i%b ut-Tahrir which is an #slamic political party that wor!s to resume the #slamic way of life' Trying me for this charge is nothing less than to put #slam in the doc!. As Muslims you are obliged to re(ect the charge against #slam and to place it as crown abo-e your heads and adopt the thoughts of $i%b ut-Tahrir which is an #slamic party. As Muslims you are under obligation to decide my release for the Messenger +sallalahu alaihi wa sallam, said.

The Muslim is the brother of another Muslim, he does not do in(ustice to his brother and nor does he abandon him.* Allah +subhana wa ta*ala, says.

4Allah has promised to those among you who belie-e and wor! righteous deeds, that of a certainty, $e will cause them to accede to power on earth, as $e granted it to those before them, that $e will establish in authority their Deen which $e has chosen for them, and that $e will change +their state of, the fear in which they li-ed, to one of security and peace. They will worship Me +alone, and not ascribe powers to any beside Me. But whosoe-er disbelie-ed after this, they are the fasi=oon +rebellious, disobedient to Allah.* />3.776
