Que el seor Kenneth Eleomar Caldet'n Piedrasanta, en su calidad de Propietario de la empresa
mercantil denominada ESCUELA DE AUTOMOVD..ISMO SPEED, solicit a este Ministerio,
autorizacin para el funcionamiento de una escuela de aprendizaje de trnsito, habiendo
acreditado que cuenta con los recursos necesarios para el desarrollo de esta actividad.
CONSIDERANDO:
Que dentro del expediente respectivo se estableci que el seftor Kenneth Eleomar Caldern
Piedrasanta, cumpli con los requisitos exigidos por la ley de la materia; asimismo, consta la
opinin favorable .del Departamento de Trnsito de la Direccin General de la Policia Nacional
Civil y dictamen emitido por la Direccin de Asuntos Jurldicos de este Ministerio, en la que
opina que es procedente conceder la autorizacin solicitada, dicho dictamen cuenta con el visto
bueno de la Procuraduria General de la Nacin; por lo que es procedente emitir el Acuerdo
Ministerial correspondiente.
POR TANTO:
En ejercicio de las facultades que le confiere el articulo 194 literales a) y f) de la Constitucin
Poltica de la Repblica de Guatemala; y con fundamento en el articulo 17 de la Ley de Trnsito,
Decreto nmero 132-96 del Congreso de ia Repblica; y 21 del Acuerdo Gubernativo nmero
242-99 de fecha 13 de abril de 1999, Reglamento para el funcionamiento de las Escuelas de
Aprendizaje de Trnsito.
ACUERDA:
ARTICULO 1. Autorizar a la empresa mercantil denominada ESCUELA DE
AUTOMOVILISMO SPEED, para que pueda funcionar como Escuela de Aprendizaje. de
Trnsito y se aprueban los estatutos que normar las actividades de la referida escuela, los cuales
estn contenidos en Instrumento Pblico nmero ciento sesenta y nueve (169) de fecha once (11)
de noviembre del afio dos mil trece (2013), autorizado en el municipio de Quetzaltenango,
departamento de Quetza1tenango. por el Notario Paul Alberto Barillas Acosta.
ARTICULO 2. La ESCUELA DE AUTOMOVILISMO SPEED, estar bajo el control del
Ministerio de Gobernacin, por conducto del Departamento de Trnsito de la Direccin General
de la Polica Nacional Civil, quien de oficio o a peticin de parte realizar las inspecciones y
verificaciones que estime necesarias, a efecto de establecer su adecuado funcionamiento, con
apego a la Ley de Trnsito y el Reglamento para el Funcionamiento de las Escuelas de
de Trnsito.
ARTICULO 3. La ESCUELA DE AUTOMOVILISMO SPEED" regir su funcionamiento
conforme a las disposiciones. legales vigentes de la materia, sus estatutos, los manuales y
disposiciones generales que emita el Ministerio de Gobernacin, por medio del Departamento de
Trnsito de la Direccin General de la Polica Nacional Civil. Previo al inicio de sus actividades
deber registtarse en el Departamento de Trnsito.
ARTICULO 4. El presente Acuerdo empieza a regir a partir del dia siguiente de su publicacin
en el Diariode Centro Amrica.
