I want to argue in favor of a more limited Felony Murder Rule.
Its very existence is
the result of the prosecutors dilemma of proving the totality of facts required for a murder conviction. Those facts, mainly constituting the so-called actus reus, that is the act of commission of the crime, and the mens rea, the required mental state at the time of commission of the crime, plus its causal link. - how it came to be (history) - what is a felony? - why felony murder? easier b/c you dont have to prove many things (ie mens rea, explain) - problem with narrow application kind of arbitrary especially with differing state laws - need straight rule so its clear to people who frequently move to different states (ie live in NJ, work in NY) of course this might seem problematic since it sounds like helping people commit crimes while slipping under law, but the idea is everyone has a right to know what the law is and how it is applied; for example borrowing car to a friend, he commits robbery, someone dies (friend mentioned *jokingly* -> rob a liquor store) -> felony murder.
