1. Actus non facit reum, nisi mens sit rea.

( where the mind is not criminal, the act cannot be criminal.)

Example: There may be civil or administrative liability but not criminal liability. (Actus non facit reum,
nisi mens sit rea.)
2. Par in parem imperium non habet. (An equal has no power over an equal.)
Example: One of two judges of the same court cannot commit the other for contempt.( Par in parem
imperium non habet)
3. In flagrante delicto (in blazing offence)
Example: The mens rea originated from the accused who was merely trapped by the peace officer in
flagrante delicto.
4. de minimis non curat lex (Literally, the law does not concern itself with trifles)
Example: Two degrees is only possible because the law does not deal with trifles. (de minimis non curat
lex)
5. delicto compuesto ( Compund crime)
Example: When a single act constitutes two or more grave or less grave felonies it is also known as
delicto compuesto)
6. delito complejo (Complex Crime)
When an offense is a necessary means for committing the other it is also known as delito complejo.
7. Semper praesumitur pro matrimonio(Always presume marriage)
Example : Appellants admission that she was married to the victim confirms the semper praesumitur
matrimonio, and that a woman so deporting themselves as husband and wife had verily uttered into a
lawful contract of marriage.
