SUBJECT : Spot Report re Shooting Incident that Resulted
to the Death of NESTOR DELA TORRE y Urdas

DATE : April 25, 2010

1. On April 25, 2010 at about 10:00 oclock in the morning a shooting
incident transpired at So. Hanawa, Brgy. Matangcong, Sigma, Capiz wherein victim one
Nestor Dela Torre Y Urdas, 46 years old, married, laborer, and a resident of So.
Hanawa, Brgy. Matangcong, Sigma, Capiz, was shot by suspect Harry Baradero Y
Legaspi, 47 years old, married, farmer, and a resident of the same place. As a result
thereof, the victim sustained multiple gunshot wounds in the different parts of the body
and was rushed to Mambusao General Hospital Mamusao, Capiz for medical treatment
but was pronounced dead on arrival (DOA) by the attending physician thereat. The
suspect was arrested at his house during hot-pursuit operation conducted, but the
weapon used in the commission of the crime was not recovered and he is now under
the custody of this station for investigation and proper disposition. The cadaver of the
victim was moved to Regional Crime Laboratory Office, Camp Martin Delgado, Fort San
Pedro, Iloilo City for autopsy examination.

2. The motive of incident is undetermined and the case still under
investigation.

AFFIDAVIT OF WITNESS


I, MANNY PACQUIOA, Filipino, of legal age, married and a resident of Barangay Langkit,
Duero, Bohol. After having been duly sworn to in accordance with the law, hereby depose and say:

1. That I personally know Edgardo Puslik Sr.


2. That last November 22, 2007, I invited Juan Manuel Marques and Edgardo Puslik Sr. to my house
for a small birthday party.


3. That on or about 12:00 noon of the same date they arrive together in my house and I invited them
to have lunch first.


4. That on the afternoon we were having fun together with my neighbors.


5. That on the evening, Juan Manuel Marques and Edgardo Puslik Sr. is already drunk and I told
them not to go home because its already dark outside and they are drunk so I offer them to sleep in
my house until morning.


6. That I was extremely amazed upon knowing that Edgardo Puslik Sr. had received a subpoena
which accuses him of the crime of Parricide of killing his son.


7. That I am executing this affidavit to attest to the truth of the foregoing statement and to support for
the dismissal of the case filed against Edgardo Puslik Sr.
