Scenario 1

Students in a project-based learning course for educator certification offered through

blended course delivery created an anchor video using the Mole Song from the Celebrate
the Molennium CD by Michael Offutt. As part of this video, students created a lip-dub using
the entire song. The students did not obtain permission from the composer; however, they
found the song several times on Youtube. The video was then posted to the course
management system and TeacherTube. Based on your knowledge of copyright law, would the
students use of the song be acceptable?

whether or not a particular use is fair, the law states that at least four factors should be taken
into should be taken into consideration:

The amount and substantiality of the portion used in relation to the work as a whole
The effect of the use on the market or potential market for the original work
Analyze this scenario.

Scenario 2
A director for a distance education educator certification program opts to use a copyrighted
photograph of students in classroom. The photograph was found on Shutterstock through a
simple Internet search and copy and pasted. The instructor uses it, along with captioning he
created, to develop promotional materials for the certification program. These materials are
then distributed at course recruitment events and though online advertisements. Based on
your knowledge of copyright law, would the directors use of the image be acceptable?

Scenario 3
An instructor for a distance education course for an educator certification program scans and
attaches five articles from copyrighted journals for student use. These articles are necessary
pieces of course content. The articles are only downloaded onto the course management
system for student use. This is a password protected site. These same articles are available to
all registered university students through the university library, as well. Based on your
knowledge of copyright law, would the instructors use of these articles be acceptable?

Scenario 4
An instructor for a distance education course for an educator certification program scans and

would the instructors use of these articles be acceptable?

Scenario 5
A university science education instructor chooses to show the Disney movie Finding Nemo
as a way to demonstrate engaging students in the classroom through pop culture. Students
are to identify multiple classifications of animals in the movie and document the evidence
(ex. Nemo is a clown fish (a bony fish), Class Osteichthyes). The instructor had this movie at
home, which she had purchased for family use. This is a distance education course, so she
used software to download the entire video onto the course management system for
students to view. This is a password protected site available only to students. Based on your
knowledge of copyright law, would the directors use of the image be acceptable?

Scenario 6
In a distance education course for educator certification, an instructor selects to run off each
chapter of the entire book The First Days of School by Harry Wong. These chapters are each
posted in a module on the course management system. The instructor determines that this
will be more cost-effective for the students than having to purchase the book, since only
portions of each chapter will be used. The instructor did request permission from the author,
but because the semester was starting, the professor went ahead and added the course
materials before a response was received. Based on your knowledge of copyright law, would
the instructors use of the book be acceptable?
