1. Enclosed by way of service is the Appellant’s (defendant by original proceedings) Notice of


Appeal in the Court of Appeal of the Supreme Court, in respect of the Judgments and Orders of
The Learned Trial Judge in Supreme Court Proceedings No. 9665 of 2007.

2. As with every other step in these abominable, abusive proceedings brought against him by the
Respondents, this Notice of Appeal has been produced with outrageous haste and under
conditions of extreme personal, financial and emotional (and for most respects, unlawful)
pressure and hardship on the Applicant:

a. Right at this moment, only the Orders of the Learned Trial Judge made on 25 February
2009 have been authenticated by the Court – and these as recently as just prior to 1.00
pm today.

b. This leaves the Orders of the Learned Trial Judge on the other 15 days of the 16 day
trial hearing (including orders made on 2 and 12 December 2008 and 5, 9, 10, 11 and
25) all yet to be authenticated by the Court.

c. This Notice of Appeal contains gaps and deficiencies which are unavoidable as of today.

d. The Appellant gives notice that he will be seeking (whether by leave of the Court or by
as allowed by the Rules) to amend this Notice of Appeal and/or file further or
supplementary Notices of Appeal in respect of The Learned Trial Judge’s orders made in
these proceedings, once those orders have been authenticated and reviewed by the
Appellant.

3. Please acknowledge receipt of service of this Notice of Appeal at your earliest convenience.
