WHEREAS, the article two, section 445, paragraph (a) (1) of R.A. 7160, otherwise known
as the Local Government Code of 1991, provides that,
Section 445. Power, Duties and Compensation (a) The Vice-Mayor shall:
(1) Be the presiding officer of the Sangguniang Bayan and sign all warrants drawn on the
municipal treasury of all expenditures appropriated for the operation of the
Sangguniang Bayan.
WHEREAS, in like manner, the Commission on Audit in its circular numbered 92-382,
under Sections 39 and 43 thereof, it provides in part and quoted hereunder that,
Section 39. Approval of Vouchers xxx. However, disbursement vouchers for
expenditures appropriated for the operation of the sanggunian shall be approved by the
provincial vice governor, the city vice mayor or the municipal vice mayor, as the case
may be. (emphasis supplied)
SECTION 43. Officials Authorized to Draw and Sign Checks xxx in case, however of
expenditures appropriated for the operation of the Sanggunian, checks drawn thereon
shall be countersigned by the provincial vice governor, the city vice mayor or the
municipal vice-mayor, as the case may be. (emphasis supplied)

WHEREAS, the Sangguiang Bayan of Guinobatan on 02 July 2013 was in receipt of the
above-entitled proposed legislative measure, with amendments provided, from the Office of the
LCE, coupled with a Certificate of Urgency, which in response thereto, finding the same to be in
order, necessary and ministerial on the part of the Sangguniang Bayan to act on the same in order
not to disrupt the financial transactions and/or operation of the LGU especially with its depository
banks, a Special Session has been called by the members of the Sangguniang Bayan in
accordance with law and the rules of procedures, today, 04 July 2013 at 10:00 oclock in the
morning, solely for the purpose of acting on the said proposed measure;
WHEREAS, said authorization however, is confined only with the transactions under the
province/domain of the executive department and does not cover those under the appropriations
appropriated under the legislative branch of the LGU as the latter is independent from the former
pursuant to Article two, Section 445, paragraph (a) (1) of R.A. 7160, Sections 39 & 43 of COA
Circular No. 92-382, and Municipal Resolution No. 01-2013;
WHEREAS, this authorization likewise is to be understood that it is granted together with
Municipal Treasurer as an official signatory in all the financial transactions of the LGU especially in
drawing of checks from the depository banks of the municipal government. Emphasis is only made
on the Honorable Mayor in this resolution being the new head of the LGU/agency, who had just
assumed the position on June 30, 2013;

fund in the amount of Php 100,000 each for CY 2013 and all the remaining municipal aids since
CYs 2011, directly to the official account of the forty-four barangays of Guinobatan, Albay.
RESOLVED FURTHER, that the Municipal Mayor, as an incident to this transfer of funds,
is further authorized to sign for and in behalf of the Municipality, in a Memorandum of Agreement
with all the barangays concerned, setting forth therein the terms and conditions on the proper
implementation of the project and the utilization of fund, thus, transferred, incorporating therein as
an integral part, among others, the program of work and other relevant documents of the project.
RESOLVED FURTHERMORE, that to effectively carry out the provision of this resolution,
the Office of the MPDC is hereby designated as the coordinating office between the barangay and
municipal governments in facilitating the transfer of funds, where as such, shall assist the
barangays in complying with the requirements such as but not limited to the making of programs of
work, disbursement vouchers, preparation of the final list of municipal aids per barangay and the
like;
RESOLVED FINALLY, that upon approval of this resolution, the Hon. Mayor, the Honorable
Members of the Local Finance Committee and the 44 barangays through their respective barangay
captains be furnished a copy of this resolution for their information and appropriate action.

WHEREAS,
incident to the vested function of every local government unit in the exercise of
their devolved functions and responsibilities pursuant to the enactment of the
Local Government Code of 1991 relative to the provision of basic services and
facilities, especially those pertaining to social welfare services, is the coordination
with appropriate government agencies for youth and children development
projects and programs;

this august body deems such program as necessary and beneficial for the
development of the children and the youth within the municipality as a way of
facilitating efforts in the promotion of their general welfare, thus consents the Local

under this feeding program around 2,282 day care pupils, more or less, in all the
61 day care centers of the Local Government of Guinobatan are bound to benefit
in this anti-poverty and hungry alleviation program of the government for 120 days
at Php 13.00 per pupil per day with a total cost of Php 3,558,360.00, more or less.
FURTHER, that copies of this resolution be furnished the Hon. Regional Director
of the DSWD, Regional Office No. V, the Hon. Mayor, the office of the MSWD and
all the Day Care Workers of the Guinobatan, Albay for their information and
appropriate action.

WHEREAS, Purok 6 of Banao, this municipality, had been inspected by the Albay Electric
Cooperative, Inc. and properly identified to be qualified under the Sitio Electrification
Program of the DOE and the Electric Cooperative;
WHEREAS, an endorsement resolution to this effect from the Sangguniang Bayan is necessary
for the same to be acted upon by the Department under its Sitio Electrification
Program funded by ER-194 in cooperation with Aboitiz Power Renewable Inc.
(APRI) as per letter dated June 24, 2013 by Atty. Veronica T. Briones, Project
Supervisor of the Electric Cooperative;
WHEREAS, this project if approved and implemented is expected to benefit about 30 households
and the cost is estimated at Php 401,270.50;
WHEREFORE, in view of the foregoing, be it now:
RESOLVED, as it is hereby resolved by the Sangguniang Bayan of Guinobatan, Albay in session
assembled, to endorse as it favorably endorses to Albay Electric Cooperative, Inc.
and the Department of Energy the electrification of Purok 6, Barangay Banao,
Guinobatan, Albay under the Sitio Electrification Program of the Department of
Energy in cooperation with the Aboitiz Power Renewable, Inc. (APRI).

WHEREAS, the Annual Investment Program (AIP) of the Municipality of Guinobatan, Albay for
the year 2013 embodies the various programs/projects/activities of the municipality
in which, through this, the local government would be able to effectively and
efficiently deliver the basic services and facilities which they envision to provide to
their constituents during their tenure;
WHEREAS, as part of the short and long term investment programs of the LGU for the
development
of
the
municipality,
the
approval
of
additional
programs/projects/activities becomes inevitable and necessary;
WHEREAS, these additional programs/projects/activities which are to be embodied in the
forthcoming supplemental budgets must be included in the AIP for the year 2013 or
that such AIP be updated to include them considering that such is a condition
precedent in the preparation of a budget;
WHEREFORE, in view of the foregoing premises, be it now:
RESOLVED, as it is hereby resolved by the Sangguniang Bayan of Guinobatan, Albay in session
assembled, to approve as it hereby approves the updating of the Annual Investment
Program of the Municipality of Guinobatan, Albay for the Year 2013 to include
Projects/Programs/Activities in the forthcoming Supplemental Budget.

RESOLVED FURTHER, that the copy of the additional items to be included in the AIP for CY
2013, subject of this resolution, as duly endorsed by the MPDC last July 15, 2013, in

WHEREAS,
the Sangguniang Bayan of Guinobatan, Albay was in
receipt on August 19, 2013 of a Certificate of Urgency
from the Local Chief Executive, certifying as urgent the
passage of this resolution which the Sangguniang Bayan
considered immediately in a Special Session;
WHEREAS,
the municipal mayor as the chief executive of the
municipal government, shall exercise such powers and
perform such duties and functions as are directly or
indirectly concerns the efficient and effective governance
the purpose of which is the general welfare of the
municipality and its inhabitants pursuant to Section 16 of
the Local Government of 1991;
WHEREAS,
in view of the above-mentioned mandate of the Local
Government Code of 1991, the Municipal Mayor shall
exercise general supervision over all the activities of the
municipal government, among others, and in connection
with this, shall represent the municipality in all its
transactions, upon authorization of the Sangguniang
Bayan;
WHEREAS,
this august body deems it necessary, appropriate
and beneficial to authorize the Municipal Mayor to
represent the municipal government in any suit/case that
it may be involved with in view of the pertinent powers
and functions of the municipal mayor and the
indispensability of a representative during such times;
WHEREFORE, in view of the foregoing premises, be it now:

WHEREAS,
the Local Government of Guinobatan and Rural Bank
of Camalig, Inc. have an existing Memorandum of
Agreement (MOA) regarding Group Accounts Loan
Program that enables the formers permanent employees

means;

WHEREAS, every local government unit shall exercise the powers expressly granted,
those necessarily implied therefrom, as well as powers necessary, appropriate, or incidental for its
efficient and effective governance, and those which are essential to the promotion of the general
welfare, and as such, shall ensure and support among other things, the promotion of health and

WHEREAS, the KALAHI-CIDSS is one of the poverty reduction programs implemented by
the Department of Social Welfare and Development utilizing Community Driven Development
(CDD) as a primary strategy wherein the Province of Albay is one of three (3) pilot provinces of this

WHEREAS, this project seek to pilot an enhanced role for the provincial local government
units in using CDD to help constituent municipalities, like Guinobatan, in planning, budgeting, subproject implementation and monitoring and evaluation;
WHEREAS, while all municipalities in Albay are included in the PLGU-led KC-CDD Project,
all however, will be subjected to an enrolment process, and only those eligible sub-projects
selected through participatory process will be provided with grants under the project;

WHEREAS, on August 23, 2013, the documents for her appointment
was forwarded to, and received by the Sangguniang Bayan
for its concurrence;
WHEREAS,on August 30, 2013, the Sangguniang Bayan acting on its
legal mandate, has called for a committee meeting and
finds that the appointee has met the necessary
qualifications/requirements of the position and is

WHEREAS, every local government unit shall exercise the powers expressly granted,
those necessarily implied therefrom, as well as powers necessary, appropriate, or incidental for its
efficient and effective governance, and those which are essential to the promotion of the general
welfare, and as such, shall ensure and support among other things, the preservation and
enrichment of culture as well as of comfort and convenience of their inhabitants (Section 16, RA
7160);
WHEREAS, every year the Local Government of Guinobatan by presidential and provincial
declarations is the center of a provincial celebration and commemoration of a National Hero, in the
person of the late General Simeon Arboleda Ola, who was a pure-bloodied Guinobateo and
nationally known and recognized in Philippine history to be the last Filipino General to vow to the
Americans during the Filipino-American War;
WHEREAS, in fitting honor to his heroism, a monument right at the center of his
hometown, Guinobatan, was built since early 90s, the PNP Regional Camp in Legazpi City was
renamed after him from Camp Ibalong to Camp Gen. Ola, and September 2 of each year, his birth
anniversary, is declared a special non-working holiday for all Albayanos to pay respect on this man
whose gallantry and patriotism had led his fellowmen to freedom, which we all enjoy now;
WHEREAS, in 2012 the Local Government of Guinobatan had planned to expand the Gen.
Ola National Shrine and an Ola/Guinobatan Museum was started to be constructed beside his
monument in the continuing pursuit of the Guinobateos to further preserve and inculcate in the
minds of the present and future generations the bravery and the true spirit of a Guinobateo

national hero, which this noble plan, however, was unduly interrupted and not completed due
primarily to the ending of the term of officials;
WHEREAS, according to the plan, the completion of this project will entail a cost of more
or less Five Million Pesos, and its completion will be complementary to the flagship program of the
Provincial Government on Tourism, by having another Tourist, Historical and Educational
Destination in the 3rd District of Albay;
WHEREFORE, in view of the foregoing premises, be it now:
RESOLVED, as it is hereby resolved by the Sangguniang Bayan of Guinobatan, Albay in
session assembled, to request as it hereby request the Provincial Governor of Albay, Hon. Joey
Sarte Salceda to allocate funds amounting to Five Million Pesos (PHP5,000,000.00) for the
construction/completion of the Ola Shrine located at Barangay Iraya, Guinobatan, Albay.
RESOLVED FURTHER, that the Proposed Program of Work for the completion of the
project, subject of this resolution, is hereto attached and made an integral part hereof and marked
as Annex A for reference and perusal of the Honorable Governor.
RESOLVED FINALLY, that a copy of this resolution be furnished the Hon. Governor and all
other persons concerned for their information and appropriate action.

WHEREAS,
the Sangguniang Bayan of this municipality recognizes the need for improving and
providing adequate means of communications between and among the members
of local sanggunian, the different heads of the LGU, barangay officials and other
officials in the municipality, in the province and most especially in the national level
and abroad where most of the time are being requested with funds for local
development;
WHEREAS,

as it is already settled in todays modern time, the fastest and cost effective ways
to make such coordination possible is through the use of mobile phones;
WHEREAS,
the recognition of the municipality of its vital importance in its official functions and
transactions cannot however be permitted without any limitation to safeguard the
use of public money for this purpose;

RESOLVED FURTHER, that only the following elective and appointive officials of the LGU, who by
the nature of their work being head of an Office or Sub-Office in Permanent or OIC
capacities, shall enjoy the privilege for communication expense-moblie and shall
be allocated strictly under the following manner:
1. Elective Official.
a.) The Mayor is entitled to allocate under its office an amount not exceeding Php5,000.00 per
month for communication expensemobile.
b.) The Vice Mayor is likewise entitled to allocate under his office an amount not exceeding
Php3,500.00 per month for communication expensemobile.
c.) Every Member of the Sangguniang Bayan are also entitled to provide an allocation under
their communication expenses-mobile up to Php2,500.00 pesos per month.
2. Appointive Local Officials.
a.) All appointive office heads in permanent capacity of the municipality and/or those whose
salary grade is 24, are entitled to allocate under their respective office budgets an amount
not exceeding Php2,500.00 pesos each per month.
b.) All other appointive local officials who are designated as head of an office or sub-office
with plantilla permanent personnel of not lower than 3, whether as OIC or in acting
capacity, in the absence of permanent head of office, are likewise entitled to allocate under
their respective office budgets an amount not exceeding Php1,800.00 pesos per month.
RESOLVED FURTHERMORE, that the adjusted allocation for communication expense-mobile
shall always depend upon the availability of funds and shall take effect upon the
approval of the office budget for this purpose. Failure of the Office to allocate
funds for a particular period can no longer avail of this adjustment retroactively.
Hence, in no case shall the adjustment subject of this resolution be effected earlier
than the month of September, 2013.
RESOLVED FINALLY, that a copy of this resolution which repeals Municipal Resolution No. 0292004, be furnished the office of the Mayor, the heads of offices and all other
concerned personnel for their information and guidance.

WHEREAS,
embodied and approved under Appropriation No. 01-2013, other otherwise known
as the Annual Budget for CY 2013 of the municipality is an appropriation item for
the Purchase of Generator 3KVA, Capital Outlay, in the amount of PhP30,000.00
under the office of the SB Legislative;
WHEREAS,
during the canvassing made of our personnel in-charge in the procurement, the
appropriated amount of PhP30,000.00 can even afford to buy a generator that is
higher in voltage up to 5KVA;
WHEREAS,
accordingly, the higher voltage, the better for the Sangguniang Bayan in order to
operationalize all its indispensable office equipments vital for its operation like the
computers, photocopier, tape recorder and the printers during power interruption
which a 3KVA generator cannot operate all simultaneously;
WHEREAS,
the documents necessary for the purchase of the 5KVA cannot be effected unless
the term under the approved appropriation ordinance is not correspondingly
changed/adjusted by way of this resolution as per advise by the Budget Officer
and other concerned personnel on procurement;

this plan of the Sangguniang Bayan to purchase generator had long been
programmed being a necessity considering that the municipality together with the
province constantly experience brownouts/power outages that disrupts office
functions and deprives its constituency with the delivery of the much needed
services because of an insurmountable indebtedness of the power cooperative
from its energy suppliers.

Typhoons Reming & Juaning, which brought immense destruction not only in
Guinobatan, but throughout Albay Province since 2006, numerous infrastructure
facilities had been damaged within the municipality, including the subject bridge of
this resolution, situated at Sitio Sagaysay, Barangay Maguiron, this Municipality;
WHEREAS,
this 5-Ton primary bridge at barangay Maguiron serves not only its residents living
in the highland district of the municipality, but as well as passengers, merchants
and travellers, among others from the towns of Jovelar and part of Camalig, as a
convenient access to and from the urban centers and a vital link sooner or later, to
the Bicol International Airport in Alobo, Daraga, Albay and the Donsol- Jovelar ByPass Road when finally opened;
WHEREAS,
numerous typhoons are still expected to visit the municipality within this year and
in the coming years, thus, said bridge, if not immediately and promptly
rehabilitated, would result in its subsequent destruction, and as a necessary

in the exercise of the vested powers and functions upon every local government
unit which are essential in the promotion of the general welfare, they shall make
an effort of providing basic services and facilities necessary, appropriate and

services, and incident in this function is the need to find ways of realizing these
endeavours, such as resort to other effective and efficient sources imbued with the
much needed capabilities, resources and facilities;

through the Hon. Bicol Regional Director of the DPWH, Honorable Danilo E.

Clinics,Inc. with principal address at 34 th Floor, RCBC Plaza Tower II, 6819 Ayala Avenue, Makati
City, and through the representation of its General Manager, is offering to the Local Government of
Guinobatan its medical services which specializes on supplying vaccines on animal bites and other
diseases accompanied by an extra commitment of establishing a center and facilities for the proper
treatment of animal bite victims;
WHEREAS, along this line, the Municipal Government of Guinobatan taking cognizance of
the existence of a number of animal bite incidences in the municipality most especially from dogs,

where most of the victims belong to indigent family or have no sufficient financial capability to
finance its treatment, finds this offer as timely, beneficial and advantageous to the government and
its inhabitants;
WHEREAS, after due consultation and exchanges of ideas with all the concerned persons
from and among the local government and the corporation, a memorandum of understanding had
been reached and forged, outlining the terms and conditions that they deem fit and acceptable to
both parties;
WHEREFORE, in view of the foregoing premises, be it now:
RESOLVED, as it is hereby resolved by the Sangguniang Bayan of Guinobatan, Albay in
session assembled, to grant as it hereby grants the Honorable Ann Y. Ongjoco, Municipal Mayor of
Guinobatan, Albay to enter into a Memorandum of Agreement with the Family Vaccine and
Specialty Clinics, Inc. represented by its general manager, Mr. Jose S. San Agustin for the
Establishment of Human Rabies Management and Treatment Clinic in the municipality.

WHEREAS, this move will likewise decongest/free Poblacion from traffic which is now being felt
and expected to be a major problem in the near future just like in any other
developing places;
WHEREAS, this new business outlook/climate of the town once realized, will bring more
attraction to businesses which will certainly boost our economy, our road to
economic prosperity;

assembled, to request as it is respectfully requesting the Municipal Mayor and the

be created by the Honorable Mayor solely for the purpose of carrying out the
objectives of this resolution who will be tasked among others, the identification of the
lot/site in Barangay San Rafael, including the negotiations for the purchase of the
same in favor of the LGU and eventually its development for the stated purpose.

WHEREAS, this move will likewise decongest/free Poblacion from traffic which is now being felt

WHEREAS, this new business outlook/climate of the town once realized, will bring more

WHEREFORE, in view of the foregoing premises, be it:
RESOLVED, as it is hereby resolved by the Sangguniang Bayan of Guinobatan, Albay in session
assembled, to request as it is respectfully requesting the Municipal Mayor and the
Municipal Development Council to consider in the 2014 Annual and Economic
Development Budget the establishment of a Bus Terminal and Pasalubong Center
somewhere in barangay San Rafael of this municipality.
RESOLVED FURTHER, that should this request be favorably granted, an ad hoc committee must
be created by the Honorable Mayor solely for the purpose of carrying out the
objectives of this resolution who will be tasked among others, the identification of the
lot/site in Barangay San Rafael, including the negotiations for the purchase of the
same in favor of the LGU and eventually its development for the stated purpose.
RESOLVED LASTLY, that a copy of this resolution be furnished the Hon. Mayor and Members of
the MDC through the MPDC, for their information and appropriate action.

speak are still vacant and therefore, very much affordable on the part of the LGU as
compared when you will acquire them 10 more years from today;
WHEREAS, these new economic centers or growth areas being envisioned in this resolution
involve among others the development/preparation of new commercial sites that will
cater for Satellite Markets, in some noted emerging center-barangays of the town,
such as the Barangay of Masarawag in Mayon District, Barangay of Mauraro in MidHigland Areas and Barangay Sinungtan in Highland Territory where the municipality
has an existing mini-market since the 90s;
WHEREAS, this noted momentum and road for economic prosperity may only be sustained
through the expansion of our avenues for trade & commerce and unless it is
anticipated now the sustainability in the future of our envisioned equal distribution of
development for all will be far from its realization;
WHEREFORE, in view of the foregoing premises, be it:
RESOLVED, as it is hereby resolved by the Sangguniang Bayan of Guinobatan, Albay in session
assembled, to request as it is respectfully requesting the Municipal Mayor and the

Mayon Area, Mauraro & Highland District.

Section 287 of the Local Government Code of 1991, mandates all local government units to
appropriate in its annual budget no less than twenty percent (20%) of its internal revenue
allotment for development projects;
WHEREAS,
in CY 2014 the 20% development fund of Guinobatan, Albay will reach about Php 25 Million
and with a better outlook of increasing in the succeeding years;
WHEREAS,
under Article 419, paragraph (c) of the Rules and Regulations Implementing the Local
Government Code of 1991, provincial, city and municipal governments are mandated to
provide aid to barangays;
WHEREAS,
with these guideposts, the Municipal Government of Guinobatan, through the Municipal
Development Council, provides an annual allocation of a considerable amount in the 20%
Development of the municipality commonly known as the municipal aid to priority
development projects of all the 44 barangays of the municipality;
WHEREAS,
this year, the Municipal Government of Guinobatan and the Municipal Development Council
earmarked an amount of Php 100,000.00 for every barangay to substantially augment its
funding for the much needed projects of the 44 composite barangays to propel development
or growth in the countryside;

WHEREAS,
this act of the Municipal Government is in recognition of the need of barangays to be fully
supported financially and to have an equitable share in the proceeds from its development
funds which are likewise in accord with the LGUs goals, plans and programs, foremost of
which is to equitably allocation its resources to attain a fair and balanced development
throughout the municipality and not only on its urban commercial district;
WHEREAS,
increasing the share of the barangays from the development fund of the municipality from
the present Php100,000.00 to Php 150,000.00 in the Year 2014 and beyond, is very much
manageable on part of the municipality as it is only about Php6.6 Million compared to the
Php 18 Million more remaining for the LGU to dispose/allocate for its own priority
development projects;
WHEREAS,
by honoring this request, the Honorable Mayor and the MDC crystalize further the
cooperative undertakings among LGUs as mandated under Section 33 of the RA 7160,
where local government units may consolidate, or coordinate their efforts, services and
resources for purposes commonly beneficial to them and finally, it will bolster our States
declared policy unto its territorial and political subdivision like the barangays to enjoy
genuine and meaningful local autonomy to enable them to attain their fullest development as
self-reliant communities and make them effective partners in the attainment of municipal and
national goals.

FURTHER, that should this request be favorably granted, it is further requested that these
funds be downloaded to the barangays in accordance with Municipal Resolution No. 042013, but only if the concerned barangay apply or opted for the said transfer.

RESOLVED,
as it is hereby resolved by the Sangguniang Bayan of
Guinobatan, Albay in session assembled, to grant as it
hereby grants a one month provisionary Municipal Tricycle
Opertions Permit (MTOP) to 107 qualified franchise applicants
as screened and recommended by the Task Force Kaayusan
taken from 64 unclaimed franchise numbers and 43
dropped/surrendered and cancelled franchise numbers that
were declared vacant and available for award.

FURTHERMORE, that any of the above-named grantee who shall remain deficient of
the abovementioned requirements after the 1-month provisionary period shall mean an
automatic exclusion from the list of tricycle franchise holders and those who shall
completely comply the remaining requirements shall be permanently included in the
official list of tricycle franchise holders in LGU-Guinobatan who are eligible to renew
every year but without prejudice however, from its revocation for cause/s authorized by
the code. All payments made by the grantees who shall remain deficient after the
provisionary period shall be forfeited in favor of the LGU.

and appropriate action.

WHEREAS, the Annual Investment Program (AIP) of the Municipality of Guinobatan, Albay for
the year 2013 embodies the various programs/projects/activities of the municipality
in which, through this, the local government would be able to effectively and
efficiently deliver the basic services and facilities which they envision to provide to
their constituents during their tenure;
WHEREAS, as part of the short and long term investment programs of the LGU for the
development
of
the
municipality,
the
approval
of
additional
programs/projects/activities becomes inevitable and necessary;
WHEREAS, these additional programs/projects/activities which are to be embodied in the
forthcoming supplemental/augmentation budgets must be included in the AIP for the
year 2013 or that such AIP be updated to include them considering that such is a
condition precedent in the preparation of a budget;
WHEREFORE, in view of the foregoing premises, be it now:
RESOLVED, as it is hereby resolved by the Sangguniang Bayan of Guinobatan, Albay in session
assembled, to approve as it hereby approves the updating of the Annual Investment
Program of the Municipality of Guinobatan, Albay for the Year 2013 to include
Projects/Programs/Activities in the forthcoming Supplemental/Augmentation
Budgets.
RESOLVED FURTHER, that the copy of the additional items to be included in the AIP for CY
2013, subject of this resolution, as duly endorsed by the MPDC, in the amount of in
the amount of Php20,356,398.00, general fund and Php3,615,000.00, special accounts, is
hereto attached and made an integral part of this resolution and marked as Annex
A.

WHEREAS, the standing fund of the drivers association in the annual budget for 2013
amounting to SEVENTY-FIVE THOUSAND PESOS (Php75,000) is not enough to cover the
proposed expenditures in the Financial Plan of the GUTODA for all the 9 Paradas present in the
municipality;
WHEREAS, the total amount available for appropriation as certified by the Municipal
Accountant of this municipality amounted to TWO HUNDRED TWENTY ONE THOUSAND EIGHT
HUNDRED FOURTY SIX PESOS AND EIGHTY ONE CENTAVOS (Php221,846.81), and thus, the
amount needed for supplemental budget to cover the proposed expenditures is ONE HUNDRED
FORTY SIX THOUSAND EIGHT HUNDRED FOURTY SIX PESOS AND EIGHTY ONE
CENTAVOS (221,846.81 75,000 = 146,846.81);
WHEREAS, to encourage the drivers to develop the spirit of cooperation and unity toward
an orderly and accident free traffic in the Municipality of Guinobatan, the committees affirmed the
proposal to include gasoline subsidy in the amount of NINETY FIVE THOUSAND EIGHT
HUNDRED FORTY NINE PESOS (Php95,849.00), Enhancement Training in the amount of FIFTY
FOUR THOUSAND EIGHT HUNDRED (Php54,800.00), GUTODA SEC Registration as part of the
Financial Plan in the amount of THREE THOUSAND PESOS (Php3,000.00), and Parada tents in
the amount of ONE HUNDRED SEVENTEEN THOUSAND PESOS (Php117,000);
WHEREAS, to augment the funding source, the Office of the Mayor has committed FIFTY
THOUSAND PESOS (Php50,000.00) from the Donation to the Parada Priority Development
Assistance Fund, thus making the aggregate amount available for appropriation to TWO
HUNDRED SEVENTY-ONE THOUSAND EIGHT HUNDRED FORTY SIX PESOS AND EIGHTY
ONE CENTAVOS (Php271,846.81);
WHEREFORE, in view of the foregoing premises, be it now:
RESOLVED, as it is hereby resolved by the Sangguniang Bayan of Guinobatan, Albay in
session assembled, to concur as it hereby concurs the herein work and financial plan of the Task
Force Kaayusan and GUTODA for Parada Priority Development Assistance Fund (PPDAF) for
Calendar Year 2013.

as the re-formulation of its Zoning Ordinance.
RESOLVED FURTHER, that a copy of the Draft Memorandum of Agreement
subject of this resolution is hereto attached and made an integral part hereof and marked
as Annex A and involves an amount of Php 850,000.00 as cost of this project.
RESOLVED FINALLY, that a copy of this resolution be furnished the Offices of the

Absent:
WHEREAS,
the Rural Health Unit (RHU) of Guinobatan serves more or less 90,000 inhabitants
or 19,000 households as per survey conducted by the LGU last 2010, and
provides, among others, medical services reaching up to 150 patients per day, and
dental services reaching 50-70 patients per day, and this number is expected to
continuously increase in the coming years;
WHEREAS,
WHEREAS,
all these programs and projects relative to health are being carried out through the
RHU which is located in the compound of the Bicol University College of
Agriculture and Forestry (BUCAF) in a very minimal area taking into consideration
the number of inhabitants/patients which depend upon its services and visit the
place every day;
WHEREAS,
the local government envisions the provision of a more efficient, improved and
expanded implementation of health programs and services, such as but not limited
to, the addition of doctors/dentists, on-going establishment of a lying-in clinic and
segregation of patients depending on their respective illnesses, which can be, in

actual fact, achieved through the construction of additional health facilities. Thus,
in order to realize this intention, it is regarded by this august body as necessary in
the interest of public service, beneficial to the inhabitants, and practical taking into
consideration the current location of the RHU which is in the BUCAF compound, to
request an additional area of one (1) hectare, for its improvement and expansion
by constructing a new building separate and independent from it, in the form of a
Municipal Hospital;
WHEREFORE, in view of the foregoing premises, be it now:

RESOLVED FURTHER, that a copy of this resolution be personally furnished to the Bicol
University by the Hon. Mayor Ann Yap Ongjoco considering the importance and
the nature of this resolution.
