Page 2 ‘Sam’s Shooters Emporium I Inspection Nr, 317857316 ‘Coverage Information/ Additional Comments inspection Number [347057316 COVERAGE INFORMATION: (On August 27, 2014 based on an accident, which ocourred on August 25, 2014, an inspection was conducted of R & S Firearms, Inc. The accident occurred at an outdoor shooting range located at 20606 N US Hwy 93 Unit B, White Hills, AZ 86445. R & S Firearms, Inc. dba Sam's Shooters Emporium II opened on January 17, 2013, and provides patrons the opportunity to shoot a large assoriment of firearms including pistols, submachine guns, sniper rifle and a crew served weapon (M2 50 cal.). The incident occurred when Charles Vacca, an employee of R & $ Firearms, Inc,, was instructing a nine year old girl on an Israel Miltary Industries Ltd. (IM), 9 mm, mini-Uzi (serial number MU 03167). ‘According to an employee interview and a video taken by the nine year old gir's mother, the nine year old gi was provided a safety brief prior fo stepping up to the firing line. The gitl fired five shots from a Smm pistol prlor to fring the mini-Uz The girl was then given additional instruction priar to fring one round on semi-automatic from the mini-Uzi, Then Mr. Vacca switched the mini-Uzi to automatic and let the gil fire. The gil pulled the trigger. After the first round was fired, the gir Jost contro! of the min|-Uzi when the forward hand grip came out of the git’ left hand as the barrel elevated up and to the {oft. Mr, Vacca was care fighted to University Medical Center Las Vegas where he succumbed to his wounds and passed on August 25, 2014. During the inspection management statements were taken, employees were interviewed; documents, photos, and a video were also reviewed. In addition, surveys of other companies that offer similar experiences of shooting weapons were taken. The oniy similarity with the companies surveyed in regards to age, weapons, safety briefs, and instructors was that each of the surveyed companies had NRA cerlified instructors. Sam's Shooters Emporium Il owners Sam Scarmardo was a NRA Ceriified Instructor and Ellyn Scarmardo was a NRA Certified Trainer (conducts NRA instructor training courses). Sam's Shooters Emporium Il employees received training from both the owners, including an NRA course, This training was @ ‘weeklong compared to the NRA Instructor course for pistol, shotgun, of rifle of one to two days, Based on the inspection there were no apparent violations of OSHA Standards relating to the incident itself. However, other apparent violations of OSHA Standards were observed during the inspections. Detaiis of these violations are in the attached worksheets. FINDINGS (Mark the applicable boxes with an " and explain findings) x_] Complaint items: Item 1: Employees are exposed to dangerous range activities in that each range officer Is to provide a very hast safety breifing to hurry the tour group through their shooting experience. The danger is not having a thorough training to ensure each patron is able to shoot safely. Tour drivers rush range officers to hurry through their safely process, putting range cadre in harm's way. Response: Based on inspection which included management statements, employee interviews, range safety rules, and safely breifings, given prior to patrons handling weapons and approaching the firing line, there were no appaernt violations ‘of OSHA Standards. This condition does not represent an apparent violation of OSHA Standards, ‘ADOSHI-1AGRev, 6199) Page 3 ‘Sam’s Shooters Emporium IE Inspection Nr. 317857316 x_] Accident Investigation Summary & Findings Notification & Synopsis: Notification: (On August 26, 2014, a complaint (209168855) was received alleging range cadres are rushed through patron's safely briefings, thereby putting range cadre in harm's way. On August 26, 2014, CSHO Supervisor J R Imes received a telephone call from Sergeant Jason Thien from the Mohave County Sheriff office, who called to report an employes of Sam's Shooters had died following Injuries that occurred on August 25, 2014. Summary: On August 27, 2014 based on an accident, which occurred on August 25, 2014, an inspection was conducted of R & $ Firearms, Inc. The accident occurred at an outdoor shooting range located at 20606 N US Hwy 93 Unit B, White Hills, AZ 86445, R & S Firearms, Inc. dba Sam's Shooters Emporium Il opened on January 17, 2013, and provides patrons the ‘opportunity to shoot a large assortment of firearms Including pistols, submachine guns, sniper rife and a crew served weapon (M2 50 cal). The Incident occurred when Charles Vacca, an employes of R & § Firearms, Inc., was instructing ‘a nine year old git! on an Israel Miltary Industries Lt, (IMI), 9 mm, mini-Uzi (serial number MU 03167). ‘According to an employee interview and a video taken by the nine year old git's mother, the nine year old gir was provided a safety brief prior to stepping up to the firing tine. After the first round was fired, the girl lost control of the mini-Uzi when the forward hand grip came out of the gir’s left hand as the barrel elevated up and to the left. Multiple rounds were fired before the gil dropped the mini-Uzi. Mr. Vacca was standing in a slightly bent-over position directly (0 the girs left. One of the rounds struck Mr. Vacca in the head. Mr. Vacca was care fighted to University Medical Center Las Vegas where he succumbed to his wounds and passed on August 25, 2014. The Video: The video shows Mr. Vacca instructing a nine year old gil on fring @ mini-Uzi. Tho gil was standing with her feet parallel tothe firing line. Ifthe target was located at 12 O'clock, the ait’ feet were pointed to 3 o'clock and approximately shoulder width apart. The git's upper body was slightly twisted counter clockwise at an approximate 60 degree angle. Mr, Vacca was standing directly behind the girl at the 9 o'clock position. Mr. Vacca’s feet were also parallel to the firing line. Mr. Vacca's forward (left) foot was forward of the air’s forward foot and Mr. Vacoe's rear foot was slightly further back than the gif’ rearfoot. Mr. Vacca was standing approximately 1 1/2 to 2 feet behind the git in a slightly bent-over position with his head slightly aver the git's forward (left) shoulder. Mr. Vacca's right hand was located in the center of the gir's back while his left hand was beneath the mini-Uz"'s magazine. ‘The video is 29 seconds long. The video starts with Mr. Vacca holding the mini-Uzi and giving the git! some instruction cn holding the weapon. Mr. Vacca then hands the weapon to the gil and adjusts how she holds the weapon, Mr. Vacca then adjusts the gir's stance. It appears Mr. Vacca places the weapon's selector switch from safe to repeating and says ‘aright go ahead and give me one sho.” The gil fires one round. Then it appears Mr. Vacea places the weapon's selector switch from repeating to automatic and says “alright full auto." The gil pulled the trigger. After the frst round was fired the Git! lost control of the mini-Uzi when the forward hand grip came out of the gits left hand as the barrel elevated up and {o the left. Multiple rounds (four rounds were left in the magazine) were fired before the girl dropped the mini-Uzi. One of the rounds struck Mr. Vacca in the head. Investigation Details: August 27, 2014, at approximately 08:53 am, CSHO Mitch Baird and | arrived at the Mohave County Sheriff office and made contact with Sergeant Jason Thien. At that time the Sherif's report of the incident had not been completed. St ADOSHL-IA(Rey. 6/93) Page 4 Sam’s Shooters Emporium If Inspection Nr, 317857316 Thien provided me with a video and photographs taken at the site. CSHO Mitch Baird and | departed the Mohave County Sheriff office at approximately 09:30 am. August 27, 2014, at approximately 10:40 am, CSHO Mitch Baird and | arrived at 20606 N US Hwy 93 Unit B, White Hills, ‘AZ 86445. At approximately 10:50 am an opening conference was conducted with Manager Mark Elson, ‘The facility was one small building located directly off of US Hwy 83, The facility had two ranges, a short range and a long range. Pistols, sub-machine guns, and rifles were shot on the short range. Belt-fed machine guns and sniper rifles were fired on the long range, The two ranges were excavated and sit below grade, The ranges were located just over 100 yards from the building. The faclity provides patrons, either by waik up or as part of a tour, the opportunity to shoot a large assortment of semi-automatic and automatic weapons ranging from a Smm pistol to a crew served weapon (M2 50 cal.) mounted on a jeep. The short range firing line had two positions. Each position had a concrete pad that measured 8' 5" long and 6 wide. The concrete pads were separated by a 3' wide table. The lable formed a “T" that ran between the shooting positions anc front of the firing positions. The length of the table in front of the shooting positions was approximately 15° 10°. Shooters slood behind the tables and fired in the northeast direction with targets located approximately 31" from the forward edge of the table. ‘After the opening conference Mr. Elson walked us down to the ranges and through the facility. Mr. Elson discussed the ‘events surrounding the incident. Mr. Elson said that the group that was shooting at the time of the incident was on a tour with Bullets and Burgers. Bullets and Burgers Corporation is a company located in Las Vegas, Nevada, that books tours and provides transportation. ‘Their tours and packages include such things as exotic cars, monster truck rides, helicopter flights of the Grand Canyon, and firing automatic weapons. ‘A family on vacation booked their tour through the Bullets and Burgers Corporation. Bullets and Burgers Corporation, ‘Owner, Russ Mann provided a rough timeline for the tour prior to arriving at the range. The parly was picked up al the Four Seasons in Las Vegas at approximately 8:00 am on August 25, 2014. The tour stopped al the Hoover Dam from 8:30 am to 9:00 am. The tour arrived on site at approximately 9:30 am. According to a statement provided by a member of the tour, to a Mohave County Sheriff officer, they estimated their arrival al 9:45 am. The tour then took a ride on a monster truck. After the monster truck ride they were brought over to the shooting range. The father of the nine year old girl stated in his interview with an officer that he was the first to shoot. Three employees were working on the day of the incident, a store manager and two range coaches. A tour of six arrived to shoot. ‘The two range coaches, Mr. Vacca and Ross Miller, were the instructors for the tour. The store manager did not ‘90 down to the range with the shooters and range coaches. A safety brief was given to the tour down on the range, Mr. Elson said the safety brief takes approximately five to ten minutes. Prior fo shooting, hearing and eye protection are handed out. Range coaches ate one on one with the shooters when they are on the fring line. Once on the firing, line range coaches cover additional information more specific to each weapon such as holding the weapon, stance and sighting. Everyone on tour gets five shots from a 9mm pistol first. Onoe rounds for the Omm pistol are fired then the range coaches covers the same topies with the next weapon. Range coach Ross Miller said that they typically get a phone call when a tour is about 30 to 35 minutes out. This gives them time to prepare for the weapons being fired. When asked if he or Mr. Vacca had any concerns with a nine year old girl shooting the mini-Uzi. Mr. Miller said that he suggested, by phone, to the tour driver Rick, thal the min-Uzi was too quick for a nine year old female. Mr. Miller was told that it was not his call. Mr. Miler said that he did not bring up his concern to anyone else. In the past when Mr. Millor had voiced his concerns, he said that his concerns had been addressed. Mr. Miller considers the mini-Uzi as the most dificult ‘weapon for a child, "Mr. Miller said, when referring fo the mini-Uzi, that it "Is just all too quick for a child.” The mini-Uzi has a rate of fire of approximately 950 rounds per minute. That is about 16 rounds per second. The weapon weights about 6 pounds without a magazine and measures approximately 23 1/2 inches with the stock out. The mini-Uzi ADOSH-IA¢Rey. 6/93) Page 5 Sam’s Shooters Emporium If Inspection Nr. 317887316 had a three-position "ARS"-style selector lever located at the top of the pistol grip and behind the trigger group. The rear position is 'S", or "safe", which locks the sear and prevents movement of the bolt. One notch forward is the middle position *R", or repeating’, which will allow the weapon to function in semi-automatic single shot mode, requiring the trigger to be pulled for each shot. When the switch is placed all the way in the forward position “A”, or “automatic the weapon will continue to fire as long as the trigger is pulled or until the magazine is empty. The min-Uzi the gif ‘was firing had a magazine loaded with a 20 rounds. Mr. Miller said that there were no weapon imitations for shooters. Mr. Miller said that all they (range coaches) are able to do fs make recommendations to either the Bullets and Burgers Corporation's tour driver or the shooters themselves. Mr. Miler said it has been a battle between the tour drivers and them (range coaches) as the tour drivers were selecting the weapons, Prior to the incident the tour drivers were selecting the weapons for the shooters. Now, after the incident, \Mr. Miler said itis up to the range coaches. Mr. Miller said that he was unaware of any quaifications for the tour drivers, to select the weapons. Mr, Miller said that the age limit was eight years old and now, after the incident, the age limit was raised to twelve years ‘old and or five feet tall and above, Mr. Miller said that they get two tours a day, one in the morning and one in the afternoon. A tour can range from one shooter to twelve, Mr. Miller said that there was not a push to go quick. However, when asked If there was no specific time to gel the shooters through, why not spend additional time on safety? Mr. Miter said that the ones that run the tours wanted them to step it up alte more and the drivers give them a hard time some time, Mr. Miller said that he thinks the time frame of when tourists or walk-ins (shooters) arrive at their door to when they are puling the trigger is approximately ten to twenty minutes. Mr. Miller's time frame was confirmed when CSHO Mitch Baird and | observed two patrons arrive on the short range on ‘August 28, 2014. Neither patron had any shooting experience, One of the patrons needed to have everything the range coaches were saying translated by the person they came with. An intraduction was given at 9:23 am followed by safely rules, At 9:33 am the shooters were instructed to put in ear plugs and firing commenced. Mr. Miller said that Mr. Vacca gave the safely brief on August 25, 2014, for the tour when the incident occurred. ‘When Mr. Miller does the safety brief he stated that they are not scripted and covers subjects such as muzzle awareness, stance, position, hand position. After the safely brief shooters are told to put on hearing protection and eye protection. Further instruction is then provided on the specific weapon on the firing ine, Some of the specifics covered are hand placement, but stock placement, and how to fean forward into the weapon to reduce recoll. For automatic weapons, shooters get two safety shots on (semi-automatic) to get used to the recoil. When the shooter is comfortable the shooter lets the range coach know and the range coach will switch the weapon {o automatic, This contradiets what was observed ‘on the video taken of the incident. The video shows the shooter shooting one shot on semi-automatic after Mr. Vacca hands her the weapon. After the girl fires one shot Mr. Vacca switches the weapon to automatic with no discussion or questions with the gi Mr. Miller was instructing another member of the tour group on north side shooting position while Mr. Vacca was instructing the 9 year old gir Mohave County Sheriff office received a call at 10:02 am reporting an accidental shooting. Mr. Miler said that if there was anything that he could have done different he sald that he would defintely stand behind the shooter, off-set, and ready to grab the weapon at all times. Mr. Miler said for a left handed shooter you stand behind the left side with a hand on the shoulder and the other hand ready to reach over and grab the weapon. Don't be on the weak hand side so you don’t have to go over the forearm to grab the weapon, go on the strong arm side so you can go around and grab the weapon. Mr. Miller said that he learned that as a range instructor in the Marine Corps. ‘When asked if there is any written polices here, Mr. Miter said that there is no standard operating procedures here. ADOSH-IA(Rev. 6193) Page 6 Sam's Shooters Emporium IT Inspeetion Nr. 317887316 ‘Company Name: (This section was included after multiple company names were given) August 27, 2014, al approximately 10:50 am, an opening conference was conducted with Manger Mark Elson, After the ‘opening conference Mr. Elson completed the ADOSH Form 100. Mr. Elson identified the company name as R & $ Firearms on the form and the parent company as Sam's Shooters Emporium Il During the walkaround portion of the inspection Mr. Elson spoke with Sam Scarmardo on the phone. Mr. Elson identified Mr. Scarmardo as the owner of R & S Firearms on the ADOSH Form 100. After the phone conversation Mr. Elson asked to change the company name on the ADOSH Form 100 to Sam's Shooters Emporium Il and the parent company to Sam's Shooters Emporium inc. After the opening conference with Mr. Scarmardo at the facllty located at 2183 McCulloch Blvd., Lake Havasu City, AZ ‘86403, Mr. Scarmardo completed an ADOSH Form 100, Mr. Scarmardo initially Identified Sam's Shooters Emporium | as the company name for the business at 2183 McCulloch Blvd with the parent company as AIMS Inc. AIMS Inc. is an ‘acronym for Arizona Indoor Marksmanship Site Inc. Mr. Scarmardo later added R & S Firearms Inc dba Sam's Shooters Emporium { on the ADOSH Form 100 for the company name. Mr. Scarmardo identified himself as a Shareholder/Manager. ‘After the opening conference, Mr. Scarmardo identified the company that operates the range located at 20606 N US Hwy 93 Unit B, White Hils, AZ 86445 as R & S Firearms. Mr, Scarmardo later changed his statement to what he had stated on the ADOSH Form 100 as R & & Firearms Inc dba Sam's Shooters Emporium | for the company located at 2183 McCulloch Bivd. Mr. Scarmardo then identified the company located at 20606 N US Hwy 93 Unit B, White Hills, AZ as ‘Arizona Indoor Marksman Site Inc dba Sam's Shooters Emporium Il (On September 19, 2014, Mr. Scarmardo faxed an OSHA fog, OSHA Summary, and an incident report. The OSHA Form 300A, with the establishment name as AIMS/Sam's Shooters Emporium Il. In an email response from Mr. Scarmardo, dated September 17, 2014, Mr. Scarmardo stated “the facility and employees located at 20606 North US HWY 93 In White Hills, AZ are only employed al AIMS INC./Sam's Shooters Emporium Ilf Last Stop.” ‘An emall was sent to Mr, Scarmardo on September 18, 2014, with the question "How is R & $ Firearms, Inc associated with 20608 N US Hwy 93, Unit B, White Hills and/or 2183 McCulloch Bivd. in Lake Havasu City?" In an email response from Mr, Scarmardo, dated September 18, 2014, Mr. Scarmardo replied "R and S Firearms is the corporate name for 2183 McCulloch Bivd. They are totally unrelated.” ‘On October 9, 2014, Bullets and Burgers Corporation, Owner, Russ Mann sent an email with an attachment of a cheok made out to R & S Firearms dated 8/27/14, The check, in part, covered the tour the family of the nine year old girl was on, ‘Awage inquiry was pulled for Mr. Vacca. The wage inquiry showed Mr. Vacca received wages from R $ Firearms for the first, second, and third quarter of 2014 Safety Program: During the walkaround portion of the inspection on August 27, 2014, Mr. Elson said that he was unaware of a wrilten safety program. After speaking with Mr. Scarmardo, CSHO Mitch Baird and I returned the following day and told Mr. Elson that Mr. Scarmardo said that there was a safety program located at this facilly and that it was In a large binder. Mr. Elson looked for a couple of minutes and located a binder tiled "The National Rifle Association Range Development Operations ‘And Business Planning Workbook.” This Range Development Guidebook contained the following sections: Orientation and Record Keeping, Competitive Shooting, Construction of Indoor and Outdoor Shooting Ranges, Cost Analysis, Developing a Range Safety Plan, Environmental Sound, Insurance Solutions, Law Enforcement and Public Safety, Lead at Outdoor Ranges, Master Plan, OSHA Standard, Public Hearing, Range Maintenance, Range Safety, and Ventliation. As the title ‘of the book describes this manual was a guidebook for a company to develop their own safety program as well as operating a range. ADOSH-A(Rev. 6193) Page 7 ‘Sam's Shooters Emporium IL Inspection Ne. 317857316 Under the section "Developing a Range Safety Plan" The safety program is a template using XYZ Rifle & Piste! Club, Inc. as the company name and was dated June 30, 1995, ‘On August 28, 2014, CSHO Mitch Baird and | observed two patrons being given a safety brief and fire multiple weapons, ‘One of the patrons required the other person in his party to translate what the R & S Firearms, Inc. employee was stating during the safety brief and on the firing line. The safety brief started al approximately 9:23 am behind the firing line. ‘Subjecis covered were safety rules, finger off the trigger, stance, and hand placement. At approximately 9:33 am shooters were instructed to put in ear plugs and started shooting. Shooters fired weapons on the short range and long range. Shooters finished at approximately 9:44 am, procedures here." (One employee stated when asked if there was any written polices here, “there is no standard oper When asked if there is a standard safely briefing given for shooters the employee stated that they are non-scripted and vary between range coaches. When Mr. Scamardo was asked on August 27, 2014, if the company had any policies on weapons, Mr. Scarmardo said that he had a policy on automatic weapons however it was in the process of being revised. On September 19, 2014, Mr Scarmardo faxed a copy of Range Safely Rules Protocols, Revision of August 29, 2014, to the ADOSH office. The Range Safely Rules Protocols received al ADOSH was a two page document. In this Range Safely Rules Protocols, (revisions being in bold) #6 states the following "when at the firing fine, the ‘employeefinstructor may NEVER break the 6 o'clock rule, Downrange being 12 o'clock, the shooter will be considered the center of the clock and the Ringmaster/instructor will and shail be considered as being restricted to tho 6 octick [sic) position, See diagram below. The instructor will always be in a position to contro! the shooter should the need arise and by any means necessary to assure the safety of the client and employee. Failure on the part of the employee to observe this rule will be considered by the management as grounds for immediate dismissal ‘The 6 o'clock rute for the position of the range coach/instructor was known by both employees and management. However, based on observation, tho video taken by the gir's mother (provided by the Mohave County Sheriff office), and videos on the internet of the shooting portion of tours taken at this facilty, the rule was not always practiced as drawn on the diagram In the Range Safety Rules Protocols. Like Mr, Vacca, range coaches/instructors were observed standing closer to a 4 o'clock or 5 o'clock position. Bullets and Burgers Corporation, Owner, Russ Mann Informed me of videos on YouTube that shows the shooting portion of their tours. In watching these videos range coaches were also observed not standing at the 6 o'clock posttion as identified on the diagram in the Range Safety Rules Protocols, When asked if the company uses a Range Safety Officer when shooting Mr. Scarmardo stated that there is always three employees on site and sometimes four. Two employees (range coaches) are always on the range when there is a shooter, Sometimes there is a third. Mr. Scarmardo said that only one shooter is firing at a time. If there are two or more shooters, than two can be on the firing line at the same time each with a range coach, however only one would fire at atime, Training: One employee received a concealed weapons class (two days) and a firearms safely olass (about an hour and a half), The employee said that he had received no other safety training except shooting on the ranges. Employee said the shooting portion of the training was four days on site. The employee remembered from training not to be on the weak hand side 80 you don't have to go over the forearm to grab the weapon, go on strong arm side so you can go around and grab the weapon. ‘A second employee said that he had applied for a concealed weapons class and was given hands on training on the range for a week. The employee said that he had extensive weapons experience from being a combat engineer in the National Guard. Clarification on what was considered extensive weapons experience was not given. Mr. Scarmardo said that he hires mainly military and former law enforcement because of their experience. [ADOSH-1A(Rev. 6193) Page 8 Sam’s Shooters Emporium It Inspection Nr. 317857316 ‘Training records for Mr. Vacca were requested on multiple occasions. On August 27, 2014, Mr. Scarmardo stated that they were at his residence and he would get them to me. (On January 14, 2014, training documents for Mr. Vacca were recelved. They included White Hills Range training protocols and a CCW class. ‘Mr. Scarmardo also stated that the employee receive a NRA Range Operations course, No documentation of this was provided. ‘Sam Scarmardo was a NRA Certified Instructor and Ellyn Scarmardo was a NRA Certified Trainer (conducts instructor training courses). According to the NRA, Certified Instructors are expected to report training data to the NRA. When asked if, as a NRA Instructor if they were required to submit a roster of those individuals that they trained, Mr. and Mrs, Scarmardo said no. Mr. Scarmardo said that the NRA was working on that. Job Site Inspections: During an interview the employee stated that every other time (customers were shooting) a management offical would observe a shoot and take corrective action if needed. The employee said he had some corrective actions taken when he first started, Mr. Scarmardo stated that he travels to Sam's Shooters Emporium !I on Wednesdays and one day of the weekend, Conelusion: Mr. Vacca was not in the correct position when instructing the nine year old girl, According to the Range Safety Rules Protocols, management and employee statements Mr. Vacca should have been in the 6 o'clock position on the shooters strong side (right side). Mr. Vacca's left hand was positioned under the magazine of the mini-Uzi, possibly to help support the weapon for the shooter. With Mr. Vacca’s hand under the magazine It prevented him from obtaining control of the min= Uzi when the shooter fost control. If Mr. Vacoa was located at the 6 o'clock position with his right hand located in such a manner to gain control of the min-Uzi, a round would not have struck Mr, Vaoca in the head. Based on the video Mr. Vacca did not have the shooter fire two rounds on semi-automatic and verify if the shooter was ‘comfortable with the weapon prior to placing the weapon on automatic as required by the company.
