Hold Harmless Clause

All Vendors agree to indemnify and hold harmless the Creation Care Farmers Market &
Community Festival, First Afrikan Church and their officers, employees and volunteers from and
against all loss, liability, claims, demands, damages, costs, and other expenses, including
attorneys fees of enforcing this Hold Harmless Clause, on account of injury, loss or damage,
including, without limitation, claims arising from bodily injury, personal injury, sickness, disease,
death, property loss, or damage to the extent caused by the negligent or intentional act, omission,
or error of Vendor, or any officer, employee, volunteer, representative or agent of Vendor.

2015 Community Festival


Creation Care
Creation Care began as a ministry in 2011 with the purpose of transforming our community to engage in healthier
eating habits & more physical activities to offset the alarming rate of diet related illness. We maintain a community
garden year round providing garden tips and classes using an experiential model to children and adults. While
realizing diet alone will not reduce diet related illnesses, Creation Care created a green space or park adjacent to the
community garden to encourage play and physical activity through the use of walking trails. Each year, Creation
Care sponsors a Farmers Market as we strive to partner with other growers and farmers to bring an awareness of
how local food is grown, how to prepare healthy food, entrepreneurship, and gardening of the future. The
Community Festival celebrates Healthy Food, Healthy Body, and a Healthy Community. Local farmers/growers,
cultural/food vendors, and local/corporate businesses are invited to participate. In March 2014, Creation Care
became a 501 (c) (3) non-profit entity of First African Community Development Corporation.
Who Can Sell
Creation Care will give booth preference to those vendors selling fresh produce and food items. Produce re-sellers
will not be permitted to sell at the market.
Only those items listed on a vendors application may be sold. If a vendor wishes to add an item, approval must be
received from the market manager or representative via email prior to offering that item for sale.
To ensure diversity of products, Creation Care may find it necessary to limit participation of vendors who sell like
item. However, no vendor is guaranteed of being the sole purveyor of an item.
Only vendors who have paid the required booth fee may sell. All vendors must have a current application on file,
including any required licenses.
A limited number of vendors will be approved to participate in the farmers market.

Products That May Be Sold
Creation Care Community Festival policies align with the Georgia Department of Agriculture Guidelines for Food
Products Sold at Events Sponsored by Non-Profit Organizations.
Products that may be sold without a license include those food items that are exempt from the Georgia Food Act
and are not governed by additional State or Federal laws and regulations:
Fresh Produce, Jams, Jellies, Cakes, Cookies, Breads, Pies and Honey
Breads, Pies, Cakes and Cookies
Jam & Jellies
Honey
Fresh, cut flowers
Fresh, cut herbs
Other products that may be sold include arts, crafts, handmade items with natural ingredients or material that are
sold by the product creator, such as soaps and other natural body products, baskets, and wooden kitchen utensils
such as pepper mills.

Labeling Requirements
All baked goods and processed products are to be labeled in compliance with all applicable Federal and State
Regulations and must include:

The common name of the food


Net weight
A list of all ingredients using the common name of each ingredient
The name, address and phone number of the person who made the item
Allergen information

Products requiring state licenses may be sold when a copy of the current license issued by the proper
authority accompanies the application.

Eggs: Governed by the Georgia Egg Law

Dairy Products: Governed by the Georgia Dairy Law

Organic Products: Growers with Organic Certification

Low Acid/Acidified Foods (Canned Vegetables, Pickles, Salsa, etc.): State license from the Georgia
Department of Agriculture and completion of Better Process Control School

Meats: Governed by Georgia Meat Compliance Law

Market Fees & Booth Spaces

Vendors must pay for their booth in advance. The fee is $50.00 for all merchandise vendors. Food
vendors must pay $100.00. Money orders should be made payable to Creation Care c/o FACDC
(First African Community Development Corporation) and may be mailed to Creation Care
Community Festival, 5197 Salem Road, Lithonia, GA 30038.

All vendors must have an approved application on file. The application must include a current
copy of any required license(s). Approval and participation will be confirmed via email or phone.

Assigned spaces will be wide enough to accommodate a 10 by 10 tent with a vehicle parked next
to the tent for unloading purposes. All vehicles must be removed from the market area by 9:45
AM.

Booth spaces will not have access to electricity.

Vendors should prominently display their name and/or business name in their selling area so
customers can easily see with whom they are doing business.

A sellers area is to remain clean and barrier free. Littering of any type is prohibited. Spaces must
be left completely clean of all trash. Trash is to be properly disposed of or hauled away by the
vendor at the end of the market. Any vendor not adhering to this rule will be barred from future
participation.

No vendor may display flyers, poster, etc. outside the rented booth space.

No soliciting or political activities shall be permitted in the market area.

Creation Care and those approved by the market manager or representative shall be permitted to
photograph, videotape and/or record any areas of the Creation Care Community Festival,
including the vendors and/or their representatives and booths.

Tents, Umbrellas, Tables and Chairs


Vendors must provide tents, umbrellas, tables and/or chairs and are responsible for their own site set up and break
down. Tents, tables and umbrellas should be clean, in good repair, and visually pleasing to the market. No tarps are
permitted. Weights, sandbags and/or stakes are required for tents and umbrellas. To prevent customer falls, ropes or
wires used to stake tents may not extend into traffic areas. Vendors will be responsible for any injury or damages
caused by their tents, umbrellas, tables and/or chairs.
Absences
Vendors are asked to give 48 hour notice if they cannot attend the market so that Creation Care can offer the space
to another vendor. No refund of fees will be given.
Cancellation of Market due to Inclement Weather
In the event of severe rain or violent weather the market will be cancelled. A decision to cancel the market will be
made by 5:00 AM on the day of the market. Vendors should go to creationcaregardens.weebly.com for
information regarding cancellation. In the event of violent weather during the market, the market manager, or
designated representative, may determine that the market shall close early. In that case, all vendors must cease
selling and leave the market area immediately. No refund of fees will be given for a market cancelled due
to inclement weather since this is a condition beyond the control of Creation Care.
Insurance
Festival vendors are required to be responsible for their own personal, general and liability insurance. First Afrikan
Church shall be reimbursed for any damage to the church property by a market vendor. This includes damages
to grounds, sidewalks, buildings, vehicles any property owned by First Afrikan Church.
Sales Tax
Market vendors are responsible for the collection and payment of sales tax.
Vendor Conduct Policies
Proper demeanor and high quality customer service are expected on the part of the vendors at the Creation Care
Community Festival & Farmers Market. All sellers are encouraged to be friendly, courteous, knowledgeable,
and honest. Customer complaints will be investigated by the Creation Care.
Sellers who are the subject of consistent complaints will be asked to discontinue selling at the market with no refund
of fees.
Vendors are responsible for all sales tax. If selling by weight, the seller is responsible for having Georgia
Department of Agriculture approved scales for weighing the produce. All produce sold by volume must also conform
to the weight standards for that volume as established by the Georgia Department of Agriculture for weight and
measurements.
Vendors should furnish clean packaging or containers for customers, such as paper or plastic bags or boxes.
A vendor or knowledgeable representative must be present at the booth at all times.
Children under the age of 16 may not sell any items unless an adult over the age of 21 is present who is
knowledgeable regarding the product(s) being sold.

Vendor Policies continued


Vendors who bring children to the market must supervise them at all times and not allow the children to run around
the market area. Children are not allowed to touch items in other vendors booths.
Vendors are expected to dress appropriately for working with the public. Shirts and shoes are required.
Vendors are not to use tobacco products.
Vendors may not bring pets to the market.
Vendors can play music; however, it must not be loud enough to disturb other market vendors or customers.
Vendor complaints and disputes must be submitted to the market manager in writing and shall give adequate
information setting forth in detail the allegation and shall be signed by the complainant.
THE FOLLOWING WILL RESULT IN IMMEDIATE AND PERMANENT EXPULSION OF A VENDOR
FROM THE MARKET AND NO REFUND OF FEES WILL BE GIVEN:

Fraudulent, dishonest or deceptive merchandising or packaging


Use of profane, abusive, threatening or harassing language
Threatening behavior, the threat or use of violence
Damage or vandalism to property
Possession of a firearm, weapon, fireworks
Gambling
Consumption of or under the influence of alcohol
Use of illegal drugs or drug paraphernalia

Promotion of the Market


Creation Care will promote the market by providing information to other websites that list local farmers markets,
sending press releases to local newspapers, and distributing fliers to local businesses and churches.
