16 Petitioner, a state prisoner proceeding pro se, has filed a petition for writ of habeas

17 corpus pursuant to 28 U.S.C. § 2254 and a request for appointment of counsel. Petitioner has

18 paid the required filing fee.

19 Petitioner is confined in California State Prison - Sacramento. The conviction

20 under attack was entered in the San Luis Obispo County Superior Court. While both the United

21 States District Court in the district where the petitioner is confined and the United States District

22 Court in the district where the petitioner was convicted have jurisdiction over petitioner’s habeas

23 petition, the witnesses and evidence necessary for the resolution of the petition are more readily

24 available in San Luis Obispo County. In the furtherance of justice, this case will be transferred to

25 the United States District Court for the Central District of California for all further proceedings.

26 See 28 U.S.C. § 2241(d); Braden v. 30th Judicial Circuit Court, 410 U.S. 484, 499 n.15 (1973).

1 Accordingly, IT IS HEREBY ORDERED that this matter is transferred to the

2 United States District Court for the Central District of California.
