WHAT IS FAIR USE??


Fair use is the legal sanctioned use of copyrighted
materials, without obtaining prior authorization or
license,
by educators, students, libraries, news
organizations,
critics, and humorists, under certain
circumstances (University libraries copyright basics, 2011)

WHAT DO I NEED TO REMEMBER?


A work is copyrighted if IT IS:

Original
Tangible
Creative

HOW DO I KNOW IF IT IS FAIR USE?


First, take into consideration these FOUR FACTORS:
1. The purpose and character of use, including whether such use is of
commercial nature of is for nonprofit educational purposes
2. The nature of the copyrighted work
3. The amount and substantiality of the portion used in relation to the
copyrighted work as a whole
4. The effect of the use upon the potential market for, or value of, the
copyrighted work (University libraries copyright basics, 2011)

What if I acknowledge the source of


copyrighted material?
*Although it is always good that you
acknowledge the source, this does not
mean you have obtained permission.
There is a thin line between fair use
and illegal use of copyrighted work.
The distinction may not always be clear
or easily defined! There is no specific
amount of work that may be taken
without permission (University libraries copyright basics).

WHICH ONE IS IT?? HELP!


If you ever need to decide, determine from one of these three:
1. General Legal Use (Legal use by general public)
Example: burning a CD full of songs from music you
purchased on your computer through Itunes
2. Fair Use (Use under fair use guidelines)
Example: Using a video clip from a video you purchased on
your own computer to support a presentation for a class
3. Illegal Use (violation of copyright law)
Example: Making copies of a lecture that you found online
and handing them out to your classmates (University libraries
copyright basics).

What is the Teach Act??


The copyright law provides educators a separate set of rights to display
and perform others work in the classroom.
Under TEACH:

Instructors may use a wider range of works in distance learning environments.

Students may participate in distance learning sessions from virtually any location.

All participants enjoy greater latitude when it comes to storing, copying and digitizing
materials.
