Legal Issue
Activity: I chose to research the legal versus illegal questions that can be asked during
interviews because this a common liability in education that is, in my opinion, overlooked.
Description: Through the research and discussions with administrators, I realized how many
general interview questions that are a complete violation of personal rights. I can even recall
through general discussion being asked about my family or personal situations; nothing was in
appropriate, but the interviewer cannot bring up or ask this information.
a. What went well?
The research of interview questions was fairly easy. The same basic no-nos appeared,
but once I uncovered the legal aspects, the forbidden categories was overwhelming.
When I spoke with my principal and even through class discussion, the majority of the
illegal questioning was happening in an innocent manner. The mistakes are coming
from the innocent get to know you conversations; however, I learned most of those are
self-revealing by the interviewee. Is that person wearing a wedding ring? Does he/she
talk about family or family goals and so on.

b. What did not?


What did not go well with this process is figuring out what to do if this is the casewhether interviewer or interviewee. It basically is results integrity and the game of he
said/she said. There is not any way to prove that someone asked illegal questions, so that
would be frustrating to believe that one was passed over for a job due to personal business.
Regardless if that affects the job performance, one cannot assume how a person would handle
the jobs or issues if his/her answer to an interview question was personal.

c. Given the chance to do it again, how would you do it better?


I learned that I have been asked illegal interview questions; however, I also know those
were not with malicious intent. I learned that I am liable as an administrator if I were to
ever ask such questions that I knew were not legal or appropriate. I have learned a lot of
innocent illegal questions have taken place, and they will probably still take place. I
just know that as an interviewee, I have rights too. However, I also know that if a
principal asked me a question that was illegal but conversational and I did not answer it, I
would probably not be seen as personable either.
