Napolitano (18825), responded to 47 W. Jefferson St to investigate a group of| people who were on private property and smoking eannabis. ‘Andrea Nieves who was inside the property was the one who could hear people taking close to the door to the property and said she could smell “weed” through the mall slot. Nieves wrote a wom statement and sso said she wanted the individuals trespasted, ‘When I artived 1 observed 3 people, two males and one female under the overhang of the property and I immediatly smelled the odor of burnt cannabis which I was able fo identify based upon my aining and experience, One of the males, Ryan Diaz, was standing with his hands in his pockets, the other male, Mario Manzi was siting on a fedge next to the female Jazmin Ahmed I was wearing my department ‘issued Orlando Police Department Bike uniform and atived on my department issued mountain bike. I was thee alone at this point in my investigation. 1 informed Diaz, Manzi, and Ahmed that they were being detained and that 1 was going to search them because of the smell of cannabis “Manzi told me he was going 10 record me for his safety so he wanted to record me and reached for his iPhone. 1 informed Manzi that he needed to stop reaching around and that he was not going to do that right now because he was being detained, so he needed to listen to my commands. Manzi shoved the phone in my face so I grabbed it from him (although he wied to pull it away fiom me), and placed it down on a ‘eaby stairway. I pulled Manzi aside and was waiting for another officer to strive before I began to search him, Manzi told Ahmed and Disz to grab the phone and continue filming. Ahmed moved from where she was seated and grabbed the phone, told her she needed to stop roving around and to stay seated. 1 was sill the only office on scene aad I did not fel it was safe for the Diaz and Ahmed to move around, ‘specially since! had not searched them yet | approached Ahmed 10 make sure she sat back down and would stop moving around. Diaz also approached at this time and Ahmed handed the phone off to him. Diaz turned his back to me and moved away from me despite my commands for him wo stop. Manzi and Ahmed began to spproseh at this time as well. When I atempied to grab Diaz's arm, Diaz held the hand with which he held the phone away ftom me and tied to push me off of him by puting his hand into my chest. He Kept saying that T couldnt tll him what to do and that he knew his rights. Manzi was saying a similar mantra thoughout this incident as well. At this time all Uxee subjects were not listening to my commands and ‘moving around as they pleased. I saw Officer Gaunt arive around this time. I told Manzi to step back which he did and J told Diaz to st oven. I was tying to explain the group that they were curently being detained fr my investigation, However, Diae sil insisted on arguing with me and decided he did not want to listen to my commands. He still did not comply with my command to sit down. At this point I decided to place Diaz under arrest. { grabbed his let arm in an attempt to secure him in handcus but he pulled away ffom me and the spun around to face me. I grabbed a hold of Diaz by the shoulders and could feel him tense up his body. 1 told him to get on she ground but he did not comply and I could feel him trying to pull away again. 1 pulled Diaz in and delivered 2or 3 knee strikes with my right knee in an attempt to gain compliance. After I felt Diaz Toosen up a litle 1 swept his legs and brought him to the round. F continuously told Diaz to stop resisting throughout this altreation, When Diaz was on the ground he kept resisting my efforts to roll him ‘nto his stomach, Again, I told him to stop resisting, Officer Gauntlet attempted to assist in flipping Diaz onto his stomach. 1 struck Disz on the outside of his left thigh 2or 3times with a closed fist in an attempt to gain compliance, Between strikes I attempted to tum him over and contol his arms but T could sill feel him tensing snd resisting. 1 (Old him to stop resisting before ech strike. Aer the final stnke Diaz loosened up and we were ableio gt him onto his stomsch and secure him in handeutl.
