EARTHLINK, INC.’S UNOPPOSED MOTION TO EXTEND TIME TO ANSWER

OR OTHERWISE RESPOND TO PLAINTIFF’S COMPLAINT

NOW COMES Defendant EARTHLINK, INC. (“EarthLink”) and through its

undersigned counsel moves for an extension of time until May 9, 2007 to answer or otherwise

respond to Plaintiff WEB TELEPHONY, LLC’s (“Web Telephony”) Complaint in the above-

captioned matter. EarthLink was served with the Summons and Complaint on March 19, 2007.

EarthLink’s response to the Complaint is currently due on April 9, 2007. Counsel for Web

Telephony has agreed to a thirty day extension of this date. Accordingly, EarthLink respectfully

requests that the Court enter an order extending the time for EarthLink to answer or otherwise

respond until May 9, 2007.

A proposed order reflecting the relief requested is attached for the Court’s convenience.
