2015 EAGLES SUPER RAFFLE

TICKET HOLDER WAIVER, RELEASE AND HOLD HARMLESS AGREEMENT
The holder of this ticket (Holder) has chosen voluntarily to participate in a raffle organized and/or
sponsored by the Walnut Hills High School Touchdown Club, a non-profit association assisting the
football program at Walnut Hills High School (WHHS), under the auspices of the WHHS Alumni
Foundation (together, the Organizers). By the use of this ticket, Holder agrees to all conditions set forth
below. Such actual raffle, together with all component activities related thereto, that might occur before,
during or after the actual date of the raffle, in which Holder participates, including all gatherings and other
activities prior to, in preparation for the raffle, and/or in claiming and enjoying any prizes that may be won
by Holder, shall be collectively referred to and included herein as the "Raffle".
Holder understands that, because of the potential risks inherent in such activities, the Organizers have
issued this ticket to the Holder only on the condition that Holder agrees to this Waiver, Release and Hold
Harmless Agreement (this Agreement), waiving any claims Holder might otherwise have as a result of
such activities, and holding harmless the Organizers and certain other persons and entities as indicated
below. Therefore, in consideration of the issuance of this ticket to Holder, and on behalf of Holder, any
minor(s) who may be accompanying Holder in any part or activity of the Raffle, their respective heirs, next
of kin, executors, administrators, guardians, trustees, other personal representatives, successors and
assigns, Holder hereby makes the following agreements and representations:
1. Holder agrees to comply at all times with applicable Raffle rules. Holder accepts full responsibility
and accountability for any damage or injury to himself or herself, accompanying minor(s), third
parties, or any property that may be caused by, may result from or may be associated with, Holders
violation of any such rule or rules.
2. Holder realizes and acknowledges that injuries, illness, and property damage and other loss are
possible results of the activities Holder will participate in as the holder of this ticket. Holder hereby
expressly and specifically assumes all such risks, including risks of injury, illness, disability, loss of life
loss of property and any other loss, that Holder and/or any minor(s) accompanying Holder may incur
in connection with the Raffle.
3. Holder recognizes that participation in the Raffle may involve risks that might result not only from the
conduct or activities of Holder and/or any accompanying minor(s), but also from the actions, failure to
act or negligence of other persons, including the Released and Indemnified Parties defined below,
and Holder hereby expressly and specifically assumes all such risks. Holder also acknowledges that
there may be other risks of injury, illness, disability, death and/or property damage that are not
specifically acknowledged herein, that are known, unknown and/or not reasonably foreseeable,
and/or that situations may arise during the Raffle which are not within the expectations or control of
the Organizers or the Released and Indemnified Parties, and Holder hereby expressly and
specifically assumes all such additional risks.
4. In exchange for the opportunity to participate in the Raffle, Holder agrees that any and all expenses
relating to or arising out of Holders participation in the Raffle, such as expenses necessary to fully
enjoy any prize that are not included as part of that prize, will be Holders sole financial responsibility.
Holder acknowledges that he/she will be solely responsible for his/her own travel, hotel
accommodations and meals while participating in the Raffle, including in the enjoyment of any prize

that Holder may win, and will also be solely responsible for all taxes, fees, gratuities and other
miscellaneous costs resulting from Holders participation in the raffle.
5. Holder understands and acknowledges that Cincinnati Public Schools, a school district organized
under the laws of the State of Ohio, and WHHS are immune from liability pursuant to Chapter 2744,
Ohio Revised Code. Holder forever (a) waives any and all claims against, and releases, discharges,
and covenants not to sue, any or all of the Organizers; WHHS, its faculty and coaches; Cincinnati
Public Schools; and their respective affiliates, departments, members, officers, trustees, Board
members, directors, administrators, employees, independent contractors, agents, volunteers, and/or
other representatives (collectively, the "Released and Indemnified Parties") against any and all
liabilities, obligations, damages (including punitive damages), losses, claims, demands, recoveries,
settlements, deficiencies, costs or expenses (including reasonable attorneys' fees) with respect to any
injury (regardless of severity), illness, disability or loss of life, property damage or economic or other
loss suffered by Holder or by any third party relating to or arising out of Holder being a holder hereof,
expressly including, but not limited to, any injury, illness, disability, death, or other damage
arising out of or related in any way to any active or passive negligence of the Released and
Indemnified Parties or any other person or entity, or as may otherwise arise in connection with
the Raffle; and (b) holds harmless and indemnifies each of the Released and Indemnified Parties
against any and all liability, claims and demands whatsoever, in law or in equity, arising from or
relating to Holders participation in the Raffle.
6. Holder expressly grants permission to the Organizers, or any of them, and to any of their respective
designees, to record, broadcast, telecast, photograph, video and otherwise exploit, through any form
of media, throughout the world, and for all commercial and non-commercial purposes, any aural or
visual depiction of his/her name, image, likeness, voice, comments or any combination thereof, and of
any accompanying minor(s), which results from their respective involvement in the Raffle or
participation in and/or performance of the activities contemplated under this Agreement, for any
purpose whatsoever, without any compensation of any type to him/her/them, or to his/her/their heirs,
next of kin, executors, administrators, trustees, other personal representatives, successors or
assigns. Holder hereby releases the Organizers from any claim by Holder or accompanying minor(s)
for invasion of privacy, defamation, violation of any right to publicity, or any other cause of action
arising out of the activities contemplated herein. By the use of this ticket, Holder agrees that the
Organizers are the exclusive owners of all copyrights and other proprietary rights in the materials and
information described in this paragraph 6.
