POTENTIAL MORATORIUM ON SINGLE-FAMILY RESIDENTIAL DEVELOPMENT DISCUSSION POINTS ‘CTY COUNCIL STUDY SESSION ~ NOVEMBER 3, 2015 Process ‘An Interim Urgency Ordinance can be adopted by the City Council on single-family residents! ‘development per the authority granted to cies in the California Constitution, California Heath & Sfety Code, and California Government Code. An Interim Urgency Ordinance could be adopted pursuant to 4 4/5 vote ofthe City Council fr a period of 45 days. The Ordinance would need to be based on findings that the action was necessary to protect the public heath, safety, and welfare and thatthe City as {going to be working toward changes to residential development standards during the interim period. If the Moratorium was found to be necessary for 2 longer period of time, the ity Council could vote to extend the Moratorium up to an adltional 10 months and 25 days through an extension of the Urgency Ordinance Hom would a Moratorium be implemented? ‘There are many afferent ways that a Moratorium could be implemented. A Moratorium could be placed ‘on the issuance of new demolition permits, new bulling permits, new design review approvals, or other thresholds. There are several stages to the approval ofa home and izuanceof permits. They ae: © Approval of Design Review —A home goes through the process of Design Review with ether Staffor 2 Homeowners Association. This typically takes a number of months and many hteraions ‘+ Issuance of a Certificate of Demolition if an existing home on alot isto be demolished and it 's Syears old or oder, the applicant must have the home reviewed by an architectural historian or historian to determine te historical signicance ofthe home, f the home s deemed to have histori value, addtional processes and review are required ‘+ Plan Check—If a home isin Plan Check, this means tha the home has been approved through desig review and the aplicant has completed engineering and construction drawings and is having the final home plan reviewed by the Cy. ‘Building Permit issuance ~ Building Permit is sued when the home has been appeoved and is ready fr construction to begin ‘© Demoition Permit issuance ~A demolition permit is required to ensure tat al exiting tities are safely capped, any environmental hazards have been abated (sucha lead and asbestos), and the home is ready for demolition. Ths can occur at several diferant stages in the process. What iin the Pipeline that would be Impacted by @ Moratorium? Based on records 9s of October 29,2035, the following single-family homes aren the “ppetine” in various tages of review. These numbers do not Include adlions to single-family homes or multifamily projects. There are 23 homes that have been Issued Bulding Permits but have not yet been issued Demolition Permits ‘There ae 91 homes curently n Plan Check that have not yet been issued a Bulding Permit. OF ‘these, there are & homes that have been Issued Demolition Permits. ‘There are approximately 30 homes that have been approved through Design Review but are 20: vetin Pan Check. “There are 82 homes curently n the City's Design Review process that have wl yet been ‘approved. is unknown how many homes are inthe HOM's Design Review pracess that have nat vet been approved.
