While having a standard FIDIC 1999 form of Contract, why do you think they needed a
bespoke form of Contract? Examples?
2. When you select a Contractor from bid evaluation, are you giving priority to Commercial
evaluation or Technical evaluation? Why?
3. You mentioned that Employer can get a price certainty by having a Lump Sum fixed price
Contract. If I says practically you cannot certain the final Contract price even for Lump Sum
fixed price Contracts, how do you defend your statement?
4. If you had the detailed design which can develop the BOQ, why do you still want to develop
the design?
5. Your last Tender addendum is IFC BOQ, why does it still has CDPs?
6. When you decided to use this strategy for tendering, why didnt you update the Pre Tender
Estimate for the Client for the additional cost for CDP? (Why Pre Tender Estimate is not
captured these CDPs?)

How do you certain that the Contractors priced any risk? Did you price the risk?

The bidder who has sent a VE may have to spend some effort in preparing that. Do you feel
that it is correct taking those items and send it to other bidders?
Instead why didnt you ask to provide VE exercise of their own?

Employer has already spent for a design which is almost completed. How can you say that
without changing the scope of work he will get a lower price including the Redesign?
Especially for the same specification?
10. Why didnt you consider re tendering with increased number of participants?
11. Dont you think you could have easily advised the employer to award the contract for the
lowest bidder and later omit the part of the work as necessary to suit the budget?
12. Once the tender is opened is it allowed that the request for further adjustment to tender
submissions other than re submission of all the tenders?
13. You compared your options against time and Cost? Did you properly evaluate the time and
cost?
Example, how can you say Re-Tendering is more cost effective than VE or de-risking? Did you
evaluate any cost for De-Risking or Re-Tendering?
