13County, to provide that only county-owned solid waste landfills shall be used for the disposal of
14solid waste.

17Section 1. The following amendment to the Constitution of Alabama of 1901, is proposed and
18shall become valid as a part of the Constitution when all requirements of this act are fulfilled:
19PROPOSED AMENDMENT
20In Baldwin County, only county-owned solid waste landfills shall be used for the disposal of
21solid waste. The rates for disposal at county-owned or operated land-fills shall not exceed the
22rates for like kind services charged by publicly or privately owned landfills in the following
23counties: Mobile, Escambia, Washington, Monroe, Clarke, Conecuh and Escambia County,
24Florida.
25The County Governing body shall create a Solid Waste Management Authority comprised of
26five members at least three of which shall be mayors of municipalities in Baldwin County. This
28programs, revenue sharing and along with other duties as requested by the County Governing
29Body.
30Section 2. An election upon the proposed amendment shall be held in accordance with
31Amendment 555 to the Constitution of Alabama of 1901, now appearing as Section 284.01 of the
32Official Recompilation of the Constitution of Alabama of 1901, as amended, and the election
34Section 3. The appropriate election official shall assign a ballot number for the proposed
35constitutional amendment on the election ballot and shall set forth the following description of
38to provide that only county-owned solid waste landfills shall be used for the disposal of solid
39waste.
