Dear Attomey General Madigan and Honorable Mr. Scholz:
Tam contacting you as heads of your respective agencies to alert you to events which occurred during,
and as a result of, yesterday's primary elections in Adams County. Due to unprecedented voter tuout,
widespread shortages of ballots throughout the 74 voting precincts occurred. As a result, and for a time, voters
were turned away from the polls, unable to vote, In response, the County Clerk printed and delivered additional
ballots to all affected precincts.
Still, problems persisted, resulting from the shortage. While an Emergency Petition To Extend Polling
Place Hours was filed and granted, I have received credible, but as yet undocumented, reports of voters who
were unable to return to polling places after initially being tured away. I have reviewed applicable statutes and
relevant law with regard to the duties of the State's Attorney in this circumstance, and I am convinced that the
role or duty of this office is limited to investigation or prosecution of criminal conduct. There is no evidence of
any such conduct of which I am aware.
As such, [request that your respective agencies commence and conduct any appropriate inquiry into this
matter, so that compliance with the Election Code may be assured. It is not known at this point whether any
meast votes resulting from unavailable ballots will ultimately affect the outeome of yesterday's primary
election, What is known is that the right to vote is sacred, and must be protected at all costs, To this end, I am
urging that your agencies assess and respond to this matter with dispatch, so that the right to vote by all eligible
and interested voters be guaranteed.
