programs at the same rate as an average U.S. Citizen, but are significantly falling behind when it
comes to master’s programs. This is simply because they are running out of national financial aid
due to the twelve semester maximum of granted aid to the people. With this maximum threshold
per person immigrants are more likely to use this all just obtaining a bachelor degree because of
obvious reasons. These Hispanics have come to America more than likely with no
documentation so they are going to school while working multiple jobs to try and support their
families.

Focusing on a state that provides more opportunities in the post-secondary education field
specifically is Kansas. Kansas is known to provide more opportunities for those that are foreign
bom or those who have no documentation based off of Substitute House Bill No. 2145. This bill
‘was put into effect after case Day v. Sebelius in which Bill No. 2145 was used to declare that
those of illegal immigrants (aliens) are provided the opportunity to higher education at the price
of in-state tuition under three main criteria: attended and accredited high school for three years,
has graduated or received an equivalent graduation certificate, and lastly an affidavit declaring
that they are going to file or apply for legalize immigration status at the earliest point available
(HR 2145) . With the American people needing to know where they stand with opportunities for
higher education it is well respected that I state that this bill may be in violation of the'Supreme
Gourt case of Plyler V. Doe which declared that the free education to illegal alien children
violates the Equal Protection Clause. Understanding that this Bill No. 2145 is also in affect in the
state of Texas under a different statute which states the same three criteria.
Alongside Bill No. 2145, Plyler V. Doe, Illegal Immigration Reform and Immigrant
Responsibility Act of 1996, and Toll V. Moreno it is clearly classified that our government
system is willing to provide opportunities for aliens more than its own people. With that being
stated it is time to acknowledge that aliens and foreign born people residing in the United States
are more likely to succeed because of one simple thing. The chance for a better chance at aneducation in the United States over the American people. Concluding that these aliens of no
documentation are not going back to their countries with their degrees to build life and
‘opportunities for their own people, but rather take the jobs originally provided for the American
people.
Statistically allowing illegal undocumented people to pay in-state tuition during this
economical time is a huge negative factor for the economy at this time: Allowing such is taking
away from the American people as well as legal immigrants residing in the United States.In—
today’s-society’jtis difficult to say that these undocumented students donot provide a positive
impact in our country,
