with further amendment to H.858
Sec. 9
Directs the Department of Health (DOH), in collaboration with the Department of Public Safety,
the Agency of Education, and the Governors Highway Safety Program, to develop and
administer an education and prevention program focused on the use of marijuana by youth under
25 years of age. DOH must adopt rules on or before March 15, 2017 and implement the program
on or before September 15, 2017.
Sec. 10
Removes possession of two marijuana plants from the criminal statute.
Sec. 11
Decriminalizes 21 + possession of two marijuana plants and marijuana harvested from the plants
under following circumstances:

Plants are possessed on property lawfully in possession of the person or with the consent
of the person in lawful possession of the property and screened from public view

No more than four marijuana plants per dwelling unit or property, regardless of how
many persons 21 years of age or older reside in the dwelling unit or on the property

Harvested marijuana is stored in a secure indoor facility on the property where the
marijuana was cultivated

First offense possession of an ounce or less reduced from $200.00 to $100.00 civil penalty
Sec. 12
Establishes the crime of chemical extraction of marijuana by means of any liquid or gas, other
than alcohol, that has a flashpoint below 100 degrees Fahrenheit.
Secs. 13 and 14
Adds marijuana to the current vehicle open container laws.

Sec. 15
Directs the Secretary of Transportation and the Commissioner of Public Safety to work
collaboratively to ensure that funding is available, either through the Governors Highway Safety
Programs administration of National Highway Traffic Safety Administration funds or other
State funding sources, for training the number of officers necessary to provide sufficient
statewide coverage for the enforcement of impaired driving laws through Advanced Roadside
Impaired Driving Enforcement (ARIDE) and Drug Recognition Expert (DRE) programs.
Sec. 16
Establishes the Marijuana Advisory Commission for the purpose of providing guidance to the
Administration and the General Assembly on issues relating to the national trend toward
reclassifying marijuana at the state level, and the emergence of a regulated adult-use commercial
market for marijuana within Vermont. Report due December 15, 2016.
Sec. 17
Establishes the Workforce Study Committee to examine the potential impacts of alcohol and
drug use on the workplace. Report due December 1, 2016.
