END MASS SURVEILLANCE UNDER THE


PATRIOT ACT

Just45daysaftertheattacksofSeptember11,2001,apanickedCongress
passed,withvirtuallynodebate,theUSAPatriotAct.Thelawamountedtoan
overnightrevisionofthenation'ssurveillancelawsthatvastlyexpandedthe
government'sauthoritytospyonitsowncitizens,whilesimultaneously
reducingchecksandbalancesonthosepowers.
Foryears,wehadlittleofficialinformationabouthowthegovernment
interpretedtheoverlybroadsurveillancebill.OnJune6,2013,thefirstof
EdwardSnowden'sdisclosuresconfirmedwhatsomeprivacyadvocateshad

longfeared:UnderSection215ofthePatriotAct,theU.S.government
collects,onadailybasis,thephonerecordsofmillionsofAmericans.These
recordsincludethenumbersdialedandreceived,thedatesandtimesofthose
calls,andtheirduration.Thatprogramwasruledunlawfulbyanappealscourt
inMay2015.
Section215isoneofthethreesectionsofthePatriotActthatarescheduledto
sunsetonJune1,2015.Thislongabusedprovisionofthelawhasbeena
failurebynearlyeverymeasure.Theauthorofthelawhaspubliclystatedthat
itwasneverintendedtofacilitatemass,suspicionlesssurveillance.Ithasnot
playedanessentialroleinstoppinganyattack.Andithasenabledan
unprecedentedsurveillancesuperstructurethatviolatesAmericans'rightsto
privacy,freespeech,andfreeassociation.

Unless Congress can agree on far-reaching reforms, it is high


time for Section 215 to sunset.
OnMay13,2015,theHousepassedtheUSAFreedomAct,abillmanyseeasa
lastditchefforttoenactsurveillancereformbeforetheJune1sunset.Some
provisionsofthebillmayofferincrementalimprovementsoverthedismal
statusquo.However,inthewakeofthe2ndCircuit'sdecision,itisclearthat
theproposalnowonthetabledoesnotgonearlyfarenough.Unlessthebillis
significantlystrengthenedintheSenate,theprovisionshouldbeallowedto
expire.

Beyond phone call data


UnderSection215,thegovernmentcanalsocollectinformationaboutwhat
booksyouread,whatyoustudy,yourpurchases,yourmedicalhistory,and
yourpersonalfinances.Theprovisiongiveslawenforcementbroadaccessto
theserecordswithoutprobablecauseofacrime.Italsoprohibitstheholders
ofthisinformation,likelibrarians,fromdisclosingthattheyhavebeen
orderedtoturnoversuchrecordsagagorderprovisionbackedbywiththe
threatofjailtime.WhileanorderfromtheForeignIntelligenceSurveillance
Courtisrequiredtoobtaintheinformation,thatcourtoperatesinneartotal
secrecythroughonesidedproceduresthatheavilyfavorthegovernment.
Section215grantstheNSAaccesstointimateinformationaboutordinary
citizens,withoutawarrantandwithoutsuspicion.Itgivesthegovernment
entryintoourprivatelives,isusedinwaysthattreateveryoneasasuspect,
andchillsfreeexpression.

WhenthePatriotActwaspassedin2001,manycongressionalrepresentatives
complainedthattheydidn'thavetimetoreadthebillbeforetheywereforced
tovoteonit,amidintimationsfromtheBushadministrationthatthosewho
voted"no"wouldbeheldresponsibleforfurtherattacks.Thankfully,a
surveillanceauthorityenactedandimplementedinthedarkhasfinallybeen
thrustintothelight.WenowknowwhatthegovernmentdidwithSection215,
andwehavefinallybeenabletotakepartinadebateweweredeniedformore
thanadecade.
Itisclearerthanever:Section215hasgottogoandCongressmust
reininotherPatriotActauthorities.

Other Patriot Act Provisions


Underthissweepinglegislation,thegovernmentcanalso:

1. Obtain intelligence surveillance orders that identify neither the person


nor the facility to be tapped.

2. Conduct secret intelligence surveillance of non-U.S. persons who are not


affiliated with a foreign organization.

3. Engage in dragnet surveillance of emails sent in the United States.

4. Search your home and not even tell you.

5. Demand your information from telephone, internet, and credit card


companies and bar them from ever telling you.

6. Label you a "terrorist" if you belong to an activist group.

7. Monitor your emails and watch what internet sites you visit.

8. Take away your property without a hearing.

9. Share the private information of innocent Americans with the CIA.

10. Put immigrants in jail indefinitely.
