MEMORANDUM OF UNDERSTANDING
Next Step Program
Partnership between the Sixth Judicial District Public Defenders Office (Public Defense), Arrowhead
Regional Corrections (ARC), The Center for Alcohol & Drug Treatment (CADT), and the Sixth Judicial District
Court (Courts).
The Parties
Where the Sixth Judicial District Public Defense received a Justice Improvement Grant from the American Bar
Association to explore holistic public defense, holistic services to clients pre-sentence and post-sentence in the
criminal justice system where the goal is to reduce pre-trial incarceration, coordinate services for clients,
encourage engagement of clients in treatment.
Where the Sixth Judicial District Public Defense is partnered with ARC, CADT, and the Courts.
Where ARC has implemented over the last three years an intensive pre-trial release program using a tool
developed to assess risk in releasing folks pre-trial, the implementation of probation officers to supervise folks
on pre-trial release, and the overall significant reduction in jail population.
Where ARC, using each of these tools, has saved the community $1.5 million in unnecessary incarceration costs
while, at the same time, engaging clients in services in the community to meet mental health, chemical
dependency, housing, and a host of other needs. Where the CADT of Duluth, Minnesota, is a leader in regional
chemical dependency referrals to mental health and the coordination of mental health and committed to holistic
client care through its partnership and various other problem solving courts in the region. Where CADT has a
long history of partnering and providing client and patient advocacy to meet the holistic needs of its patients.
Where the Courts has been a partner in various judicial reforms to include supporting seamless access to
services, interdisciplinary communication, and client-centered interdisciplinary success through its nine
problem solving courts.
Therefore, be it agreed, understood, and each party is prepared to work in partnership to implement a holistic
Next Step Probation Assistance Program, hereinafter called Next Step.
The following parties agree by this Memorandum of Understanding to the following steps:
Arrowhead Regional Corrections
ARC agrees to work collaboratively with all the partners identified, identify criteria and a group of clients to not
exceed 30 clients in the next one year, and 30 additional clients who will act as the control group. ARC shall
identify 30 clients and work collaboratively through its probation officer and its community sanction program
and intensive pre-trial release program. The 30 identified clients will receive holistic services, the assistance of
other partners to connect each client to meet a host of needs. It is anticipated that ARC will assist in providing
data for program evaluation.

The Center for Alcohol & Drug Treatment


CADT agrees to work collaboratively with the Next Step partners identified to provide a client advocate who
will work collaboratively with probation and the Public Defense social work intern to assist the identified

clients to engage in holistic services. Holistic services includes but is not limited to: Health care navigation and
obtaining health insurance, obtaining a rule 25 chemical health assessment, scheduling and assisting in primary
treatment, exploring housing options, mental health treatment referrals and engagement, veterans services
referrals, food shelf referrals, drivers license assistance, employment assistance, and ignition interlock
applications to obtain a drivers license.
The Sixth Judicial District Public Defenders Office
The Sixth Judicial District Public Defenders Office will provide a social work intern to work in partnership
with the parties to further aid in providing holistic services. The social work intern will be responsible for
working with the partners to gather data for evaluation.
Data for Evaluation
All parties agree to assist with and gather data which could include: Criteria for the targeted demographics
which would include the number of days of involvement in the program, re-arrest rate, number of probation
violations for pre-trial release, number of urinalysis collected and the corresponding results, consumption of jail
days, engagement in and completion of treatment, number of rule 25 evaluations completed, therapy progress,
treatment engagement plans, and insurance access.
All parties agree to work collectively, cooperatively with an identified program evaluator, Professor Emily
Gaarder, University of Minnesota-Duluth.
Compensation
ARC:
CADT:

No compensation.
The CADT shall be compensated no more than $9,000 to provide client advocacy. This shall be
billable at the rate of $35 per hour.
