CASE/lNCIDENT REPORT

The assigned, Oetectivela~none and Captain Merrithew arrived at 42 Oakwood Drive shortly after 2:30 a.rn., the officers again knocked on the door several times, but no answer. The assigned officers observed that the television was on in the top floor bedroom to the front south side of the house. There were lights on in the lower front level of the house. The assigned officers no longer saw any further movement within the residence at that time. Captain Merrithew called the residence at 2:41 a.m., but there was no answer. Captain Merrithew left a message on the answering machine ..

That based on the above facts that no one came to the door and that no movement had been seen inside the residence for awhile, the as'-~dned felt that exigent circumstances eidsted to force entry. This was also based on the fact that the assigned officers had concerns that another crime was about to be committed or had been committed inside the residence so force entry was made inside the residence at 2:47 a.m.

The assigned officers discovered that the female who identified herself as Mary Ames, O.O.B. 03-24~63, in the back south side bedroom. Mary was lying in her bed watching television. It should be noted that the assigned officers did hear the phone ring inside the residence when Captain Merrithew called a few minutes earlier. It should, also be noted that the officers also banged on the door very hard which shook the door. There was no way possible that Mary did not hear the officers knocking or her door and/o~ hear the phone ring. Mary did not seem surprised by the officer's presence. Mary was escorted from her bedroom to the living room and did not ask the officers what was going on.

Officers then located a male subject, who was identified as Michael Ames. D.O.B. 07-28-85, in·the front south side bedroom where he was fying ~ e down and appeared to be sleeping. It was learned that Michael is Mary Ames' son. Michael was also escorted from his bedroom to the ·i"tvlt1g room were he sat ~cross from his mother. A search of the rest of the house did not reveal any more occupants.

After a few minutes, Mary advised the assigned to ask her any questions and she would answer them. Mary was advised to wait a few minutes until Detective Iannone came with a tape recorder prior to the assigned asking her any questions. When Detective Iannone arrived with the tape recorder, Mary was escorted to the lower level living room area, where she-was interviewed by the assigned officers. Prior to asking Mary any questions she was advised of her Miranda Warnings to which he stated she understood and waived her r!ghts and agreed to speak with assigned officers.
