Dear Mr. Moureau
Please accept this letter as a follow-up to our previous conversation and as a
formal request on behalf of my client, Cedric Richmond, to cancel the above-referenced
Tease agreement for Covered Slip #19. In connection herewith, Mr. Richmond is also
Tequesting a refund of all prepaid rents to the Levee District as of August 29, 2005.
As you well know, Mr. Richmond prepaid fora lease term of 24 ¥4 years beginning
August 18, 2004 and ending February 18, 2029. Since the tragedy of Hurricane Katrina,
Mr. Richmond has been deprived of access to and use of Covered Slip #19. Under the
terms of the lease agreement, the Levee Board is Tesponsible for the “maintenance and
repairs of the roof, pilings, and structural supports of the covered slip located on the
Leased Premises, and for maintenance and repairs of the common areas adjacent to the
‘Leased Premises in the Marina.” Inasmuch as the Levee Board has been unable and/or
unwilling to make the required repairs to Covered Slip #19 and the adjacent premises,
Mr, Richmond is entitled to a cancellation of the lease agreement and a refund in the
amount of $70,994.94. This amount represents the prepaid lease amount less one (1)
year’s rent for Covered Slip #19.
Please kindly present this request to the Board of Commissioners and its Legal
Counsel. Mr. Richmond is aware of the fact that other levee board tenants have requested
and received modifications to their lease agreement with the Levee Board as a result of

It is our belief that this request is fair and reasonable under the circumstances.
Kindly provide me with the Board’s decision within the next thirty (30) days. In the
event that the Board is unwilling to cancel Mr. Richmond’s lease and issue the requested
refund, I have been instructed to institute litigation without further delay,
