Lam writing this letter with great privilege and honor on behalf of Joseph Barron, in support of his
application for one of the vacant seats on the Supreme Court of lowa. | am a partner with Peddicord
‘Wharton and have had the opportunity to work very closely with him over the course of my 15 plus years
in the practice of law.
During my 15 years of practice, I have been involved in many complicated eases from products liability
type cases, to breach of contract cases, to insuitance coverage disputes, all of which involved intricate

Please accept this unsolicited letter in support of John W. Bernau for the Jowa Supreme
Court, I have known John for approximately two years now and consider him to have been an
irreplaceable mentor throughout these early stages of my career
| met John as a law student when I was clerking for a firm in Dyersville. He took time to
set up at meeting, with me at which he listened to and answered almost two hours of my
questions, always with an insightful answer and a smile, Since then John has been a “first call”
for me when an important issue atises.
Last April I decided to run for County Attorney immediately out of law school and was
fortunate to be elected, Both before and after the election I sat in on neighboring Delaware
County court fo observe John in action, He searched for the just result in each case and without
exception he consistently treated everyone with respect, whether the person was a judge, defense
attorney, defendant, or courthouse employee.

By way of introduction, my name is Jim Smith and I am the General
Counsel for the Iowa State Education Association, The Towa State Education
Association is a professional association with a membership of approximately
34,000 public school employees. For the fourteen years prior to joining the Iowa
State Education Association, I worked in the Polk County Attomey’s office (the
last six years as the Polk County Attorney). It has recently come to my attention
that the abovenamed Richard Blane II has submitted his name to you, and the
other members of the Iowa State Judicial Nominating Commission, indicating his
desire to be nominated for consideration of his appointment to fill one of the
current vacant positions on the Iowa Supreme Court. The purpose of this letter is
to urge you fo nominate Judge Blane to fill one of those vacancies.
Thave known Judge Blane both personally and professionally since our
days working together in the Polk County Attorney’s Office. I have also followed
his career through his days in the United States Attomey’s Office, the private
practice of law, and his sixteen years as a Judge on the Polk County District Court
Bench. Over the years, I have had ample opportunity to observe him in a number
of these different settings involving many different people and situations. These
interactions with people of varying backgrounds have benefited him greatly in his
current role as a District Court Judge. Whether in the courtroom or in the
community, Judge Blane always speaks and acts with the appropriate amount of
dignity and respect.

During my time as General Counsel for the Jowa State Education
Association, as well as my fourteen in the Polk County Attomey’s Office, I have
had occasion, on an almost daily basis, to observe the Judicial system, and its
participants, in action, I have been very fortunate to be in a position to wateh, and
learn from, some of the State’s best Judges and attorneys, both at the District
Court and Supreme Court levels. I feel that experience puts me in a unique
position to assess the qualifications needed for a member of the Iowa Supreme
Court. In my opinion, Judge Rick Blane meets all of those requirements,
Judge Blane has a great respect for, and knowledge of, the law, He has an
almost uncanny ability to analyze a given situation, identify the issues involved,
assess the options available, and make appropriate decisions. He is also able to
explain his decisions, both orally and in writing, in a manner understandable to
the members of the Bar and lay people alike. I have always found Judge Blane to
be prepared, articulate, courteous, and respectful to all who appear before him.
Perhaps most important, is his overriding sense of fairness.
Judge Blane’s awareness of, and appreciation for, our judicial system and
its important role in our society is obvious. Each day he welcomes the challenge
of making our court system the best that it could possibly be. During all of that
time, Judge Blane has also been very active on numerous Judicial commissions
and committees whose role was to enhance and improve the practice of law and
the role of the Judiciary. Somehow, he was also able to find time to teach a very
popular trial advocacy class at the Drake University School of Law. In addition,
he has continued to seek out, and attend, numerous meetings and conferences to
better assist him in his service to the people of the State of Iowa,
Judge Blane’s professional skills, demeanor, and integrity (both personal
and professional) are above reproach. He works as hard as any judge that I know.
He possesses all of the professional qualities, temperament, good judgment, and
common sense that one looks for in a member of the Supreme Court. I have, in
the past, had occasion to represent numerous clients before the Supreme Court.
Should it be necessary for me to represent the interests of other clients before the
Supreme Court in the future, it would be an honor to have Judge Biane as one of
the presiding Justices.
1 realize that the task before you in nominating individuals to fill the
current vacancies on our State Supreme Court is not an easy one. However, your
decision to nominate Judge Rick Blane for consideration of a position on the
Court would be one of which you would certainly be proud. His judicial ethics,

Judge Blink is an enthusiastic and tireless participant in the legal profession in al of its facets and would

Asa three time applicant for openings on the Towa Court of Appeals myself, [ had the pleasure to
meet you and th you about your vision of what qualities an appeal judge should possess.
Broad experience of many areas of law, good analytic and writing skills, judicial temperament
and personality come to mind as qualities we discussed,
Ihave known Judge Blink for nearly 25 years. We first met when we were new associates
together with Whitfield & Eddy. He came to private practice with 10 years legal experience as
assistant attorney general and assistant Polk County Attorney; I came with 12 years experience in

he went on the district court bench in 1995,
Judge Blink’s entire professional career has groomed him for this opportunity. His experience as

does not mean you cannot do so. 1 know from my personal association with him as a partner,

| would like to take the time to tell you alittle about James D. Bruhn, whom I call Jim, I met Jim in 1998,
We were introduiced at a charity golf outing anid have been friends ever since. Over the years, have
grown to respect Jim for his unending commitment to our community, our schools and the justice

{can tell you his professionalism is as good as I've seen. He has the respect of his peers and the
community because he holds his professionalism and profession in high regard. He believes part of
being a professional and earning respect requires a great deal of citizenship and concern for others. His
demeanor is one of his great assets and his actions certainly prove that. He is respectful, considerate
and a compassionate person.
tn 2004, my wife and | returned from Ukraine with an adopted son, Jake. Jess, our biological son, now
hada brother. While in Ukraine, we met Jake’s sister, Veka, She was living with her grandmother and
doing well, even though she was living in very poor conditions. In November 2006, her grandmother
called our attorney in Ukraine and asked that we adopt Veka. She could no longer provide for her and
was afraid her life would be left to live, running the streets and without any education past 8 grade. A
few days after we received the call we were in Jim’s office, discussing our excitement and the legal
remedies to finish this adoption as quick as legally possible. Jim’s excitement for us and his
understanding of how bad this girl needed to get to the United States was immediate. We gave him a
picture of Veka and asked him to work for her, every day. His efforts helped us finish her adoption in
February, 2008. She is now a freshman at Clinton High School. His work and commitment to her was
the greatest gift he provided our family, just ask my daughter. We would have paid anything for what
he did to help us, yet we have never recelved a bilJim has the courage of integrity. His ability to choose ethics over convenience and truth over popularity
defines him as a person and a professional.
1am proud to be writing this letter on his behalf and | encourage you to give him a fair look and a honest

T am writing this letter to support James D. Bruhn in his
application for appointment for a Supreme Court Justice vacancy.
I am a practicing Attorney in Clinton, Iowa, and have engaged in
the practice of law in Clinton, Towa, since 1976, for a period of
34 years, and Jim Bruhn commenced practicing law in Clinton in
1980, and has been a broad spectrum general practitioner for 30
years. As an Attorney, Mr. Bruhn has been practicing in both
Federal and State Courts and he is an experienced litigator. In
his general practice, I regard Jim as a problem solver as well as
an advocate, which is a rare combination by today’s standards in
our community of lawyers. Jim also represents the City of
Clinton as Attorney for their Civil Service Commission and he
therefore has experience in the administrative law area. Jim is
a good technician, and he has great attention to detail. Mr.
Bruhn is an excellent student of the law and when I have had
difficulty in construing and applying the law, I have turned to
Jim for assistance and sought his opinions regarding
interpretation of the law.
I have frequently opposed Jim Bruhn in the handling of cases
in our community and if we have not resolved the problem prior to
Trial, we have tried our cases in a civil and professional
manner... Mr. James Bruhn has an excellent understanding of the
rules of ethics and he exhibits professional decorum in his

Tam writing this letter in support of Mr. James Bruhn, On a personal note I have known
Jim since 1980, As a young man, he played on a softball team my company sponsored
and supported. After college and law school, he joined a Clinton law firm and soon after
became my personal and corporate lawyer. During this period I observed a competitive
team player that gave 110% effort at whatever he tried,
Recently Mr. Bruhn ran for a school board position and was elected and served two terms
dedication. Currently I am president of the Clinton Community School Board and
having served with Jim in prior years, it is comforting to be able to discuss current
‘matters with him, He remains very knowledgeable.
My real experience with Jim came following a tragie accident that left my son, age 19, in
coma for nearly six months, He was very professional and at the same time
compassionate in his advice and handling of the situation. After coming out of the
comas, it was apparent my son was to need long-term care and rehab, Again, Jim was
able to give advice and guidance. A long-term settlement was achieved that will allow
my son to live a comfortable disabled life.
Thave had many contacts with Jim, whether in business, at Rotary or on a personal level
on the golf course or as a “Hawkeye Fan”. He has acted and played as a truly mature,
caring and knowledgeable individual. I could not think of anyone I know who could
represent the state of Iowa in a more honorable, judicious manner any better than James
D. Bruhn,

Thave known Jim for about thirty-one years, ever since he graduated and
began his career as a lawyer for a law firm in Clinton, Lam currently the
Clerk of Court for Clinton and Jackson County. When Jim started his
career, I was the civil deputy in the Clinton office. In that capacity, I
worked closely with Jim.
I am just starting my 39" year in the Clerk’s office, the last 26 years I have
been the Clerk of Court, Because of Jim’s law practice, in every aspect of
the clerk’s office, I feel with Jim’s experience, he is a great candidate for
one of the vacated positions.
