Affidavit No. I of Wimess No. 10 Swom 2010 No, $-097767 Vancouver Registry IN THE SUPREME COURT OF BRITISH COLUMBIA IN THE MATTER OF: ‘THE CONSTITUTIONAL QUESTION ACT, RSBC. 1986, C. 68 AND IN THE MATTER OF ‘THE CANADIAN CHARTER OF RIGHTS AND FREEDOMS AND IN THE MATTER OF: A REFERENCE BY THE LIEUTENANT GOVERNOR IN COUNCIL SET OCT IN ORDER IN COUNCIL NO. $33 DATED OCTOBER 22, 2009 CONCERNING THE CONSTITUTIONALITY OF S. 293 OF THE CRIMINAL CODE OF CANADA, R.S.C. 1985, C. C-46 AFFIDAVIT 1, Witness No. 10, MAKE OATH AND SAY AS FOLLOW: 1. [have personal knowledge of the facts and matters hereinafter deposed to save and except where the same are stated to be made upon information and belief and where so stated I verily believe them to be true. 2, Tam aware of the order of the Chief Justice made September 24, 2010 and | elect to avail myself of the protections authorized by that order. 3. Tam a resident of the FLDS community in Texas and have lived here for two and a half years. 4 Lam 21 years old. 5, [was born in the Short Creek community, located on the Utah/Arizona border, near Hilldele, Utah and Colorado City, Arizona. My parents had eight children, 6. When J was 13 years old, my mother left the FLDS and we moved from the Short Creek community to West Jordan, Utab, in Salt Lake County. My mother left the FLDS community because she became dissatisfied with our religion. She also strongly disagreed with the Prophet, feeling he had no right for leadership. . 7, After we moved to West Jordan, Utah, my mom put me in summer school. When summer school was finished, I began school at the public junior high schoo! in West Jordan, Utah. There were about 1,000 students in the public junior high and it was a major change, in every area. Trying to fit in was very hard. It was hard to get familiar with the atmosphere in public school because I was used to a coramunity where everything is based on being wholesome and I hadn’t ever run into what I bad been taught was immorality. 8. I was told by my mom and my brothers and sisters, not to go to schoo! dressed the way I did, in my traditional clothing. However, I believe in my religion; I love my religion, regardless of what anyone says. So, I felt that if I started giving that up, I would lose everything; that I ‘would lose my ability to See straight, which is something I've seen with others, including my ‘prothers and sisters. So, I continued to follow my religion and dressed traditionally, even though it caused me to suffer persecution. 9. After junior high, I continued my public education at West Jordan High School in West Jordan, Utah. During high school, I took some college credits. 10. After my mom and my siblings moved to West Jordan, Utah, I continued to visit my fother in Short Creek. I wanted to move back to Short Creek but my morn told me that I coulda’t live back in Short Creek until I was 18 years old, 11, Because I wanted to move back to Short Creek, I started running away from my mom’s home in West Jordan, Utah. However, my mom refused to let me move back home, to Short Creck Eventually, I moved into my uncle's house, but my mor told me that if I tried to run away and go back to Short Creek, she would have the police come for me. 12. I graduated from West Jordan High School in West Jordan, Utah and about a month later, I moved back to Short Creek to be with my family, in the FLDS community. I am the only one of my eight siblings who has gone back to the FLDS community. 13. The only pressure I have ever received is from those who didn't want me to move back to Short Creek. The pressure I bave felt from my siblings has been terrible. Everyone around me ‘tied to prove to me that | was making the wrong decision to come back to Short Creck. My mom told me that I was making the wrong decision to come back. My mom told me that the prejudice against my people was getting even worse and would be twice what it was before. She asked me if I was sure that I wanted to deal with that. But, I wouldn’t change my decision for anything in the world, 14. Ihave a cell phone and can contact whomever I want. I still communicate with my siblings by phone but I have only seen them a few times since I moved back to Short Creek. It is ‘tough for me to talk to my siblings because they put out accusations and I get defensive. I don't have a whole ton of contact with my mom, but we text some. I last heard from my mom in July, ‘on my birthday. 1 don’t choose to call my mom because there is conflict there, but it is better now than it used to be since we live so far away from each otber. 15, Tam currently teaching school at the private school in the FLDS community where I live. 16. 1 am curently unmarried and I don’t have any immediate plans to marry. I want to ‘marry, when [ feel the time is right, and I want to live my religion to the fullest. But, right now, marriage is not the main issue in my life. Right now, the main issue in ty life is just leaming how to teach. 17. I believe the marriage covenant is 4 relationship that is sanctioned by our Heavenly Father through divine power and authority.
