Dear: Mr. Mendez

I Alma Mendez whom resides at 2654 W Thomas Street Chicago, IL 60622 second floor rear have
received your five day notice on April 10, 2011 for non-payment of rent. This is to inform you that, I will
not be moving out in the next five days. As you clearly know the circumstances of the conditions in my
apartment for example the Rotan’s, ants and other insects that you have failed to take care of as a
landlord. Just like a landlord tenants have rights to live in a habitable premises, also the five day notice
mentions a lease you and I both know that you haven’t given me a lease that’s why I live on a month to
month basis.

So with that said, I believe the next step is take me to court and we can both present our case as to why
I haven’t paid you rent and will not pay rent unless the problem is clearly resolved. You have mentioned
in the past that you need me out of my apartment to fix the problem that is totally untrue. You may
think and assume that I don’t know what I am talking about in regards to my rights but I clearly do.
Once again the next time I receive a letter from you should be telling me the time, date and location of
our court date.
