ILLEGAL OPERATION OF “D” CLASS STAND.
Dear Sir,
The above-mentioned letter was received and it was a
surprising fact that the sanction of “D” Class stand was demanded from the undersigned.
The new administration in the Tehsil Municipal
Administration is not aware of the facts and circumstances in which the transporters were shifted from inside of the city to General Bus Stand. However, probably some cases are still pending in the Apex Supreme Court. In the year 1997, the Chairman, Regional Transport Authority/Controller of affairs of Municipal Corporation/Appellate Authority/Commissioner, Multan Division, Multan granted the permission to sale a piece of land, the part of General Bus Stand, to the New Khan Road Runners, to meet with their requirement. The matter was also approved by the auction committee on 23.07.98 and the Administrator of then Municipal Corporation executed a sale deed in favour of the New Khan Road Runners.
In this sale deed, where all the legal requirements and
formalities were fulfilled, the purpose for the sale of land was also mentioned. The words “ ” are very much mentioned in an un-ambiguous manner. The wording mentioned in this sale deed is however, giving a very close meaning towards Rule 253 (b) in Motor Vehicles Rules 1969. The question of sanction at this belated stage does not mean, except to create unlawful, illegal and unwarranted harassment to the New Khan Road Runners. The Commissioner of then Multan Division, Multan, the Chairman Regional Transport Committee on one hand and Controller of affairs of then Municipal Corporation on the other hand were quite wise and aware of the consequences of the execution of the sale deed. It was an express permission from the Regional Transport Authority and the Local Authority as well.
It is, therefore, respectfully requested that such a
question may not be agitated in future and obliged please.
