Our photographers have tuxes and will wear them when requested. _____________________________________________________________________________ This is a contract for personal photography services to be provided by Lexilu Photography Studio and their assistants, to do the work for; __________________________________________, known herein as CLIENT. AGREEMENT Overview: This agreement contains the entire understanding between Lexilu Photography Studio hereafter known as Lexilu, and the CLIENT. It supersedes all prior and simultaneous agreements between the parties. The only way to add or change this agreement is to do so in writing, signed by all the parties. If the parties want to waive one provision of this agreement that does not mean that any other provision is also waived. The party against whom a waiver is sought to be effective must have signed a waiver in writing. Client Initials that they have read and agree to the terms of this page________________ We, Lexilu and the CLIENT, agree to the following terms and conditions. CHANGE OF VENUE: Lexilu must be notified immediately of any changes of schedule or location, at least two weeks prior to the scheduled date of event. Notification of any changes can be made by phone, along with written notice, sent via email for documentation. If an email is sent, a confirmation of receipt must be in writing. It is the CLIENTS responsibility to confirm all arrangements at least 14 days prior to the event. In the event of change of address or contact information (time, etc) as listed, you must notify Lexilu. COOPERATION: The parties agree to cheerful cooperation and communication for the best possible result within the definition of this assignment. Lexilu recommends that CLIENT point out important

individuals for informal or candid photographs to the photographer during the wedding, as well as during portrait shooting, that they wish to have photographed. The photographer will not be held accountable for not photographing desired people if there is no one to assist in identifying people or gathering people for photographs. Lexilu is not responsible if key individuals fail to appear or cooperate during photography sessions or for missed images due to details not revealed to Lexilu. FAILURE TO PERFORM: The photographer is limited by the guidelines of the ceremony official or reception site management. CLIENT agrees to accept the technical results of their imposition on the photographer. Negotiation with the officials for moderation of guidelines is Clients responsibility; Lexilu will however offer technical recommendations. Due to the limited and subjective nature of the event, Lexilu cannot be held responsible for requested or missed photographic opportunities due to lack of coverage resulting from weather conditions, or schedule complication caused by but not limited to, anyone in or at the event, or by the church or location restrictions. The photographer is not responsible for lost photo opportunities due to other camera or flashes, the lateness of any in the bridal party or other principles. It is acknowledged that any lists submitted to Lexilu will be used for organizational purposes only and in no way represents photography that will actually be produced. Lexilu will do its best to fulfill all requests but will make no guarantees as to requested photos. Client Initials that they have read and agree to the terms of this page________________ FORCE MAJEURE: If Lexilu or its assistants, cannot perform this agreement due to fire, casualty, strike, or to civil disturbances, Acts of God, including but not limited to, road closures, severe traffic, fire, terrorism or other causes beyond the control of the parties, or due to the photographers illness, then Lexilu shall return any monies paid by the CLIENT, less expenses, but shall have no further liability with respect to the agreement. This limit of liability shall also apply in the event that photographic materials are damaged in processing, lost through camera malfunction, compact flash card malfunction, lost in the mail, or other wise lost or damaged without the fault on the part of Lexilu. In the unlikely event that the photographer is injured or becomes too ill, or has an emergency that prevents him from photographing the event, Lexilu will make every effort to secure a replacement photographer. If the situation should occur and a suitable replacement is not found, responsibility and liability is limited to the return of all payments received for the event. Lexilu takes the utmost care with respect to exposure, handling, and processing the photographs. However, in the unlikely event that photographs have been lost, stolen, or destroyed for reasons within or beyond Lexilus control, Lexilus liability is limited to the return of all payments received for the event package. GARMENTS: Lexilu cannot be held responsible for damage to GARMENTS during environmental events. Client is responsible to arrange personal assistance for wedding garments. EVENT FOOD SERVICE: Lexilu will take photos of the Bride and Groom possibly at the head table and in the food service line as a depiction of our first meal. However, there will be no photography of individuals while eating. Due to the fact that most wedding coverage begins in the morning and lasts upwards of 12 hours, Lexilu will use this time to break from coverage and eat as well after wedding party and family have been served so that we can continue coverage when the bride and groom are done. In the event Lexilu is shooting with assistants, one assistant will remain poised to continue shooting the event so as not to miss any shots. MODEL RELEASE. The CLIENT hereby grants to Lexilu and its legal representatives and assigns, the irrevocable and unrestricted right to use and publish photographs of the CLIENT or in which the

CLIENT may be included, for editorial, trade, advertising and any other purpose and in any manner and medium; to alter the same without restriction; and to copyright the same. The CLIENT hereby releases Lexilu and its legal representatives and assigns from all claims and liability relating to said photographs. METHOD OF PAYMENT: Payment may be made by; 1. Cash 2. Check payable to Lexilu Photography Studio c/o Lexilu Photography Studio 2671 Clear Springs Ct, Lapeer, MI, 48446 3. Pay Pal invoice. CANCELLATION & REFUND OF DEPOSIT: Deposit may be transferred to another date if available with the photographer but is non refundable if canceled by the Client. All payments, less deposit, made up to 60 days prior to the reserved date will be happily refunded. TRAVEL EXPENSE: For weddings outside the Lapeer area there is a $.50 charge per mile round trip from Lexilus point of origin or 2671 Clear Springs Ct, Lapeer, MI 48446. (Miles are calculated using www.mapquest.com. or similar software.) Depending on the location some destination weddings may incur accommodation expense. For example, Weddings in Northern Michigan when extended travel is necessary. COMPLETION SCHEDULE: Editing the photos and online presentation depends on the amount of editing that needs to be done and the size of CLIENTS files. CLIENT will provide Lexilu with current email and telephone numbers and contact Lexilu with any changes to what is recorded in this contract.

If applicable, please remit payment of balance for services to Lexilu Photography not less than 30 days prior to the event date listed in this contract.

Client Initials that they have read and agree to the terms of this page________________ RETURNED CHECKS: Returned checks are subject to a $50.00 return check fee, AND ANY ADDITIONAL BANKING FEES ASSOCIATED WITH RETURNED CHECK. CLIENT assumes all cost for any and all collection costs and legal fees incurred by Lexilu in the event enforcement of this contract becomes necessary. All legal action shall take place in Lapeer County, Michigan 48446 Client Initials that they have read and agree to the terms of this page________________ Deposit required to save the date DEPOSIT & PAYMENT REQUIREMENTS: Our studio requires a $300.00 deposit on any Wedding Collection to reserve your date and to schedule your photographer. This deposit is Non-Refundable. Our studio requires one-half (1/2) of the total balance due to be paid 60 days prior to your wedding date. The remaining balance is due to our studio on or before 2 weeks (14 days) prior to your wedding date. At this time we will go over your contract to confirm times, place, directions, etc. Payment in Full We do allow for payment in full using credit cards through Pay Pal, cash or check. In the event of cancellation prior to 60 before your date will be refunded less the deposit fee of $300.00. If the event is canceled less than 60 days to the wedding then no refund will be given. Postponements: We understand that sometimes things happen and you may have to postpone your wedding. Should you need to postpone your wedding, please notify us as soon as possible! If you are postponing your wedding to a different date that we have available No Problem!! We will transfer all of your information to that date. We will need notification of postponement in writing please. However, if we do not have the postponed date available and if postponement is before 60 days prior to the wedding date, we limit any refund only to monies paid above the deposit. (The deposit is Non-Refundable.) Cancellations: As with any other company that you hire to perform a service you usually sign a contract. Such is the same with our studio. Once we sign the contract I expect, count on, and plan for that income for my business. I am sure you understand that should you cancel your contract it would be impossible to book another wedding in your place, so our Cancellation Policy is as follows: Cancellation Policy: ALL CANCELLATIONS MUST BE IN WRITING. WE WILL NOT ACCEPT ANY VERBAL CANCELLATIONS. Refunds: Should you cancel your contract with us at any time before the 60 days date prior to your wedding date, we limit refund only to monies paid toward your balance, with payments made in a timely manner.

Should you cancel your contract with us after your 60 days date all monies paid are NON-REFUNDABLE. At this time we will state your contract Null & Void.
