Reeves Municipal Building 2000 14th Street NW, Suite 433 Washington, DC 20009 Ref: Request for Investigation On December 28, 2011, Councilmember Marion S. Barry, Jr. issued an official press release from his Ward 8 Council office, condemning a protest against a womens homeless shelter to be led by potential Council candidate Natalie Williams. The opening sentence of the press release, which clearly identified Ms. Williams as a candidate in the upcoming primary election stated: The planned protest of the Calvary Womens Shelter in Ward 8 lead by Natalie Williams, a candidate for the Ward 8 City Council seat indicates her insensitivity and knowledge about the shelter. The press release later refers to Ms. Williams as a Johnny-Come-Lately and states, Natalie Williams just recently moved into the Ward and knows very little about it. The header of the correspondence list the name of Councilmember Barrys Chief of Staff Joyce Clements-Smith, a government employee, as the point of contact. It also provides her government email, jclementssmith@dccouncil.us and phone and fax numbers issued to his office for government use. The press release is in violation of DC Official Code 1-1106.01 (b)-(h-1)(2) and 11106.51 which states, Usage of District of Columbia government resources, including budget authority, personal services of employees during their hours of work, and nonpersonal services such as supplies, materials, equipment, office space, telephones to support or oppose any candidate for elected office or to support or oppose any initiative, referendum, or recall measure in the District of Columbia. is a prohibited activity by a public official under the law. I am requesting a formal investigation into Mr. Barrys violation of the law as it relates to the guidelines set forth for campaigning. Candidates for public office must be afforded an equal and unbiased chance to win election to the seat they seek, free from the unethical advantage an incumbent can employ if allowed to violate campaign laws.
