Affidavit of Desistance
I, SAMUEL LAHOY y RABE, of legal age, Filipino, married, and a resident of Maharlika, Bislig City, Surigao del Sur, Philippines, after having been duly sworn in accordance with law, hereby depose and say: 1. That I am the private complainant in the criminal case entitled "People of the Philippines versus Gerald Kam" for Grave Oral Defamation and Grave Threats docketed as NPS Docket No. XIII-04-INV-010L-00331 before The City Prosecution Office of Bislig City, Surigao del Sur, Philippines; 2. That I found out that the said accused at the time of the incident was not in his right mind and did not know that what he was doing was wrongful and criminal and further considering that the whole incident subject matter of the preliminary investigation was just a great misunderstanding; 3. That respondent, Gerard Kam, already made amends and asked forgiveness for his actions and utterances and I have subsequently forgiven him; 4. That, in view of the foregoing, I finally manifest that I now completely and absolutely exonerate the respondent, Gerard Kam, from any liability in connection with the above-mentioned preliminary investigation and that I am no longer interested, and I hereby desist, in prosecuting the aforestated criminal case; 5. That I execute this Affidavit of Desistance so that the above-mentioned criminal case be immediately dismissed and considered finally closed and the bond posted by the herein accused be released to him; and 6. That, as such, I am respectfully praying that the aforementioned case against the respondent, Gerard Kam, be dismissed and finally closed with prejudice.
