Applicationforandconditionsofsupply ApplicationforasupplyshallbemadetoandinaformprescribedbytheCouncil. The Council may, before granting a supply, inspect the electrical installation to which an application relateswithaviewtoestablishingthatsuchinstallationissafeandproperandcomplieswiththeseBy lawsorotherapplicablelegislation. Anapplicationforanelectricitysupplyforaperiodoflessthanoneyearshallberegardedasan applicationforatemporarysupplyandshallbeconsideredatthediscretionoftheCouncil,whomay specifyanyspecialconditionstobesatisfiedinsuchcase. Consumersagreement NopersonshalluseorbeentitledtouseanelectricalsupplyfromtheCouncilunlessoruntilsuch personhasenteredintoanagreementinwritingwiththeCouncilforsuchsupply,andsuchagreement togetherwiththeprovisionsoftheseBylawsshallinallrespectsgovernsuchsupply.Ifapersonuses anelectricalsupplywithoutenteringintoanagreementheshallbeliableforthecostofelectricityand 5

anyothercostsincurredbyCouncilinsuchcircumstances. (2) (3) Thechargepayableforelectricityusedshallbeinaccordancewiththeapplicabletariffasperthetariff scheduleasdeterminedbytheCouncil. Nopersonshalluseasupplyunlessaconsumersagreement,ascontemplatedin3(1)hasbeen concludedwiththeCouncilProvidedthatanyconsumerwhowasaconsumerpriortothepromulgation oftheseBylaws,shallbedeemedtohaveconcludedaconsumeragreementwiththeCouncilinterms of3(1). TheCouncilmaydecidewhetheraconsumersagreementshallbeconcludedbyCouncilwiththe ownerofthepremisesorwiththeoccupierofthepremises,orwithboth,orwithanydulyauthorised personactingontheirbehalf. No person shall, without first having obtained the Councils permission in writing, lead electricity temporarily or permanently to any point of consumption or place not forming part of the electrical installationforwhichasupplyhasbeenagreeduponorgiven. Shouldtheconsumerfailtopaytheaccountreferredtoin7(7),theelectricitysupplymaybe discontinuedwithoutnotice. Terminationofconsumersagreement Subjecttotheprovisionofsection7(9)and(13),theconsumersagreementmaybeterminatedbythe consumer,orhisauthorisedrepresentative,orbytheCouncilgiving14daysnoticeinwritingcalculated fromthedateofservicethereof.Providedthatifsuchnoticepurportstoterminateanagreementona Saturday,Sundayorpublicholiday,suchterminationshallonlytakeeffectonthefollowingworkday. Afteraconsumersagreementhasbeenterminated,anyconsumptionrecordedbeforeanother consumersagreementisconcludedinrespectofthesamepremises,shall,untilthecontraryisproved, bedeemedtohavebeenconsumedbytheownerofthepremiseswhoshallbeliableforpaymentof thechargeasdeterminedbytheCouncil. Continuationofsupplytonewconsumers The Council may, upon the termination of any consumers agreement, enter into a new consumers agreementwithanyprospectiveconsumerprovidingforthecontinuationofsupply. Theconsumerwhoisapartytothenewconsumeragreementreferredtoin5(1)shallbeliabletopay fortheelectricityconsumedafterameterreadingtakenonthedateofterminationoftheprevious agreement. Deposits The Council reserves the right to require the consumer to deposit a sum of money as security in paymentofanycharge,whicharedueormaybecomeduetotheCouncil.Suchdepositshallnotbe regarded as being payment or part payment of any accounts due for the supply of electricity for the purposeofobtaininganydiscountprovidedforintheelectricitytariffreferredtointheseBylaws.The depositamountshallbedeterminedonthebasisofthecostofthemaximumconsumptionofelectricity whichtheapplicant,inthetreasurersopinionislikelytouseduringanytwoconsecutivemonths. Notwithstandingtheforegoingprovisionsofthissectionthetreasurermay,inlieuofadeposit,accept fromtheapplicant,aguaranteeforanamountcalculatedinaccordancewithsection6(1)andinthe formprescribedbytheCouncil,assecurityforthepaymentofanyamountthatmaybecomeduebythe applicantfor,orinrespectof,thesupplyofelectricity.Providedthatnosuchguaranteeshallbe acceptedunlesstheestimatedmonthlyaccountinrespectofthesupplytothepremisesconcerned 6

amountstoatleastR2000,00. (3) Thetreasurermayatanytimewhenthedepositorguaranteeisfoundtobeinadequateforthe purposesof6(1),requireaconsumertoincreasethedepositmadeortoincreasetheguarantee furnishedbyhim,inwhicheventtheconsumershall,within30daysafterbeingsorequired,deposit withtheCouncilsuchadditionalsumorfurnishsuchadditionalguaranteeastheCouncilmayrequire, failingwhichtheCouncilmaydiscontinuethesupply. Anysumdepositedbyoronbehalfofaconsumer,shallberefundedwithin30daysafterthe terminationoftheconsumersagreementafterdeductinganyamountduebytheconsumertothe Council. Subjecttotheprovisionof6(4),anypersonclaimingarefundofadepositorpartthereof,shalleither surrenderthereceiptwhichwasissuedforpaymentofthedeposit,orifsuchreceiptisnotavailable, signareceiptprescribedbytheCouncilfortherefundtohimofsuchdepositorpartthereof,andsatisfy theCouncilthatheisthepersonentitledtosuchrefund. Ifadepositorpartthereofhasbeenrefundedinaccordancewith6(5),theCouncilshallbe absolvedfromanyfurtherliabilityinrespectthereof. Theconsumersagreementmaycontainaprovisionthatanysumdepositedbytheconsumer,shallbe forfeitedifitisnotclaimedwithin1yearofeithersuchagreementhavingbeenterminatedorforany reason,theconsumerhasceasedtoreceiveasupplyintermsofsuchagreement. IfaconsumerappliestotheCouncilforasupplyofhighercapacity,thetreasurermayrequirethe consumertomakeanincreaseddepositorfurnishanincreasedguaranteeintermsof6(2)beforesuch supplyisprovided. Accounts TheCouncilshall,inrespectofeachscaleofthetariffgoverningasupply,providethenumberof metersthatitdeemsnecessary.Theconsumershallbeliableforallchargesforallelectricitysupplied tohispremisesattheprescribedtariffrates. The Council may, during any meter reading period, render to the consumer a provisional account in respectofapartofsuchperiodasprovidedforin7(4)and shallas soonas possibleafterthemeter reading at the end of such period render tothe consumer an account based on the actualmeasured consumption and demand during that period, giving credit to the consumer for any sum by him as settlementoftheprovisionalaccount. Anaccountmayberenderedforfixedchargesintermsofthetariffsasandwhentheybecomedue. The amount of a provisional account referred to in 7(2) shall be determined by the Council with referencetopreviousconsumption,reflectingwhatwouldinCouncilsopinion,constituteareasonable guidetothequantityofelectricityconsumedovertheperiodcoveredbytheprovisionalaccount.Ifthere has been no such previous consumption the Councilshall determine the amount ofthe said account with reference to consumption on similar premises which, in Councils opinion afford reasonable guidance. Aconsumersdecisiontodisputeanaccountshallnotentitlehimtodeferpaymentbeyondthedue datestipulatedintheaccount. Whenitappearsthataconsumerhasbeenwronglychargedforelectricityduetotheapplicationofa wrongtarifforonanygroundsotherthatinaccuracyofthemeter,theCouncilshallmakesuch enquiriesandtestsasitdeemsnecessaryandshall,ifsatisfiedthattheconsumerhasbeenwrongly charged,adjusttheaccountaccordingly. Providedthatnosuchadjustmentshallbemadeinrespect 7

ofaperiodinexcessof36monthspriortothedateonwhichthewrongchargewasobservedorthe Councilwasnotifiedofsuchwrongchargebytheconsumer.AnycostsincurredbyCouncilasadirect resultofaconsumercomplaintthatinCouncilsopinionprovedtobewithoutgrounds,shallbecharged totheconsumer. (7) AllaccountsshallbedeemedtobepayablewhenissuedbytheCouncilandeachaccountshall,reflect theduedateanda warningindicatingthatthesupplymaybedisconnectedwithoutnoticeshouldthe chargesinrespectofsuchsupplyremainunpaidaftertheduedate.Thewarningshallbedeemedto bethenoticeservedontheconsumerofsuchdisconnection. Anerrororomissioninanyaccountorfailuretorenderanaccountshallnotrelievetheconsumerofhis obligationtopaythecorrectamountdueforelectricitysuppliedtothepremisesandtheonusshallbe ontheconsumertosatisfyhimselfthattheaccountisrendered. WhereadulyauthorisedofficialoftheCouncilhasvisitedthepremisesforthepurposeof disconnectingthesupplyintermsof7(7)andheisobstructedorpreventedfromeffectingsuch disconnectiontheprescribedfeeshallbecomepayableforeachvisitnecessaryforthepurposeofsuch disconnection. AfterdisconnectionfornonpaymentofanaccountorcontraventionofanyprovisionoftheseBylaws, theprescribedfeesandanyamountsdueforelectricityconsumedshallbepaidbeforereconnectionis made. TheCouncilmaychargeinterestonoverdueaccountsatarateofinterestwhichisonepercenthigher thattherateofinterestpayablebytheCounciltoitsbankforanoverdraft. Thedateonwhichthepaymentofinterestonarrearaccountswillcomeintoeffectshallbetheday aftertheduedateoftheaccount. Themeterreadingperiodshallbeascloseto30daysaspossiblewithintheboundsofpractical considerations. Readingofmeters Theaccountforelectricitysuppliedtoanypremisesduringanymeterreadingperiodshallbetakenas thedifferenceofthereadingofthemeterormetersthereonatthebeginningandtheendofsuchperiod andwheremaximumdemandmeteringpertains,thedemandshallalsoconstituteapartofthemeter reading.Amultiplicationfactorwillbeappliedtothereadingwhereapplicable. Thereadingshownbyametershallbeprimafacieproofoftheelectricalenergyconsumedandofthe maximumdemandduringthemeterreadingperiodandanentryintheCouncilsrecordsshallbeprima facieproofthatthemetershowedthereadingwhichtheentrypurportstorecord. If,attherequestofaconsumer,themeterisreadbyanauthorisedemployeeorcontractorofthe CouncilatatimeotherthatthedatesetasidebytheCouncilforthatpurpose,achargedeterminedby theCouncilshallbepayablebysuchconsumerforsuchreading. Ifforanyreasonametercannotberead,theCouncilmayrenderanestimatedaccount.Theenergy consumptionshallbeadjustedinasubsequentaccountinaccordancewiththeactualenergy consumption. Whenaconsumervacatesapropertyandafinalreadingisnotpossible,anestimationofthe consumptionmaybemadeandthefinalaccountrenderedaccordingly. Ifanycalculating,readingormeteringerrorisdiscoveredinrespectofanyaccountrenderedtoa consumer,theerrorshallbecorrectedinsubsequentaccounts.Anysuchcorrectionshallonlyapplyin 8

respectofaccountsforaperiodof36monthsprecedingthedateonwhichtheerrorintheaccounts wasdiscovered,shallbefreeofinterestuptodateonwhichthecorrectionisfoundtobenecessary, andshallbebasedontheactualtariffsapplicableduringtheperiod. (7) IntheeventoftheCouncilnotbeingabletogainaccesstoameterfortwoconsecutivemeterreadings theCouncilmayforthwithdiscontinuethesupplyofelectricitywithrespecttothepremisestowhichthat meterrelates. Prepaymentmetering Norefundoftheamounttenderedforthepurchaseofelectricitycreditshallbegivenatthepointofsale afterinitiationoftheprocessbywhichtheprepaymentmetertokenisproduced. Copiesofpreviouslyissuedtokensforthetransferofcredittotheprepaymentmetermaybeissuedat therequestoftheconsumer. Whenaconsumervacatesanypremiseswhereaprepaymentmeterisinstalled,norefundforcredit remaininginthemetershallbemadetotheconsumer. TheCouncilmay,atitsdiscretion,appointvendorsforthesaleofcreditforprepaymentmetersand shallnotguaranteethecontinuedoperationofanyvendor. Testingofmeter Ifaconsumerorownerhasreasontobelievethatameterisnotregisteringcorrectly,theconsumeror ownermayrequesttheCounciltohavethemetertested.Suchrequestmustbeaccompaniedbythe feeprescribedinthetariffforthetestingofmeter,andtheCouncilshallassoonaspossiblethereafter testthemeter.Thefeeshallberefundedifthemeterisshownbythetesttoberegisteringincorrectly. TheCouncilsfindingastotheaccuracyofameterafterthetestreferredtoin10(1)hasbeencarried outshallbefinal.Ametershallbeconclusivelypresumedtoberegisteringaccuratelyifitsatisfiesthe requirementsprescribedinNRS057Part2:ElectricityMetering:MinimumRequirements. Theengineershall,immediatelybeforeremovingameterfortesting,takeareadingofthatmeterand thecurrentmeterreadingperiodshallbeterminatedatthetimeofsuchreading. If aftertesting ameter, the Council is satisfiedthatitis not registering correctly,it shall render tothe consumerastatementofaccountadjustedinaccordancewithsection11. TheCouncilshallhavetherighttotestitsmeteringequipment.Ifitisestablishedbyatestorotherwise that such metering equipment is defective, the Council shall in the case of a conventional meter, adjust the account rendered in accordance with section 11 or in the case of prepayment meters, (a) render an account where the meter has been underregistering, or (b) issue a free token where the meterhasbeenoverregistering,inaccordancewiththeprovisionsofsection11. Incaseofadispute,theconsumershallhavetherighttorequesttheCounciltohavethemetering equipmentunderdisputetestedathisowncostbyanindependenttester,accreditedbytheSouth AfricanAccreditationServicesandtheresultofsuchtestshallbefinalandbindingonbothparties. Failureofmetertoregistercorrectly WhentheCouncilissatisfiedthatameterhasceasedtoregistercorrectlythereadingshownthereby shallbedisregardedandtheconsumer: (a) Shallbechargedinrespectofthecurrentmeterreadingperiodthesameamountashepaidin respectofthecorrespondingperiodintheprecedingyear,subjecttoadjustmentnecessitated 9

byanalterationtotheelectricalinstallationofthetariffor (b) ifhewasnotinoccupationofthepremisesduringthecorrespondingperiodreferredtoin 11(1)(a)heshallbechargedonthebasisofhisconsumptionduringthe3monthspreceding thedateonwhichthemeterwasfoundtoberegisteringincorrectlyor ifhewasnotinoccupationofthepremisesduringthewholeoftheperiodreferredtoin11(1)(b) heshallbechargedonthebasisofhisconsumptionduringthe3monthsfollowingthedate fromwhichthemeterwasagainregisteringcorrectly.

Ifitcanbeestablishedthatthemeterhadbeenregisteringincorrectlyforalongerperiodthanthemeter readingperiodreferredtoin11(1)(a),theconsumermaysimilarlybechargedforthecorresponding meterreadingperiods,providedthatnoamountshallbesochargedwithrespecttoaperiodinexcess of36monthspriortothedateonwhichthemeterwasfoundtoberegisteringincorrectly. Disconnectionofsupply TheCouncilshallhavetherighttodisconnectthesupplytoanypremisesifthepersonliabletopayfor suchsupplyfailstopayanychargeduetotheCouncilinconnectionwithanysupplywhichhemayat anytimehavereceivedfromtheCouncilinrespectofsuchpremises,or,whereanyoftheprovisionsof theseBylawsand/ortheRegulationsarebeingcontravened,afternoticehasbeengiventothe occupier.Aftersuchdisconnection,thefeeasprescribedbytheCouncilshallbepaidbefore reconnection. WhenconditionsarefoundtoexistinanelectricalinstallationwhichintheopinionoftheCouncil constitutesadangerorpotentialdangertopersonorpropertyorinterfereswiththesupplytoanyother consumer,theCouncilmay,withoutnotice,disconnectthatinstallationoranypartthereofuntilsuch conditionshavebeenremediedorremoved. TheCouncilmaywithoutnoticetemporarilydiscontinuethesupplytoanyelectricalinstallationforthe purposeofeffectingrepairsormakinginspectionsortestsorforanyotherpurposeconnectedwithits supplymainorotherworks. TheCouncilshall,onapplicationbyaconsumer,inaformprescribedbytheCouncil,disconnectthe supplyandshallreconnectitonpaymentofthefeeprescribedinthetariff. Whenaninstallationhasbeenillegallyreconnectedonaconsumerspremisesafterhavingbeen previouslylegallydisconnectedbytheCouncil,orwhereCouncilsequipmenthasbeentamperedwith topreventfullregistrationofconsumptionbythemeter,theelectricitysupplyshallbephysically removedfromthosepremisesandwillonlybereinstalleduponpaymentoftheapplicablefee,as prescribedinthetariffofcharges. TheCouncilshallnotbeliableforanylossordamage,directorconsequentiallysufferedorsustained byaconsumerasaresultoforarisingfromthecessation,interruptionordiscontinuationofthesupply ofelectricity,unlesscausedbynegligenceonthepartoftheCouncil. Unauthorisedconnection Nopersonshallpersonally,norshalltheypermitanyoneelsetoconnectorreconnectorattemptto connectorreconnectanyelectricalinstallationtothepointofconsumption,theelectricitysupply,the serviceconnectionorsupplymainexceptanemployeeoftheCouncil,acontractor,orapersoninthe serviceofacontractororconsumer,authorisedtodosobytheCouncil. Ifthesupplytoanyelectricalinstallationisdisconnected,theconsumerconcernedshalltakeall reasonablestepswithinhispowertoensurethatsuchsupplyisnotreconnectedincontraventionof 13(1). 10

IfsuchsupplyisneverthelesssoreconnectedafterithasbeendisconnectedbytheCouncilthe consumerconcernedshallforthwithtakeallreasonablestepswithinhispowertoensurethatno electricityisconsumedonthepremisesconcernedandshall,inaddition,forthwithnotifytheCouncilof suchreconnection. Iftheconsumercontemplatedin13(2)or13(3)isnotinoccupationofthepremisesconcerned,thenthe occupierofthosepremisesshallcomplywiththeprovisionsofthementionedsubsections. Anycontraventionorfailuretocomplywiththeprovisionofthissection,whetherintentionalor negligent,shallbesufficienttoconstituteanoffenceand,unlessthecontraryisprovedbythe consumer,itshallbedeemedthatthecontraventionwasduetoanintentionalactoromissionofthe personcharged. Whereasupplythathaspreviouslybeendisconnectedisfoundtohavebeenreconnected,the consumerusingthesupplyshallbeliableforallchargesforelectricityconsumedbetweenthedateof disconnectionandthedatethesupplyisfoundtobereconnectedandanyotherchargesraisedinthis regard. Resaleofelectricity Where a person resells electricity supplied by the Council, such electricity shall, in respect of each purchaser,bemeteredthroughasubmeterapprovedbytheCouncil. TheCouncilshallnotbeheldliableforanyinaccuracyorotherdefectinanysubmeterwhetherornot theCouncilhasapprovedsuchsubmeterortheinstallationthereof. Thechargemadebysuchsellershallnotexceedthetariffwhichwouldhavebeenpayablehadthe purchaserbeenaconsumeroftheCouncil.Withtheunderstandingthattheresellermaydividehis totalunitspurchasedintohistotalaccountreceivedfromCounciltoarriveatacentperkWHunit charge.Theresellercanthenusethisc/unitchargetobillhiscustomers. Theconditionsofresaleshallnotbelessfavourabletothepurchaserthanthetermsonwhichthe Councilsupplieselectricity.Theresellermayhoweverrecovertheadministrativecostincurredin meteringandbilling,fromthepersonsosuppliedwithelectricity,providedthatattherequestofsuch person,theresellershallfurnishsuchpersonwithsuchinformationasmaybenecessarytoenablehim todeterminewhethertheadministrationcostsarefairandreasonableandeverysuchpurchasershall beentitledtorequirethesellertofurnishhimwithallsuchaccounts,documentsandotherinformation asmaybenecessarytoenablethepurchasertoascertainwhethertheaccountsrenderedtohimfor electricitysuppliesarecorrect. Installationdiagramandspecification TheCouncilmayrequireacontractortosubmit,forapproval,awiringdiagramandspecifications coveringaproposedconstructionor,alteration,extensionorrepairtoanyelectricalinstallation.Where theCouncilrequiressuchadiagramandspecificationtheproposedworkshallnotbecommenceduntil theyhavebeensubmittedandapproved.

Inspectionandtests TheCouncilmay,atanyreasonabletimeorincaseofemergency,enteranypremisesandinspector testanypartoftheserviceconnectionorelectricalinstallationthereonforanypurposeincludingthe purposeofascertainingwhetherabreachoftheseBylawsorotherapplicablelegislationhasbeenor isbeingcommittedandtheownerorcontractor,whencalledupontodoso,shallremoveanyearth, bricks,stone,woodwork,orotherworkobstructingorcoveringanypartoftheelectricalinstallation.

Beforeanytestorinspectionintermsofthissectioniscarriedouttheownerortheoccupiershallbe informedofthepurposethereofandifitisestablishedthatabreachoftheseBylawshasbeen committed,theCouncilshall,notwithstandingtheprovisionsof16(3)notbeliabletorestoreandmake goodintermsthereof. TheCouncilshall,saveasisprovidedin16(2)restoreandmakegoodanydisturbancedamageto interferencewiththepremisesoccasionedbyanyinspectionortestmadeintermsof16(1). Whileanyelectricalinstallationisinthecourseofconstruction,alteration,extensionorrepairthe engineermayinspectandtestanypartoftheworkasoftenashedeemsnecessary,andifanywork whichtheCouncilrequirestoinspectortesthasbeencovereduptheCouncilmayrequirethe contractorortheownerofthepremisesatnocosttotheCouncil,touncoverthatwork,toexposeany jointsorwiresandtoremoveanyfittings,castings,trapdoors,floorboards,materialsorother obstructionswhatsoeverandanyworkorreinstatementrenderednecessaryshalllikewisebecarried outatnocosttotheCouncil. EveryreasonablefacilitytocarryouttestsandinspectionsshallbeaffordedtotheCouncilbythe electricalcontractor,theownerortheoccupierofthepremisesandtheaforesaidfacilitiesshallinthe caseofacontractor,includetheprovisionofsuitableladders. AnypersoninpossessionofaCertificateofComplianceintheformofAnnexure1foranewelectrical installation,shallgivetheCouncilatleastthreeworkingdaysnoticebeforethesupplyistobeswitched on. LiabilityofCouncilandContractor NeithertheCouncilsapprovalofanelectricalinstallationaftermakinganyinspectionortestthereofnor thegrantingbyhimofpermissiontoconnecttheinstallationtothesupplyshallbetakenasconstituting foranypurpose,aguaranteebytheCouncilthattheworkhasbeenproperlyexecutedorthatthe materialsusedinitaresoundorsuitableforthepurposeoranywarrantywhatsoeverorasrelievingthe contractorfromliability,whethercivilorcriminal,forexecutingtheworkimproperlyorforusingfaulty materialtherein. TheCouncilshallnotbeunderanyliabilityinrespectofanyinstallationorotherworkorforanylossor damagecausedbyfireorotheraccidentarisingwhollyorpartlyfromtheconditionofanelectrical installation. Serviceconnection Theownerofthepremisesconcernedorpersonactingonhisbehalfshallmakeapplicationforthe installationorreinstatementofaserviceconnectioninaformprescribedbytheCouncil. Aserviceconnectionshallbeinstalledattheexpenseoftheownerandthecostthereofasdetermined bytheCouncilshallbepaidtotheCouncilbeforesupplyisauthorized. EverypartoftheserviceconnectionshallremainthepropertyoftheCouncil. Notwithstandingthattheserviceconnectiontoanapprovedelectricalinstallationmayalreadyhave beencompleted,theCouncilmayatitsabsolutediscretion,refusetosupplyelectricitytothat installationuntilallsumsduetotheCouncilbythesameconsumerinrespectofthatoranyother serviceconnection,whetherornotonthesamepremises,havebeenpaid. Noownershallbeentitledtorequiremorethanoneserviceconnectionforasupply,toanypremises, evenifitcomprisesoroccupiesmorethatonestand.TheCouncilmayhowever,subjecttosuch conditionsasitdeemsfittoimposeupontheowner,providemorethanoneserviceconnectiontoa premisesandwheremorethanoneserviceconnectionissoprovideditshallbeunlawfulto 12

interconnectthem. (6) Incaseswheremorethanoneconsumeronthesamepremisesisprovidedwithelectricityfroma singlepointbymeansofequipmentbelongingtotheownerofthepremises,theCouncilwillnotbe responsibleforanydefectsintheelectricitysupplywhatsoever,thatarecausedbydefectsinthe equipmentoftheownerofthepremises. Theapplicantforaserviceconnectionshall,beforeworkonhisinstallationiscommenced,furnishthe Councilwithsuchindemnityasitmayspecify. The Council may, notwithstanding any indemnity given in terms of 18(7) refuse to install a service connectionuntilitissatisfiedthatnopersonisentitledtoobjecttosuchinstallation. Sealedapparatus Where any seal or lock has been placed by the Council on any meter, service fuse, service circuit breaker or other similar apparatus or cabinet or room in which such apparatus is accommodated whetherornotbelongingtotheCouncil,nopersonotherthananemployeeoftheCouncil,acontractor, apersonintheserviceofacontractororaconsumerauthorisedbytheengineershallforanyreason whatsoeverremove,break,defaceorotherwiseinterferewithanysuchsealorlock. 20. (1) Tampering Nopersonshallinanymannerorforanyreasonwhatsoeverpaint,deface,tamperorinterferewithany meterorserviceconnectionorserviceprotectiondeviceorsupplyoranyotherequipmentofthe Council.OnlyanauthorizedemployeeoftheCouncilmaymakeanyadjustmentorrepairthereto. Whenasaresultofillegaltamperingbyaconsumer,itisnecessarytomakealterationstothemetering systemtopreventfurthertampering,theconsumershallbeliableforthetotalcostofsuchalterations. Liabilityfordamagetoserviceconnection TheownerofthepremisesortheconsumershallbeliabletomakegoodtotheCouncilanydamage thatmayoccurtotheserviceconnectionoranypartthereofortoanyotherCouncilapparatusonthe premises,unlesssuchownerorconsumercanprovenegligenceonthepartoftheCouncil. Ifanydamageoccurstothecableoranypartofaserviceconnectiontheconsumershallinformthe CouncilassoonashebecomesawareofthatfactandtheCouncilorapersonauthorizedbyCouncil shallrepairthedamage.Ifthedamagewascausedbytheconsumer,hewillbeliableforthecost. Typeofsupply TheCouncilmayinanyparticularcasedeterminewhetherthesupplyshallbemediumorlowvoltage andthetypeofsuchsupply. 23. (1) Lowvoltageconnection Beforealowvoltagesupplyisgiven,theapplicantorownershall,ifrequiredtodosobytheCouncil, provideacabinetofapproveddesignandconstructionfortheaccommodationoftheCouncilsservice connection,atnoexpensetotheCouncilandinapositionapprovedbytheCouncil. The consumer shall provide approved accommodation in an approved position,themeter board, and adequateconductorsfortheCouncilsmeteringequipment,serviceapparatus,protectivedevicesand load management relays. Such accommodation and protection shall be provided and maintained, to the satisfaction ofthe engineer, at the cost of theconsumer orthe owner, as the circumstances may demand and shall be situated, in the case of conventional meters, at a point to which free and 13

unrestricted access can be had at all reasonable hours for the reading ofmeters and at alltimes for purposes connected with the operation and maintenance of the service equipment. Access at all reasonablehoursshallbeaffordedfortheinspectionofprepaymentmeters. (3) (4) Where submetering equipment is installed, accommodation separate from the Councils metering equipmentshallbeprovided. The consumer or in the case of a common meter position, the owner of the premises, shall provide adequate electric lighting in the space set aside for accommodating the metering equipment and serviceapparatus. WhereintheopinionoftheCouncil,thepositionofthemeter,serviceconnection,protectivedevicesor maindistributionboardisnolongerreadilyaccessibleorbecomesasourceofdangertolifeorproperty orinanywaybecomesunsuitable,theconsumershallremoveittoanewposition,athiscostwithina reasonabletime. The accommodation for the Councils metering equipment and protective devices may, if approved, includetheconsumersmainswitchandmainprotectivedevice.Noapparatusotherthanthatusedin connection with the supply and use of electricity shall be installed or stored in such accommodation unlessapproved. Mediumvoltageelectricalinstallation Alltheapparatususedinconnectionwithamediumvoltageelectricalinstallationshallbeofan approveddesignandconstruction. Before any work is commenced in connection with anew mediumvoltage electricalinstallation orfor theextensionofanexistingmediumvoltageinstallation,asiteplanandadrawingshowingindetail,to the Councils satisfaction,the particulars and layout of all proposed electrical apparatus together with fulltechnicalinformationconcerningtheapparatus,shallbesubmittedtotheCouncil.Noworkshallbe commenceduntiltheproposedinstallationorextensionhasbeenapproved. No person other than an authorized skilled person shall undertake the installation, repair, alteration, extension, examination or operation of or touch or do anything in connection with medium voltage apparatus. Notwithstandinganyapprovalpreviouslygiven,theCouncilmayatanyreasonabletimeandincaseof emergency at all times, inspect any high voltage apparatus and subject it to such test as may be deemed necessary and may, if such apparatus be found defective, disconnect the supply to the premisesuntilthedefecthasbeenrectifiedtotheCouncilssatisfaction. TheownerortheconsumershallbeliabletotheCouncilforthecostofcarryingoutanyofthetests referredtoin24(4)ifanydefectinthemediumvoltageorlowvoltageelectricalinstallationisrevealed thereby. Notwithstandinganythingcontainedinthissection,nomediumvoltageapparatus,whichhasbeen newlyinstalled,alteredorextendedshallbeconnectedtothesupplywithoutthepermission,inwriting, oftheCouncil,whichpermissionshallnotbegivenunlesstherequirementsofthissectionhavebeen compliedwith. Enclosuresforsupplyequipment WhererequiredbytheCouncil,anownershall,atnoexpensetotheCouncil,provideandmaintainan approved enclosurefor accommodating the Councils and consumers supply equipmentin a position determinedbytheCouncil.

No person shall enter the enclosure accommodating the Councils supply equipment or touch or interferewithanyapparatustherein,unlessauthorizedtodosobytheCouncil. Everylowvoltageenclosureassociatedwithamediumvoltageenclosureandeveryenclosurefora specialsupplyatlowvoltageshallbekeptlockedbytheconsumerandakeyshall,ifrequiredbythe Council,bedepositedwithCouncilorprovisionshallbemadeforthefittingofanindependentlockby theCouncilwhoshallbeentitledtoaccesstotheenclosureatalltimes. The consumer or owner of the premises shall at all times provide and maintain safe and convenient accesstoamediumvoltageenclosureandsuchenclosureshallatalltimesbekeptcleanandtidyby the consumer to the satisfaction of the Council and shall be used for no other purpose save the accommodationofequipmentandapparatusassociatedwiththesupply. Theconsumerorownerofpremisesshallatalltimesprovideandmaintainsafeandconvenientaccess toamediumvoltageenclosure.Suchaccessistobedirecttothatpartoftheenclosureintowhichthe mediumvoltagesupplyisledandnotthroughthelow voltageenclosureorthroughanydoororgate, thelockofwhichiscontrolledbytheconsumerortheownerofthepremises. TheCouncilmayuseanyenclosureforsupplyequipmentinconnectionwithasupplytoaconsumeron premisesotherthanthoseonwhichthatenclosureissituated. Permanentlyconnectedappliances AppliancespermanentlyconnectedtoanelectricalinstallationshallbeapprovedbytheCouncil.

Maintenanceofinstallation Anyelectricalinstallationonanypremisesconnectedtothesupplymustbemaintainedingoodworking orderandconditionatalltimesbytheownerorconsumertothesatisfactionoftheCouncil. TheCouncilmayrequireaconsumerwhotakesamultiphasesupply,todistributehiselectricalloadas approvedbytheCouncil,overthesupplyphaseandmustinstallsuchdevicesintherelevantservices connectionasitmaydeemnecessarytoensurethatthisrequirementiscompliedwith. Noconsumershalloperateelectricalequipmenthavingloadcharacteristicsorhavingunbalanced phasecurrents,whichfalloutsidethestandardsdeterminedbytheCouncil. Theassessmentofinterferencewithotherconsumersshallbecarriedoutbymeansofmeasurements takenatthepointofcommoncoupling. IfrequiredbytheCouncil,thepowerfactorofanyloadshallbemaintainedwithinthelimits0,85lagging and0,9leading. Where,forthepurposeofcomplyingwith29(5)itisnecessarytoinstallpowerfactorcorrectiondevices, suchcorrectivedevicesshallbeconnectedtotheindividualterminalsunlessthecorrectionofthe powerfactorisautomaticallycontrolled. 15

Nopersonshall,exceptwiththeconsentoftheCouncilandsubjecttosuchconditionsasmaybe imposed: a) Construct,erectorpermittheerectionofanybuildingstructureorotherobject,orplant,treesor vegetationoverorinsuchapositionorinsuchamannerastointerferewithorendangerthe electricaldistributionsystem excavate, open up or remove the ground above, next to or under any part of the electrical distributionsystem damage,endanger,removeordestroyordoanyactlikelytodamage,endangerordestroyany partoftheelectricaldistributionsystem makeanyopeninginanypartoftheelectricaldistributionsystemorobstructordivertorcause tobeobstructedordivertedanyelectricaldistributionsystemtherefrom the owner shall limit the height of trees or length of projecting branches in the proximity of overhead lines or provide a means of protection which in the opinion of the Council will adequatelypreventthetreefrominterferingwiththeconductorsshouldthetreeorbranchfallor becutdown.ShouldtheownerfailtoobservethisprovisiontheCouncilshallhavetheright, afterpriorwrittennotification,oratanytimeinanemergency,tocutortrimthetreesorother vegetationinsuchamannerastocomplywiththisprovisionandshallbeentitledtoenterthe propertyforthispurpose ThecostofanyworkcarriedoutbytheCouncilasnecessitatedbyacontraventionofthisBy law,shallbefortheaccountofthepersonwhoactedincontraventionofsection29.

Controlapparatus Attimesofpeakloadorinanemergency,orwhen,intheopinionoftheCouncil,itisnecessaryforany reason to reduce the load on the electricity supply system of the Council, the engineer may without noticeinterrupt and,for such period as the engineer may deem necessary, discontinue the electricity supplytoanyconsumerselectricallyoperatedthermalstorage waterheaterorany specificappliance or the whole installation. The Council shall not be liable for any loss or damage directly or consequentiallyduetoorarisingfromsuchinterruptionanddiscontinuanceoftheelectricitysupply. TheCouncilmayinstalluponthepremisesoftheconsumersuchapparatusandequipmentasmaybe necessary to give effect to the provisions of 30(1), and the engineer or any duly authorized official of the Council may at any reasonable time enter any premises for the purpose of installing, inspecting, testing,adjustingand/orchangingsuchapparatusandequipment. Notwithstanding,theprovisionsof30(2),theconsumerortheowner,asthecasemaybe,shall,when 16

installing an electrically operated water storage heater, provide such necessary accommodation and wiring as the engineer may decide to facilitate the later installation of the apparatus and equipment referredtoin30(2). (4) Theengineermayuponwrittenrequestbyaconsumerconsenttoanyapparatusnotbeingconnected toacontrolrelay,inwhicheventtheconsumershall,fortheperiodduringwhichsuchapparatusisnot soconnected,payamonthlychargedeterminedbytheCouncil. Theengineermayprovideasetofelectricalcontactswhichwillclosewhentherelaycontemplatedin 30(1)isoperative,andwhichwillenabletheconsumertooperateloadcontrolapparatusandwarning devices. Obstructingemployees Nopersonshallrefusetogiveorfailtogivesuchinformationasmayreasonablyberequiredofhimby andulyauthorisedofficialoftheCouncilorrenderanyfalseinformationtoanysuchofficialregarding anyelectricalinstallationworkcompletedorcontemplated. Nopersonshallwilfullyhinder,obstruct,interferewithorrefuseadmittancetoanydulyauthorized officialoftheCouncilintheperformanceofhisdutyundertheseBylawsorofanydutyconnected therewithorrelatingthereto. Irregularsupply TheCouncilshallnotbeliablefortheconsequencestotheconsumeroranyotherpersonofstoppage, failure,variation,surgeorotherdeficiencyofelectricityfromwhatsoevercause,providedthat compliancewiththeElectricityActismaintained. 33. Complaintsoffailureofsupply IfanauthorizedemployeeoftheCounciliscalledtoaconsumerspremisesbyanyconsumertoattend to a complaint concerning any failure of supply and the cause thereof is found to be due to the consumers electrical installation, a charge determined by the Council shall be payable by such consumerforsuchattendance. 34. Ownersandconsumersliability (1) The owner and the consumer shall be jointly and severally liable for compliance with any financial obligation, except as provided in section 34(2) or other requirement imposed upon thembytheseBylaws. The liability for compliance with any financial obligation in respect of the consumption of electricity,shallbethesoleresponsibilityoftheconsumer.

Notices AnynoticeorotherdocumenttobeissuedbytheCouncilintermsoftheseBylawsshallbedeemedto havebeensoissuedifitissignedbyanauthorizedofficialoftheCouncil. (1) Offencesandpenalties AnypersoncontraveningorfailingtocomplywithanyprovisionoftheseBylawsshallbeguiltyofan offenceandshalluponconvictionthereofbeliableforafinenotexceedingR2000,00orindefaultof paymenttoimprisonmentforaperiodnotexceeding12months. Theoccupier,oriftherebenooccupier,theownerofanypremisessuppliedwithelectricity,wherea breachoftheseBylawshasoccurred,shallbedeemedtobeguiltyofthatbreachunlessheproves thathedidnotknowandcouldnotbytheexerciseofreasonablediligencehaveknownthatitwas beingorwaslikelytobecommittedandthatitwascommittedbysomeotherpersonoverwhoseacts hehadnocontrol. Anypersonwhocontravenestheprovisionsofsection13andwhoisasaconsequencethereof,not chargedforelectricitywhichhasbeenconsumedorischargedforsuchelectricityataratelowerthan thatwhichheshouldproperlyhavebeenchargedshall,notwithstandinganypenaltywhichmaybe imposedintermsofthissection,beliabletopaytotheCouncilthesumwhichwouldhavebeenpaid hadthesaidoffencenotbeencommitted.Suchsumshallbecalculatedintermsofthehighestcharge, whichcouldhavebeenmadeaccordingtothetariffapplicablefromthedatewhenthecontravention firsttookplace. 1/4/1/1/2 MI195/2001dated29November2001andCL 71/2002dated26March2002 102dated24April2002 487
