Dear U.S. Attorney Leonardo: My personal congratulations to you on your recent appointment as United States Attorney to the State of Arizona. Last month the media stated that you are now a key part in restoring public confidence in the federal government, subsequent to the Fast and Furious gun sales scandal and the murder of U.S. Border Patrol Agent Brian Terry. Regarding public confidence: It has been widely reported that on or about August 22, 2012, the FBI began investigating Tucson based property management company Rathbun Realty Inc., with regards to an apparent embezzlement of 1.8 million dollars from Rathbun Realty Trust Fund Accounts. Subsequently; in my capacity as a public advocate, a significant number of Rathbun Client-Landlords, (many of them residing out of state), have contacted me for news and information on how they should proceed. Apparently; Rathbun Client-Landlords, who number some 800, are becoming increasingly concerned regarding the safety of their properties, their (apparent) lack of payment for any rents

received on their behalf by Rathbun Realty, Inc. for the past three months, and the lack of news from any official Arizona State or Federal Government source whom, ultimately, are responsible for the regulation of real estate activities and the enforcement of laws regarding the theft or embezzlement of money on deposit in banks, within the State of Arizona. Frankly; the local media is continuing to spin the facts and hide the truth, resulting in growing public confusion and alarm, as well as the unnecessary erosion of confidence in government institutions whose sole purpose is, to protect the public interest. Could your office please respond to this inquiry and let the public know: what are the actions you intend to take and when you may take them? Regarding public confidence: Supreme Court Justice Frankfurter wrote: "The Court's authority possessed of neither the purse nor the sword ultimately rests on sustained public confidence in its moral sanction. BAKER V CARR, 369 US 186, 82 S.CT. 691 That was true for you while you served so admirably as a Pima County Judge, as well as now in your capacity as U.S. Attorney. The only difference is: Now, as U.S. Attorney, YOU also possess The Sword. Thank you for your attention.
