Peoplevs.Orita ART.6:STAGESOFEXECUTION FACTS:ComplainantCristinaS.Abayanwasa19yearoldfreshmanstudentattheSt.Joseph'sCollegeatBorongan,EasternSamar.Appellant wasaPhilippineConstabulary(PC)soldier.somebodyheldherandpokedaknifetoherneck.Shethenrecognizedappellantwhowasa frequentvisitorofanotherboarder(pp.89,ibid). Shepleadedwithhimtoreleaseher,butheorderedhertogoupstairswithhim.Sincethedoorwhichledtothefirstfloorwaslockedfrom theinside,appellantforcedcomplainanttousethebackdoorleadingtothesecondfloor(p.77,ibid).Withhisleftarmwrappedaroundher neckandhisrighthandpokinga"balisong"toherneck,appellantdraggedcomplainantupthestairs(p.14,ibid).Whentheyreachedthe secondfloor,hecommandedhertolookforaroom.WiththeBatangasknifestillpokedtoherneck,theyenteredcomplainant'sroom. Uponenteringtheroom,appellantpushedcomplainantwhohitherheadonthewall.Withonehandholdingtheknife,appellantundressed himself.Hethenorderedcomplainanttotakeoffherclothes.Scared,shetookoffherTshirt.Thenhepulledoffherbra,pantsandpanty(p. 20,ibid). Heorderedhertoliedownonthefloorandthenmountedher.Hemadeherholdhispenisandinsertitinhervagina.Shefollowedhisorder ashecontinuedtopoketheknifetoher.Atsaidposition,however,appellantcouldnotfullypenetrateher.Onlyaportionofhispenis enteredherasshekeptonmoving(p.23,ibid).

Appellantthenlaydownonhisbackandcommandedhertomounthim.Inthisposition,onlyasmallpartagainofhispeniswasinsertedinto hervagina.Atthisstage,appellanthadbothhishandsflatonthefloor.Complainantthoughtofescaping(p.20,ibid) Accusedplednotguiltybutthetrialcourtfoundandconvictedtheaccusedoffrustratedrape. Inhisappeal,theaccusedassignsthefollowingerrors: 1.) Thetrialcourterredindisregardingthesubstantialinconsistenciesinthetestimoniesofthewitnesses;and 2.) Thetrialcourterredindeclaringthatthecrimeoffrustratedrapewascommittedbytheaccused. ISSUE:WONtheaccused'sconvictionforfrustratedrapeisproper.i.e.,WONthefrustratedstageappliestothecrimeofrape. RULING:Clearly,inthecrimeofrape,fromthemomenttheoffenderhascarnalknowledgeofhisvictimheactuallyattainshispurposeand, fromthatmomentalsoalltheessentialelementsoftheoffensehavebeenaccomplished.Nothingmoreislefttobedonebytheoffender, becausehehasperformedthelastactnecessarytoproducethecrime.Thus,thefelonyisconsummated.Inalonglineofcases(Peoplev. Oscar,48Phil.527;Peoplev.Hernandez,49Phil.980;Peoplev.Royeras,G.R.No.L31886,April29,1974,56SCRA666;Peoplev.Amores, G.R.No.L32996,August21,1974,58SCRA505),Wehavesettheuniformrulethatfortheconsummationofrape,perfectpenetrationisnot essential.Anypenetrationofthefemaleorganbythemaleorganissufficient.Entryofthelabiaorlipsofthefemaleorgan,withoutrupture ofthehymenorlacerationofthevaginaissufficienttowarrantconviction.Necessarily,rapeisattemptedifthereisnopenetrationofthe femaleorgan(Peoplev.Tayaba,62Phil.559Peoplev.Rabadanetal.,53Phil.694;UnitedStatesv.Garcia:9Phil.434)becausenotallactsof executionwasperformed.Theoffendermerelycommencedthecommissionofafelonydirectlybyovertacts.Takingintoaccountthenature, elementsandmannerofexecutionofthecrimeofrapeandjurisprudenceonthematter,itishardlyconceivablehowthefrustratedstagein rapecaneverbecommitted. DecisionoftheRegionalTrialCourtisherebyMODIFIED.TheaccusedCeilitoOritaisherebyfoundguiltybeyondreasonabledoubtofthe crimeofrape. Ofcourse,weareawareofourearlierpronouncementinthecaseofPeoplev.Eria50Phil.998[1927]whereWefoundtheoffenderguilty offrustratedrapetherebeingnoconclusiveevidenceofpenetrationofthegenitalorganoftheoffendedparty.However,itappearsthatthis isa"stray"decisioninasmuchasithasnotbeenreiteratedinOursubsequentdecisions.Likewise,WeareawareofArticle335oftheRevised PenalCode,asamendedbyRepublicActNo.2632(datedSeptember12,1960)andRepublicActNo.4111(datedMarch29,1965)which provides,initspenultimateparagraph,forthepenaltyofdeathwhentherapeisattemptedorfrustratedandahomicideiscommittedby reasonorontheoccasionthereof.Weareoftheopinionthatthisparticularprovisiononfrustratedrapeisadeadprovision.TheEriacase, supra,mighthavepromptedthelawmakingbodytoincludethecrimeoffrustratedrapeintheamendmentsintroducedbysaidlaws.
