MOTION TO EXPEDITE HEARING OR CONSIDERATION OF MOTION TO LIMIT THE TIME TO ASSUME OR REJECT AN EXECUTORY CONTRACT TO THE HONORABLE LEIF M. CLARK, UNITED STATES BANKRUPTCY JUDGE: NOW COMES Wortham Insurance and Risk Management (hereinafter "Wortham") pursuant to Local Rule 9014(e) and files this Motion to Expedite Hearing or Consideration of Motion to Limit the Time to Assume or Reject an Executory Contract. In support of its motion, Movant would show the following: 1. On or about January 3, 2012, Delta Produce, L.P. (hereinafter Delta) and Superior Tomato Avocado, Ltd. (hereinafter Superior) filed voluntary petitions for relief under Chapter 11 U.S.C. 1101 et seq. (the Bankruptcy Code) in the Western District of Texas. 2. As set forth in Movants Motion to Limit the Time to Assume or Reject, Movant will become obligated to pay approximately $96,000.00 in insurance premiums to The Cincinnati Indemnity Company and St. Paul Travelers Insurance Company on behalf of Delta and Superior unless the debtor has rejected the executory contracts by the time the insurance policies expire at midnight on April 4, 2012. 3. The undersigned has conferred with Alan Dubard, one of the attorneys for the debtors, by email and telephone since March 16, 2012, but has not been able to obtain a definite decision as to whether the debtors intend to assume or reject the executory contracts. 4. Movant is requesting that the Court require Delta and Superior to assume or reject the insurance contracts at issue on or before March 30, 2012 in order to give Movant sufficient time to prepare a cancellation of these policies if Delta and Superior reject the contracts. 5. Movant requests an expedited hearing or consideration of its Motion to Limit Time to Assume or Reject so that it can cancel the policies on or before midnight on April 4, 2012 if the debtors reject them, or obtain relief from the stay should the debtors seek to assume them. WHEREFORE, PREMISES CONSIDERED, Wortham respectfully requests that the Court expedite the hearing or consideration of the Motion to Limit Time to Assume or Reject, and further relief in law and in equity as is just.
