ORDER AUTHORIZING DEBTORS TO (I) MAINTAIN EXISTING BANK ACCOUNTS; (II) CONTINUE TO USE EXISTING BUSINESS FORMS; AND (III) AND GRANTING RELATED RELIEF Upon the Debtors1 motion dated May 5, 2011 (the Motion),2 for authority to (i) maintain their existing bank accounts, and (ii) continue to use their existing business forms; and it appearing that no notice need be given other than to the United States Trustee and proposed counsel to the Official Committee of Unsecured Creditors (the Committee); and it further appearing that the request for relief, to the extent granted herein, is reasonable and proper; and sufficient cause appearing therefor, it is hereby ORDERED THAT: 1. 2. The Motion is granted to the extent set forth herein. CBI is authorized to continue to use and maintain the CBI Accounts as described

on Exhibit A annexed hereto with the same names and account numbers as existed immediately prior to the Petition Date.

The last four digits of The Christian Brothers Institutes employer identification number are 0153 and its mailing address is 21 Pryer Terrace, New Rochelle, New York 10804. The last four digits of The Christian Brothers of Ireland, Inc.s employer identification number are 0603 and its mailing address is 10001 S. Pulaski, Room 106, Chicago, IL 60655-3356. 2 Capitalized terms otherwise undefined herein shall have the meanings set forth in the Motion.

CBI is authorized to deposit funds in and withdraw funds from the CBI Accounts

by all usual means, including, but not limited to, checks, wire transfers, electronic funds transfers and other debits, and to otherwise treat the CBI Accounts for all purposes as debtor-inpossession accounts. 4. 5. CBI will designate the CBI Accounts as debtor-in-possession accounts. Nothing herein shall prevent CBI from opening new debtor-in-possession bank

accounts or closing any CBI Accounts, as they deem necessary and appropriate, in the ordinary course or other orders of the Court; provided, however, that notice of any new account openings shall be provided to the U.S. Trustee and proposed Committee counsel, along with documentation of the accounts. 6. depository. 7. CBOI is authorized to maintain only its operating account set forth on Exhibit CBOI shall open appropriate debtor-in-possession accounts at an approved

B to the Motion and shall maintain no more than $15,000 on deposit in said account and perform regular sweeps from said account to its new debtor-in-possession operating account. CBOI shall close all other accounts listed on Exhibit B to the Motion and separately account for any funds therein and separately preserve any funds therein that it reasonably believes are required to be separately preserved under applicable non-bankruptcy law. 8. CBI and CBOI are authorized to continue to use their existing correspondence and

other business forms. However, to the extent that CBI or CBOI issue purchase orders, such purchase orders shall reflect that CBI and CBOI, as the case may be, are debtors-in-possession.

CBI is authorized to continue to use its existing check stock; provided, however,

that as soon as practicable, it will manually imprint the legend debtor-in-possession on existing checks. 10. Nothing herein shall be construed as a finding of fact or conclusion of law that

any funds of the Debtors, including funds in the CBI Accounts, the CBOI Accounts described on Exhibit B to the Motion, or any debtor-in-possession account opened by the Debtors are restricted, designated, held in trust by the Debtors for any purpose, or otherwise are not property of the estate for payment of general unsecured claims.
