PROTECTED AREA NOTICE

I, Andrew P Zaloumis, in my capacity as Chief Executive Officer of the iSimangaliso Wetland
Park Authority and duly authorised in terms of section 13 of the World Heritage Convention
Act, 1999 (Act No. 49 of 1999) and in terms of Regulation 23 (2) of the Regulations
published in terms of the National Environmental Management: Protected Areas Act, 2003
(Act No. 57 of 2003) published in Government Notice 28181 in the Government Gazette on
28 October 2005 do hereby issue the following Protected Area Notice.

PROTECTED AREA NOTICE

1. EXCLUSION AREA FOR OFFSHORE SCUBA DIVING, SWIMMING AND

FISHING

1.1 Purpose of this Protected Area Notice

The Protected Area Notice issued concerns the prohibition of all offshore
diving, swimming and fishing in or about the artificial reefs at Cape Vidal
namely the DAR 1 and DAR 2 which are situated at:

LOCATION:
DAR 1:- Latitude (28º09.733’S) & Longitude (32º33.655E)
DAR 2:- Latitude (28º09.771’S) & Longitude (32º34.042’E)

WATER DEPTH: 37m and 25 m respectively

1.2 Exclusion

This Protected Area Notice does not-

(a) replace or limit any existing Protected Area Notice;

(b) apply to shore based angling and swimming.

(c) affect iSimangaliso Authority employees and its agent Ezemvelo KZN
Wildlife employees acting in the course and scope of their

 employment, duties and conservation management activities in the
Park.

(d) apply to special access permits issued by the iSimangaliso Authority.

1.3 Compliance with World Heritage Convention Act and other laws

This Protected Area Notice does not exempt a person from compliance with
any provision of the World Heritage Convention Act or the National
Environmental Management: Protected Areas Act unless stated otherwise or
any other applicable law, regulation, ordinance or bylaw.

1.4 Area of applicability

This Protected Area Notice is applicable to all off shore diving, swimming and
fishing within the area between the beacon XN (1km south of St Lucia Marine
Protected Area beacon N4) and beacon XS (situated 3km south of the St
Lucia Marine Protected Area beacon N4) extending out to sea by 1 nautical
mile.

1.5 Duration of Protected Area Notice

This Protected Area Notice will be valid from the date of publication of this
Protected Area Notice, unless-

(a) it is amended at any review period, which period shall be at intervals

of one year from the date of publication of this notice;

(b) it is replaced with another Protected Area Notice or legislation having

general application in relation to a specific activity or within a specific
area; or

(c) a license or agreement supersedes this Protected Area Notice.

1.6 Access to Exclusion Area

Access for special purposes as contemplated in 1.2(d) shall only be issued by

the iSimangaliso Wetland Park Authority for the following reasons:

(a) Approved research & management;

(b) Approved monitoring of the DAR1 and DAR2 and their surrounds;

(c) Permitted activities;

(d) Other reasons deemed appropriate/necessary by the iSimangaliso

Wetland Park Authority at the time of application.
