Abstract
According to Regulations EC1070/2009 amending EC 549/2004, EC 550/2004, EC 551/2004 & EC 552/2004 and EC216/2008 as amended by EC 1108/2009, EC 1034/2011, EC 1035/2011, NSAs need to organise proper inspections and surveys to verify compliance with the requirements of these Regulations, including human resources requirements for the provision of air navigation services. This process provides an overview of the requirements to be met by an Air Navigation Service Provider (ANSP) or an Operating Organisation in general, as well as the procedures, arrangements, principles, means and key processes to be followed by HANSA for the Oversight of ATM/ANS Personnel. The document outlines the main issues in initial and ongoing safety oversight of ATM/ANS Personnel.

1 1.1

INTRODUCTION Purpose

This procedure shall form the basis for the safety oversight of the ATM/ANS Personnel Air Traffic Controllers (ATCOs) and Engineering and Technical Personnel undertaking operational safety related tasks ,AIS Personnel, ASM/ATFM Personnel, AFIS Personnel, MET Personnel. The document concerns the requirements for the regulation of ATM/ANS Personnel for the designated authority (here HANSA) that performs the Human Resources Oversight function. HANSA performs 1 Human Resources Oversight of the ANSP or, if this were the case, for the Operating Organisation l. The document makes reference also to the requirements that individual ATM/ANS Personnel have to comply with. Note: for a definition of terms see 3.4 Terminology. Specifically, Regulation EC 1070/2009 amending Regulations EC No 549/2004, EC No 550/2004, EC 551/2004 and EC 552/2004, EC 216/2018 as amended by EC 1108/2009, EC 1035/2011, EC 805/2011 require NSAs to organise proper inspections and surveys to verify compliance with the requirements of the SES Regulation, including human resources requirements for the provision of air navigation services. In this respect this document outlines the requirements for human resources management from a safety regulatory perspective.

SCOPE

This document covers the requirements, procedures, arrangements, principles, means and key processes for the Safety Oversight of ATM/ANS Personnel and more general the human resources requirements, and the oversight activities that should be carried out by the designated respective department of the Hellenic Air Navigation Supervisory Authority. In doing so it makes reference to the requirements for the Operating Organisation (here the Hellenic Air Navigation Service Provider HANSP) and the requirements for individual staff.

The scope of this document is confined to the safety regulatory aspects a key element of the functional ATM system, i.e. the ATM/ANS Personnel and the way in which the competence and qualification of this Personnel is maintained and used. The requirements are outlined in the following chapter.

2.1

Safety Regulatory Requirements for ATM/ANS Personnel

EC Regulations 1035/2011, EC 216/2008 as amended by EC 1108/2009 and EC 805/2011 impose Requirements for the ATM/ANS Personnel, specifically EC 1035/2011 Annex I, General Requirements, 5. Human Resources. 5. HUMAN RESOURCES Air navigation service providers shall employ appropriately skilled personnel to ensure the provision of air navigation services in a safe, efficient, continuous and sustainable manner. In this context, they shall establish policies for the recruitment and training of personnel Annex II 3.1.2. Requirements for safety achievement (a) ensure that personnel are adequately trained and competent for the job they are required to do, in addition to being properly licensed if so required and satisfying applicable medical fitness requirements (competency 3.3. Safety requirements for engineering and technical personnel undertaking operational safety related tasks Providers of air traffic services shall ensure that technical and engineering personnel including personnel of subcontracted operating organisations who operate and maintain ATM equipment approved for their operational use have and maintain sufficient knowledge and understanding of the services they are supporting, of the actual and potential effects of their work on the safety of those services, and of the appropriate working limits to be applied. With regard to the personnel involved in safety-related tasks including personnel of subcontracted operating organisations, providers of air traffic services shall document the adequacy of the competence of the personnel; the rostering arrangements in place to ensure sufficient capacity and continuity of service; the personnel qualification schemes and policy, the personnel training policy, training plans and records as well as arrangements for the supervision of non-qualified personnel. They shall have procedures in place for cases where the physical or mental condition of the personnel is in doubt. Providers of air traffic services shall maintain a register of information on the numbers, status and deployment of the personnel involved in safety related tasks. That register shall: (a) identify the accountable managers for safety-related functions; (b) record the relevant qualifications of technical and operational personnel, against required skills and competence requirements; (c) specify the locations and duties to which technical and operational personnel are assigned, including any rostering methodology.

3 3.1

CONTEXT Mission Statement


The mission of the safety oversight of ATM/ANS Personnel is to verify that sufficient competent ATM/ANS personnel providing services to general air traffic is available to provide a safe service by: 1. Monitoring the provision of air navigation services; 2. Verifying that the applicable training, competence and human resources requirements and any arrangement needed to implement and maintain them are effectively met; 3. Including those stemming from planned changes to the provision of services.

3.2

Overall View

The objectives, rules, procedures and requirements contained in this document take into consideration the national legislation of Greece, the provisions of the ICAO Convention and the relevant Annexes to the Convention, the EU Single European Sky (SES) regulations and Common Requirements and other relevant EU legislation. The Hellenic Air Navigation Supervisory Authority (HANSA) is responsible for supervising the implementation of requirements applicable to the provision of ATM/ANS to general air traffic. The Human Resources & Financial Section of the HANSA reports to the Head of HANSA and is responsible for the financial and human resources oversight of ATM/ANS personnel of the ANSPs in cooperation with the Safety/Quality/Security (SQS) Section, according to the respective and appropriate national law and regulations, following this process. At present, the Air Navigation Service Providers in Greece are: The Air Navigation General Directorate, comprising the Hellenic Air Navigation Service Provider (HANSP), according to national Law 3913/2011 The Hellenic National Meteorological Service (HNMS) for ANS MET services The Civil Aviation Training Centre for Air Navigation Training

Responsibility The safety of the service is the prime responsibility of the service provider or operating organisation. In the human-centred system of ATM, the organisation and the humans are a major source of risk. Safety Management Systems (SMS) are needed and they aim to improve safety performance of the organisation through the reinforcement, control and supervision of safety related activities in normal situations, in situations of change and transition and in emergency situations.
Independent oversight comprises the approval and monitoring of safety standards and requirements in the functional system, which encompasses humans, procedures and systems and organisational environment. ICAO requires a safety programme aiming at enhancing the SMS framework. This procedure is applicable to the HANSA and the ANSPs under the remit of HANSA.

Air Navigation Services The requirements for the provision of ATM, applicable to the specific situation under consideration and established through the existing rulemaking framework, concerning, inter alia: a) Technical and operational competence and capability to provide ATM (especially maintenance of adequate technical and operational capacity and expertise); Set up and maintain an organisational structure and management personnel to support a safe, efficient and continuous service; Maintain systems and processes for safety and quality management; Employ and maintaine (i.e trough training and recruitment) appropriately skilled (and authorised) personnel to ensure a safe, effcient, continuous and sustainable service.

The NSA supervises the implementation of all requirements that are applicable to the provision of ATM services to General Air Traffic. Operating Organisation An organisation responsible for the provision of engineering and technical services supporting air traffic, communication, navigation or surveillance services. If the ANSP is the providing its own technical support it would be the Operating Organisation. If engineering and technical services would not be provided by the ANSP, the Operating Organisation would be a separate entity. The adoption, enactment and implementation of rules for the achievement of stated objectives by those to whom the regulatory process applies. A systematic and explicit approach defining the activities by which management is undertaken in an organisation in order to achieve acceptable or tolerable safety. A quantitative or qualitative statement that defines the maximum frequency or probability at which a hazard can be expected to occur. The function undertaken by a designated authority to verify that safety regulatory objectives and requirements are effectively met. A systematic and independent examination conducted by, or on behalf of, a National Supervisory Authority to verify written procedures and arrangements against required procedures and arrangements and / or actual; process and their results against written procedures and arrangements. This also includes verification of compliance with allocated objectives, mitigation measures and any other arrangements identified as a result of the procedures carried out by the ATM service provider (ANSP) respectively Operating Organisation. Verify products, services or specified parts of the ATM system against specifications required and previously published by the safety regulator. The formal stipulation by the regulator of a safety-related specification which, if complied with, will lead to acknowledgement of safety competence in that respect. A risk mitigation means, defined from the risk mitigation strategy that achieves a particular safety objective, including organisational, operational, procedural, functional, performance, and interoperability requirements or environment characteristics. A specific objective or measure, identified consistently with safety regulatory requirements, whose implementation is found necessary to ensure safety. The aggregation of airborne and ground-based constituents, as well as spacebased equipment that provides support for ATM services for all phases of flight. Confirmation through the provision of objective evidence that specified requirements have been fulfilled.

4 4.1

ATM/ANS PERSONNEL OVERSIGHT PROCEDURES Triggers

There is a need for continuous safety oversight within the ANSP. Designated authorities, ANSPs / operating organisations and individual personnel need to comply with the regulatory requirements for ATM/ANS Personnel in accordance with applicable Requirements. These Requirements are examined by HANSA either during the Initial or Ongoing Oversight.

4.2

General

This document is based on applicable Requirements for Human Resources and Competence of ATM/ANS personnel.

4.2.1

Safety Oversight Functions and Regulatory Context

The safety oversight of ATM/ANS Personnel is the responsibility of the designated authority (HANSA) and should be performed as: a. Initial safety oversight during the implementation state during which the ANSP (HANSP) demonstrates compliance with the requirements or have their compliance assessed by HANSA. b. Ongoing safety oversight for continued compliance assessment and the assessment of changes in the training and competence processes and procedures.

The major issue for safety oversight of ATM/ANS Personnel relates to training requirements and the procedures and processes for the assessment of competence of ATM/ANS Personnel. The ANSP is responsible for ensuring the competence of ts personnel and the correct assignment and supervision and for adequate staffing and rostering arrangements.

4.2.2

Scope and Arrangements for ATM/ANS Personnel Oversight

The safety regulator (here HANSA) will have to make provision for: 2 1. Issuing licenses (for ATCOs) 2. Approve competence assessors and examiners; 3. Assess (and approve) ANSP procedures for compliance with applicable Regulatory Requirements (or develop in a prescriptive way requirements to which the ANSP has to comply, HANSA relevant Processes and Procedures); 4. Audit or inspect ANSP units and ANS training centres for their compliance with (prescriptive) requirements or means of compliance; 5. Assess the management structure of the ANSP / operating organisation to determine that they can support the compliance with requirements. In regard to the requirement of a management structure supportive to compliance with ESARR 5 the ANSP/operating organisation has to define the responsibilities and accountabilities for the requirements. A flow chart of the management structure has to demonstrate how the accountability is assigned (flows) from the individual personnel conducting operational (safety related) tasks to higher management and ultimately to a single entity within the ANSP / operating organisation.

No requirement exists for a licensing of ATSEPs.

It is the responsibility of the ANSP/operating organisation to develop procedures that support and enable the organisation to meet the requirements and to demonstrate the compliance to the designated authority. The HANSA needs to have a management structure and adequate and appropriate staff competent to implement and maintain its safety oversight function and in particular for regulating the safety oversight of ATM/ANS personnel. The HANSA staff assigned to regulate competence of ATM/ANS personnel will need to be trained for their regulatory duties and need to maintain competent on an ongoing basis to remain current with the progress and means in all relevant aspects related to ATM/ANS Personnel: 1. Relevant International, European and national requirements for the regulation of ATM /ANS personnel; national and European legislation; 2. Responsibilities and accountabilities of those implementing Requirements relevant to Human Resources and Competence of ATM/ANS personnel; 3. Safety and Quality management (SMS/QMS); 4. Existing, recognised/accepted means of compliance regarding Human Resources and ATM/ANS competence requirements 5. Auditing/inspection techniques etc.

4.2.3 Key Processes Elements, Guidance Material in Safety Oversight of Human Resources & ATM/ANS Competence Requirements
Guidance Material is available, which can be used for the assessment of the ATM/ANS Personnel competence, ESARR 5 defines the roles of the ANSP, the designated authority (here: HANSA) and the individual personnel, but does not describe the regulatory arrangements / structures that should be in place to ensure that the requirements of ESARR 5 are effectively met and completely covered. The arrangements and the assignment of the responsibilities and accountabilities of the organisations must be established and clearly described and must be complete to cover all requirements. There must be no doubt as to which organisation is responsible for the tasks within the regulatory framework by which the State intends to comply with ESARR 5. The link to an existing Safety (and Quality) Management System (SMS/QMS): Some procedures that the ANSP has set up to comply with ESARR 5 requirements will be addressed in the SMS/QMS) such as training and competence of ATM /ANS personnel. Safety oversight for ATM/ANS staff should consider the following in the ANSP: 1. Management structure, processes and procedures that are established to meet requirements; 2. The processes and procedures themselves that are submitted for being assessed to be compliant with requirements; 3. The ANSPs internal systems, like internal auditing and SMS, and the quality control of the documentation that is provided to the HANSA; 4. Processes in place that aim to determine that a change is required and if a change is identified what process is established to manage changes. The key elements of the SMS to be considered during the safety oversight of ATM/ANS staff are: 1. Organisational structure (that is set up to comply with requirements); 2. Internal verification mechanism (internal monitoring; feedback mechanisms; training statistics / records; examination and competence assessment results etc); 3. Internal risk assessment and mitigation processes (risk follow up after training or changes have been made indicating that personnel training has not negatively impacted safety, that all relevant safety relevant elements in the change have been addressed etc.)

Activities Principles and Steps


Initial and on-going human resources oversight

Initial safety oversight of ATM personnel: Principles for the HANSA 1. Accept documented organisational arrangements proposed by ANSP after the ANSP has demonstrated compliance with requirements. 2. Verify, through audits and inspections effective implementation of the arrangements. 3. Identify and request corrective actions if required. 4. The HANSA should be responsible for the overall approval of the SMS. 5. Provide the detailed scope, duration and applicability (which area is affected) of approval and any restrictions to the operation that might apply. 6. NSAs should conduct the safety oversight successively (step-by-step) to ease implementation and provide early feedback. Ongoing safety oversight of ATM/ANS personnel: Principles for the HANSA 1. Conduct evaluation of organisational arrangements by (continuous) monitoring. 2. Prioritise organisational arrangements for audits and inspections as needed. 3. Use safety regulatory audits and inspections in a systematic way to verify compliance and verify that: written procedures are in place and satisfy compliance with required procedures; processes etc are conducted in accordance with procedures required; compliance with prescriptive parts of Regulatory Requirements for Human Resources & ATM/ANS Personel Competence. 4. Identify and propose / demand corrective actions if required and follow up on them. 5. Focus on safety critical aspects in the arrangement and processes in the ANSP/operating organisation by which the organisations aims to comply with requirements in particular in regard to the competence of ATM/ANS Personnel. 6. Make proposals for addressing further safety oversight actions to the appropriate point of responsibility within the ATM/ANS safety regulatory body.

4.3.2

Fundamentals in Safety Oversight of ATCOs and Engineering & Technical Personnel undertaking operational safety-related tasks

Safety oversight of Air Traffic Controllers (ATCOs) and Engineering & Technical Personnel shall in principle be carried out as initial safety oversight and on-going safety oversight in accordance with the procedures prescribed for the oversights. Where ANSPs have integrated their response to safety requirements related to Engineering and Technical Personnel into the SMS, the safety oversight of the personnel and the management of the personnel shall be part of the initial and on-going safety oversight of the SMSs. Where the response to safety requirements related to Engineering and Technical Personnel is not part of the SMS, the personnel and the management of personnel shall be directly subjected to initial and on-going safety oversight. Specifically, the HANSA SQS Section and the HANSA Human Resources Section shall: Provide adequate and appropriate safety oversight of ATCOs that provide ATS and the Engineering & Technical Personnel assigned by any Operating Organisation to undertake operational safety- related tasks; Provide adequate and appropriate safety oversight for the rest of the ATM/ANS staff such as AIS, AFIS, MET and ASM/ATFM staff Verify that, from a safety viewpoint, appropriate methods are in place to ensure that third party individuals and subcontracted organizations assigned to operational safety-related tasks meet the applicable provisions of EC 1035/2011 Annex II 3.3.

In the context of safety oversight of ATCOs and ATSEPs, the HANSA SQS and HR Sections shall consider that the nature of oversight of personnel contains different aspects than those from oversight of systems and equipment. In order to achieve maximum safety benefit from oversight of personnel it is necessary to create a positive understanding and atmosphere that enhances trustfulness and open communication of the personnel subjected to the oversight (creation of a supportive safety culture). In preparation for and execution of safety oversights, the HANSA SQS Section shall use processes, means and procedures that are transparent and understandable and to the extent possible developed in close cooperation with the service provider(s) and representatives of personnel without losing independence and effectiveness. The objective of this procedure is to assure that safety oversight of ATM/ANS is carried out in an effective and rational manner (i.e. logical, transparent, independent). The procedure applies to the HANSA SQS and HR Sections and the ANPS under the Remit of HANSA).

4.3.3

Fundamentals in ATM/ANS Personnel oversight operational aspects

Competence: Staff working on the technical and or procedural aspects of the system need to possess the capabilities that are required for the safe and efficient operation of the functional system. Main factors to assure competence are: 1. Recruitment and selection; 2. Instruction and formal training; 3. Competence assessment / assurance; 4. Development training (career development); 5. Train-the-trainer; 6. Training effectiveness; 7. Performance assessment etc. Procedures: Clear procedures need to be available that clearly and unambiguously describes the roles and responsibilities, structure and content in all appropriate detail what the human operator has to deliver and to whom (responsibility and accountability). ANSP/operating organisation that in preparation for safety oversight shall elaborate: 1. Lists of jobs considered to fall within the categories Engineering and Technical Personnel and Air Traffic Controller 2. Descriptions of jobs, including safety-related functions (including those in the area of training); 3. Descriptions of qualifications, including licenses and/or certificates, required for the jobs; 4. Descriptions of training required for the jobs; 5. Descriptions of training programmes, including contents and schedules; 6. Descriptions of requirements to and qualifications of instructors; 7. Description of management structure and managerial procedures, including accountability flow and flow of processes, to support compliance with applicable Regulatory Requirements; 8. Description of relationship with subcontractors, including training centres delivering services, including division of responsibilities for competency of personnel; 9. Description of manning/staffing procedures and rules during different times of operations; 10.Description of procedures to be followed in situations of change (especially transition periods) and in situations of emergency and or unusual situations. The documentation listed above shall be presented to the HANSA SQS and HR Sections and will be available to any other section of HANSA which has interest to examine in consultation with the Operating Organisation will consider the documentation for approval. The documentation will subsequently be used in the processes of safety oversight.

Ergonomics/Operating Environment: The requirements for a safe and efficient human operation and human machine interaction need to be met during all times of operations. Main factors are: 1. Human Machine Interface; 2. Human Performance; 3. Fatigue; 4. Work related stress. Work organisation: The organisation and management of the workforce and the allocation and distribution of human resources and available working time need to allow a safe and efficient operation and should be commensurate to the workload and operational and other requirements of the work. Main factors are 1. Daily / weekly working time; 2. Rest days and leave; 3. Breaks; 4. Workload; 5. Roster arrangements etc. Communication: Communication and interaction between staff and staff and management on all operational, safety related matters must be effective. The main issues are: 1. Language proficiency; 2. Briefing and handover; 3. Coordination; 4. Staff management interrelations; 5. Staff / team interrelations etc. Human Reliability: Sufficient capability (resources; competence) for avoiding and or mitigating human error and for recovery after unwanted situations or failures need to be available to ensure safe operation. Main aspects are: 1. Management and mitigation of human error; 2. Prevention, Detection and Recovery capability; 3. Redundancy requirements; 4. Human Automation and other Human Factor issues.
