I. Weaknesses of the Articles of Confederation Review the six purposes of our government, are those good purposes? Government Structure Lack of Executive power and leadership, Legislature only branch (Establish Justice: no judicial system) Congress settled disputes, but they also made the law Trouble enforcing laws No Executive to enforce and states serve as the army (Provide for the common defense) Can't maintain order, no enforcement of National laws (Ensure domestic tranquility) Secure the blessings of liberty Army's represent states, not America Unanimous vote needed to amend the articles, Inflexible (Secure the blessings of liberty: posterity will be different but same laws) Laws should be able to change with society. Ex. Civil Rights and African American Voting Amendments 11-27 No articles ever added to the Articles of Confederation Powers of Congress Make war and peace, treaties Send and receive ambassadors Borrow money, Monetary system No taxes (Promote the general welfare) How will it pay back debts? Build a navy, Ask states for troops for an army (Provide for the common defense) Settle state disputes State Obligations States responsible for enforcement of National law, dont like it, won't do it Responsible for their own enforcement of laws No army to force them to States did what they wanted (In order to form a more perfect union) Articles pledge states to provide funds and troops if needed Critical Period after Treaty of Paris, 1783 States bickered amongst each other Taxed each others goods and banned trade Printed own money II. Constitutional Convention Virginia and Maryland illegally met to resolve disputes Worked so well, decided to do it with all of the states in Philadelphia Constitutional Convention
