TERMS AND CONDITIONS FORMING PART OF THIS APPLICATION FOR ALLOTMENT OF A RESIDENTIAL APARTMENT IN BRIGADE ORCHARDS AT DEVANAHALLI, BANGALORE.

The broad terms and conditions for allotment of the residential Apartment (Residential Apartment) is as mentioned below:

1.

The Intending Allottee (Applicant) has applied for allotment of a Residential Apartment after reading and understanding the Terms and Conditions of this Application..

2.

The Applicant cannot claim any right or interest in the Residential Apartment by merely subscribing to the application for allotment. The allotment of the Residential Apartment is entirely at the discretion of the Company and Company may at its sole discretion decide not to allot any or all of the Residential Apartment and/or keep the project in abeyance. The Applicant shall enter into the definitive agreements with the Company within 60 days from the date of intimation of provisional allotment, or else the provisional allotment of the Residential Apartment stands cancelled without any further notice, unless the Company agrees at its sole discretion to extend the timeline for execution of the definitive agreements.

Withdrawal and/or cancellation of the Application by the Applicant for whatever reasons, after submission of the Application but before signing the Allotment letter, entitles the Company to forfeit a sum of Rs. 25,000/- (Rupees Twenty Five Thousand only) from the booking amount paid along with the application, and the balance sum if any will be refunded to the Applicant without any interest thereon. The Applicant has understood that the Brigade Orchards project will be developed in a phased manner and as such, all the amenities and facilities contemplated in the project may not be in place for use at the time of handing over of the Residential Apartment. The time for completion is restricted only to the Residential Apartment that is allotted to the Applicant and is not related in any way to completion of other developments in the project. However, the Residential Apartment will be completed in a habitable state with all essential amenities. The super built-up area of the Residential Apartment, its specifications, handing over date, rights and obligations of the purchaser etc., shall be more clearly defined in the definitive agreements.

The Applicant confirms and represents that he/she/they has made payment to the Company only towards the Residential Apartment and that he/she/they shall not have any claim of any kind whatsoever in any other development undertaken by the Company within the project.

The price list is subject to change from time to time at the sole discretion of the Company and the price as prevalent on the date of submitting the Application shall prevail. The price shall be confirmed by the Company when the provisional allotment letter is issued.

The sale consideration/construction cost is inclusive of: Finishes as specified the cost of providing electric wiring with necessary terminations; plumbing & sanitary piping and fixtures in the Residential Apartment; Power back up as specified for each Residential Apartment in addition to that for the common areas and services.

The sale consideration/construction cost excludes the cost of: Interest free maintenance security deposit; Corpus Fund; Stamp duty and registration charges payable on the agreement for sale, construction agreement and the sale deed to be executed in favour of the Applicant including any amount sought to be paid by the department of detection of undervaluation of stamps and registration and all other incidental expenses and legal consultants fee; Electric fittings, fixtures, geysers, electric and water meter etc., Service tax, VAT and other taxes (if any) payable pro-rata per Residential Apartment; Proportionate share of amounts payable to the concerned authorities/boards or otherwise for provision of permanent electricity connection, water and sewerage facilities and associated charges, cable charges, service charges and all other departmental expenses including self execution work expenses for sub-station, transformer/RMU installation, charges incidental to general power and lighting connections, telephone and broadband connections, etc; Cess, Cauvery water supply security deposit etc., whether levied or leviable now or in future, as the case may be, prior to the execution of the sale deed or thereafter; Assessment and Sub Numbering charges; Katha Transfer will have to be undertaken by the Allottee/Purchaser by themselves after the Sale Deed; All the above deposit, charges, fees, etc., shall have to be paid by the Applicant to the Company in the manner and at the time, as may be indicated by the Company in addition to the sale consideration/construction Cost, as will be specified in the price list to be furnished by the Company.

The Applicant cannot claim shifting of the bookings done unless the Company specifically agrees for the same and subject to such charges as may be leviable in this regard.

Car Parks: The Applicant agrees that he/she/they shall not be entitled to sell/deal with the car parking space (if any) independent of the Residential Apartment.

Alterations to the building plan: The Applicant has seen and accepted the plans, design and specifications and the Applicant authorizes the Company to effect suitable and necessary alterations/modifications in the layout plan/building plans, designs and specifications as the Company may deem fit or as directed by any competent authority/(ies), while at the same time ensuring that the Applicants interests are not compromised.

The Applicant agrees that, after the provisional or final allotment, if as a result of any legislation, order or rule or regulation made or issued by the Government or any other statutory authority or if competent authority/ies refuses, delays, withholds, denies the grant of necessary approvals for the Residential Apartment or due to any suit/writ before a competent court or due to force ma jeure conditions, the Company is unable to construct the Residential Apartment for the intending Applicant, the Company may shelve the project and refund the amounts received from the Applicant.

Owners association: The Applicant agrees to become the member of the owners association as and when it is formed. Club : The Company shall provide a residents club and the Membership of the Club will be compulsory for all the purchasers of Residential Apartments,. The Applicant shall become entitled to the membership only upon registration of the sale deed in his/her favour with respect to the Residential Apartment. The Applicants right to membership of the club will be extinguished if the Apartment booking is cancelled or transferred. The usage of the club and the facilities provided therein will be subject to the rules and regulations that will be framed from time to time.

Compliance: In case of Applicant being non-resident/foreign national of Indian origin/foreign nationals/foreign companies, he/she/they are required to comply with the provisions of Foreign Exchange Management Act, 1999 including circulars and statutory enactment or amendments thereof and the rules and regulations of the Reserve Bank of India in respect of all remittances, acquisition/transfer/refund/security of the residential unit by the allottee, and provide the Company with such permissions, approvals which would enable the Company to fulfill its obligations under this Application or the definitive agreements. The Applicant shall be fully responsible for any violation of FEMA Act & its regulations and shall keep the Company indemnified and harmless in this regard. The Company accepts no responsibility in this regard.

Any refund of money by the Company to the Applicant will be made by local cheque only. The courts at Bangalore/Devanahalli shall have the exclusive jurisdiction in all matters arising from this application regardless of the place of execution of this application.
