One application has been moved by one surety namely Prabhu Sharan RaiNayyar. Hehas statedthatheis the suretyofconvictSmt. ShashiMalhotra(7)andthathehadfurnishedoriginalFDRalongwithhis suretybonds. Itispreyedthatthesamemaybereleased. Sincethebail bondsandsuretybondsstandforfeited,theapplicationisallowed.

ORDERONSENTENCE 22.01.2013 Mostoftheconvictsareseniorcitizensandallofthemsuffer fromvariousailments.Someofthemareseriouslyill.Manyofthem have their spouses, children and parents, who suffer from interminable diseases. Some of the unfortunate convicts have the burdenofsupportingtheirminorgrandchildrenduetothedeathof theirsons. Afewofthemarephysicallychallenged. Manyofthese convictshavebeendesertedbytheirchildrenintheiroldage.Inthis background,thisjudgmentofconviction,itisargued, hasshattered thembeyondredemption. 2. Sh.S.K.Saxena,Adv.hasprayedferventlyforshowingleniency

in awarding sentence to Om Prakash Chautala due to his old age, physicalchallengeandvariousailments.ItisarguedthatOmPrakash Chautala,AjaySinghChautalaandSherSinghBadshamihaveheavily sufferedintermsoftheirpoliticalcareerbecauseaftertheregistration of this case, their party had lost the power and individually these convictshavelostelectionssuccessively.Itisfurtherarguedthateven this conviction is an enough punishment for them because it is difficultforthemtoshowfacetothesociety. 3. Ld.Counselsforconvictshavesubmittedtheirmedicalrecords andthemedicalrecordsoftheirfamilymembersinsupportoftheir submissions.Ifindnoreasonnottobelievetheaforesaidsubmissions ofLd.Counselsforconvicts.However,theseaspectsarenotrelevant tothequestionofthequantumofsentence. Therelevantpointsfor consideringthesentencearethecircumstancesattendingtheoffence. 4. Theenormityoftheoffencesunderconsiderationtodaycanbe appreciatedfromthefactsthattheconspiracyinquestiontookinits sweepalmostallthedistrictsofStateofHaryana. Asmanyas57 Chairpersons/membersof18DistrictLevelSelectionCommitteeswere made to create forged award lists in which the interview marks of about8,000candidateswerechanged.Ihavealreadydiscussedinthe mainjudgmentthattheforgingofawardlistsamountedtoforgingof 'valuablesecurities'punishableundersection467IPCwhichprovides sentenceuptolifeimprisonment. Thegravityoftheoffencesfurther

enhancesinviewofthereasonthatthebrazennesswithwhichthe sacrosanct constitutional guarantee of equal opportunity in the matters of public employment to each citizen of India has been violated. In AIR 1978 Supreme Court 1548, the full Bench of SupremeCourthadseverelycastigatedthelenientviewtakenbythe SessionsCourtinsentencingaconvictinsuchoffencesandobserved asunder:
7. Social defence is the criminological foundation of punishment. The trial judge has confused between correctional approach to prison treatment and nominal punishment verging on decriminalization of serious social offences. The first is basic, the secondpathetic.ThatCourtwhichignoresthegraveinjurytosociety implicitineconomiccrimesbytheupperberth'mafia'illservessocial justice.Softsentencingjusticeisgrossinjusticewheremanyinnocents arethepotentialvictims.Itisaltogetheradifferentthingtoinsiston therapeutic treatment, hospital setting and correctional goals inside theprison(evenpunctuatedbyparole,opportunitiesforwelfarework, meditational normalization and healthy selfexpression), so that the convict may be humanised and, on release, rehabilitated as a safe citizen. This court has explained the correctional strategy of punishment in Giasuddin's case (1978) 1 SCR 153: (AIR 1977 SC 1926). Coddling is not correctional, any more than torture is deterrent. While iatrogenic prison terms are bad because they dehumanize,itisfunctionalfailureandjudicialpathologytoholdout a benignly selfdefeating nonsentence to deviants who endanger the moralsandmorale,thehealthandwealthofsociety. 5.

Therefore, considering the enormity of the offences and the

mannerinwhichpoliticianbureaucratnexushasresultedindepriving suchalargenumberofcandidatesoftheirconstitutionalrights,Ido not find any reason for leniency in sentencing those convicts who

were masterminding the entire conspiracy or assisting them in executionofthesame. 6. IthasbeenarguedonbehalfofconvictVidyaDharthathedid nottookanybenefitfromtheseoffencesandevenhisownrelatives couldnotbeselectedandthathehadnotspokenawordinanyofthe meetings. Hence, it is prayedthat a lenient view should be taken whilesentencinghim. Idisagreewithhissubmissions. Thosewho hostalunchwillhavetopaythebill,eveniftheythemselvesareon fast.Needlesstosaythattheyalsoserve,whostandandwaitsilently. 7. IthasbeenarguedonbehalfofconvictM.L.Kalra,DurgaDutt Pradhan,BaniSingh,Smt.DayaSainiandRamSinghthattheirroleis onlyinrespectoftheirrespectivedistricts,and,therefore,theycannot becomparedwiththosewhoplannedtheconspiracy.Idisagreewith thissubmission. Ifyouhavejumpedinacesspool,youareinit. It doesnotmatterwhetheryouareinthecenterofitorinthecornerof it. Hence, your culpability and liability is same as the main conspirators.Itislikeapersonplanningaterroristactandtheperson executing it. Both deserves same sentence. Hence, I find no substanceforadoptinganylenientapproachtowardstheseconvicts. Convict Pushkar Mal Verma and Durga Dutt Pradhan had maintainedthattheyhadneverpreparedtheawardlists,but,today theyhavecomewiththewrittensubmissionsastohowtheincident took place. In the written submission, Durga Dutt Pradhan has

admittedhissignaturesonthelistsbutstatedthattheinterviewmarks were filled later on. He has not pleaded any pressure upon him. Hence,hiscasehastobeconsideredalongwiththeconvictsnamely M.L.Kalraetc. SofarasPushkarMalVermaisconcerned,hehas written as to how the entire incident took place and how he was under pressure. Though, this submission has come at a very late stage,but,betterlatethannever. 8. However, what troubled me was to decide the question of sentencingSanjivKumar. Ihaveheldhimtobea'whistleblower'. Thereisnolawatpresenttoprotectthewhistleblowers.HadSanjiv KumarnottakenasteptoapproachtheSupremeCourtofIndiaand hadhenotproducedthesecondsetofawardlists,thisscamwould nothavecometolight.Thedilemmabeforethiscourtindecidingthe question of sentence is on account of the simple reason that sentencingsuchapersonmaysendamessagethatawhistlebloweris notappreciatedbylaw,rather,heisputtotrialandtribulation. 9.

Inabsenceofanylawfortheprotectionofthewhistleblowers,I

officerandduringtrialhe must testify on oath at the stage of defence evidenceandshoulddisclose thetruthbeforethecourtduring trial. Thetrialcourt,insuchevent,must certifyinitsjudgmentaboutthefact outwithtruthandhasnotconcealed 5. the

Onsuchcertificationinthejudgment,thecourtcanproceedtoaward minimumpossiblesentencetosuchconvictandifpossible,may probationwithrecommendationtothegovernmentthat actionshouldbeinitiatedagainsthiminviewofthesaid

Now,letmeseeastowhetherSanjivKumarhaddisclosedthe

completetruthbeforethiscourt.Ihavealreadystatedthathisentire effortinthetrialwastoshowasifhehadnothingtodowiththe entire offence. His standas towhichwas the true award listwas foundtobefalse.Hekeptonsayingthathehadpreventedthescam bynotimplementingthefakelists.Theprosecutionevidenceonthe other hand has proved beyond reasonable doubt that he was fully involvedinthescamandhadactuallyimplementedtheforgedaward lists.Oneofthedefencewitnessesexaminedbyhimwasfoundtobe untrustworthy. HetookawrongstandbeforetheSupremeCourtof

Indiainrespectofthefakenessorgenuinenessoftheawardlists.He maintainedthesamestandbeforetheinvestigatingofficerandstuck tohisgunstothelastevenduringtrial. Evenif,SanjivKumarhad takenatruthfulstand,atleastatthestageoffinalargumentsinview oftheoverwhelmingevidenceforthcomingbeforethiscourt,hiscase wouldhavebeentakenentirelyonadifferentfootingthantheother convicts. Butinviewofhisconsistentfalsestandinrespectofthe genuinenessandfakenessoftheawardlists,Ihavenooptionbutto treat him on parity with those convicts who were overseeing the executionoftheentireconspiracy. 11. However,Iagreethattheconvictswhohadactedundersevere pressuremustbetreatedleniently. Theseconvictshadbeentruthful duringthetrial.Theywereawarethattheyhadcommittedaserious mistake in their life, but, their conscience did not permit them to speak falsehood before the court. Their moral values shone like a guidinglampforthem.Duringtheentiretrial,theyweretruthfuland courageousdespitethefactthattheyknewthatbybeingtruthful,they wereinvitingtheirconvictionwhichmayentailalongjailterm. I refertothestatementu/s313CrPCofPremBahal,R.S.Dahiyaetc. andthedefenceevidencesofSherSinghandD.D.Verma.Theyhad committed an offence once, but soon the repentance was in their hearts.TheyfullycooperatedCBIduringinvestigation.Theycameup truthfully before this court. A few hesitant convicts soon followed

them. aninquiryandtoidentifythoseofficerswho hadindulged in such activities and if sufficient material is found, departmental action shouldberecommendedagainstthoseofficers. 17. I may point out that Sanjiv Kumar in his Writ Petition no. 93/2003 had specifically mentioned that the same scam had taken placeintheselectionsoftheteachersundertheDirectorateSecondary Educationduringthesametime. Someevidencetothateffecthas beenledduringtrialwhichindicatesthepossibilityofsuchascam. One award list Ext.PW24/L has been shown to this court which reflectsthesamepatternofmarksasavailableintheDirectoratelists. TheCBIshouldnotcloseitseyesonthisaspectonthegroundthatthe secondsetofawardlistsisnotavailable.Imaypointoutthatevenin JBT scam, the original award lists of some of the districts are not available, but, this court has held the Directorate Lists of those districtstobefakeonthebasisofthemarkingpattern.Therefore,I recommend that CBI should start investigation u/s 173(8) CrPC in respectoftheselectionsofteachersunderDirectorateofSecondary Education which happened during the same time, of course, after fulfillingthenecessaryrequirements.
