Bismillaahir-Rahmaanirraheem (In the name of Allah, the most Compassionate, the most Merciful)

Translation: and it is not for the believers to go forth [to battle] all at once. For there should be separate from every division of them a group [remaining] to obtain understanding in the religion and warn their people when they return to them so that they might be cautious (Surah Taubah, Chapter-9, Ayat# 122) BROCHURE For INTRODUCTORY COURSE OF HADITH AND ISLAMIC JURISPRUDENCE (FIQH)
Compiled by MUFTI MOHAMMED SHAFIQ AHMED QASIMI Published by MARKAZUL HADEESI WAL FIQHUL ISLAMI (CENTER FOR HADEES & ISLAMIC FIQH), BANGALORE

Origin of Religion (Deen) and Shariyah All the rulings of Religion and Shariyah are proved based on the four sources (Dalail). And out of these four sources two are fundamental, firstly holy Quran and secondly Hadith i.e. narrations of Prophet Muhammad (Swallallahu Alaihi Wa sallam), then these two form the proof of the remaining two. Therefore some rulings have been clearly explained in the Book of Allah (Quran) however it is very difficult and cumbersome to explain every ruling. Hence in case of other rulings certain basics (Zawabit) and principles are explained in the light of which all the other remaining rules have been derived First among those principles is: Next to the Book of Allah (Quran) is the Hadith of the Messenger of Allah (Swallallahu Alaihi Wa sallam), because Allah taala sent His beloved Messenger, Muhammad (Swallallahu Alaihi Wa sallam) to clarify and explain the teachings of His Book (Quran). All those explained and taught from Book of Allah (Quran) by Muhammad (Swallallahu Alaihi Wa sallam) is known as Hadith, therefore Allah says in holy Quran; Translation: and We revealed to you this note of advice (Quran) so that you may make clear to the people what was (the guidance) sent down (through you) to them and so that they might give a thought (in this). (Surah Al-Nahl, Chapter-16, Ayat# 44).From the above mentioned verse of Quran it is proved that the explanation of holy Quran done by Prophet Muhammad (Swallallahu Alaihi Wa sallam) is the only one which is authentic and acceptable. Also that the understanding of the Words of Allah depends only on the explanation and details provided by Prophet Muhammad (Swallallahu Alaihi Wa sallam). Not everyone has the right to explain the Quran on the basis of his own understanding. The sayings, the actions and the silence (Sukoot) of Muhammad (Swallallahu Alaihi Wa sallam) are all the Tafseer of the holy Quran, because every saying, act and silence (Sukoot) of Muhammad (Swallallahu Alaihi Wa sallam) were the orders either thru Quran Or thru Wahi-EIlahi (revelations from Allah) which were not included in the Quran. Or is thru such a research (Ijtihaad) about which principles and fundamentals (Usool wa Kulliyaat) have been sent down from the Allah. And then this research (Ijtihaad) has been confirmed or has been rectified by Allah. Second and third principle: And for the issues and rulings that cannot be found clearly in the holy Quran and in the sacred Hadith, for such issues and rulings the unanimity of Sahaba (Ridwanullahi taala alaihim ajmaeen) have been established. And also the unanimity of the scholars among the Ummah of successive generations are continuously being established. On the different occasion this unanimity of scholars has been declared as authentic (durust) and accepted as proof of action on Shariyah (hujjat) by holy Quran. And the path going against this has been told as the way leading to Jahannam (hell). It is evident that until the Day of Judgment, different new circumstances and issues will keep emerging about which no clear ruling of Shariyah is found in Quran or Hadith. Sometimes rulings are mentioned but seem (not actually) to have contradictions among the related verses (Ayaat) of Quran and among the narrations of hadith. And some rulings do have been mentioned in the Quran and Sunnah but chances are there that they can have multiple interpretations, hence in the process of determining the accurate interpretation as desired by Quran

and Sunnah, there exists difference of opinions among the Sahaba (Ridwanullahi taala alaihim Ajmaeen) and Tabaeen (Rahimahumullaah). It is apparent that such type of issues and rulings can be solved based on deep knowledge of the first two principles which are Quran and Sunnah (Nusoos) only, for this purpose the option of deep study (Ijtihaad) has been kept open. The same thing has been indicated in sacred verse of Quran So that they (the people for whom this Quran has been sent down to) might give a deep thought (in this) and so that the rulings of Shariyah for their issues can be made known. Refutation of Taqleed and Fiqh (Jurisprudence) is a Trial (Fitnah) From the above mentioned paragraph it has been clarified that determination of the rulings of Shariyah is based upon the four sources (Dalail). Hence the Aimma-E-Mujtahideen (four Imams) have made it easier for the sake of Ummah by extracting solutions for the countless issues belonging to every aspect of life and determined rulings by means of their extensive research based on the four sources (Dalail), indeed this has been of great services by them. In this matter Taqleed and following of four Imams is the source of security and prosperity for Ummah. But some people who are short sighted pessimists, being stubborn insist say that they can understand all the rulings of religion (Deen) only thru two sources (Dalail) meaning Book of Allah and Hadith of Messenger of Allah (Swallallahu Alaihi Wa sallam). And claim that Taqleed is shirk, there is nothing like Fiqh and that we should not follow Imams etc. The idea behind this is that these people want Ummah altogether deviate from these four Imams by leaving their Taqleed and being obedient of the Imams. Dont those people realize the result of this? It is apparent that in the matter of religion and Shariyah if a person doesnt have confidence and trust upon the scholars and makes himself free from following and being obedient of such scholars who by the mercy of Allah have reached to a special position and status of guidance (Hidayah) and knowledge, then such person will land himself into the valley of misguidance. This is a dangerous big trial (Fitnah) and a very deeply planned conspiracy by enemies of Islam. Hence to understand and defeat this conspiracy and to save Muslim Ummah from the custody of such rivals is necessary and inevitable upon us. A Muslim neither he cheats nor he get cheated. Background of the Course of Hadith and Fiqh (Islamic jurisprudence) Those who reject Taqleed and Fiqh have made certain points as their topics of debate among people which has the following prominent features:- (1)Taqleed of Imams is not right, (2)Quran and Hadith are sufficient there is no need of Fiqh, (3)Will practice Deen based on self understanding by using transliteration of Quran and Hadith, and there is no need of any Faqih and scholars, (4)Contradicting rulings like raising hands (raful yadain) in the salah, saying Ameen loudly, placing hands on the chest, stretching legs while standing, without reason offering salah with head uncapped, offering salah in semi naked or bizarre clothing, reciting Quran behind Imam, considering triple talaq as one, not believing in Eesal-E-Thawab(sending reward to decedents), handshake(Musafaha) with one hand..Etc These are the issues being made popular and based on this, difference (inteshaar) and trials (fitnah) are created between the people. They have no interest in other subjects and topics; while there have been differences between the followers of all the four Imams, in spite of that till date never was there any conflict or mutual degradation and neither did not declare each other as non-believer (Kaafir) or dwellers of hell (Jahannami). But sadly these people falsely claim and do propaganda that they are the followers of Quran and Saheeh Hadith and that we followers of Imams (Muqallideen) do against it, while the fact is the other way around. And besides them, abusing all the four Imams, other scholars and pious people (saliheen), proving them wrong, degrading them and declaring them as dwellers of hell (Jahannami) has become the beloved business of their life, as if they are the ones calibrated (Misdaaq) by the following verse of Quran: Translation: Then is one to whom the evil of his deed has been made attractive so he considers it good [like one rightly guided] and the one who reckons evil deed as evil, can they both be equal? (Surah Faatir, Chapter-35, Ayat# 08)

Never! However, this is their deed and they will answer in the presence of Allah Taala on the Day of Judgment. The need to worry aroused much not only because they did not felt it enough on being misguided but they are wasting their lives trying to trap the entire Ummah in their dirty ambitions. It is more to be afraid of and restlessness that they are busy in taking the innocent people away from the righteous path, who with their great efforts being on the straight path want to spend their life on the Sunnah and Shariyah and in the religious work, minds of such people are being corrupted by spreading things which are very far from the reality. They get their work done by deceiving the people and most often the educated religious youth are targeted. The actual reason people are easily trapped in their words is that people dont have answer for any of their points. At the least people cant even defend themselves, let alone that the people can explain and try to bring them back on straight path. Therefore the need was realized that our brethren who are working hard for the sake of religion and the gentlemen educated in the convent system, to provide them with the fundamental knowledge, specially the knowledge of Hadith and Fiqh, so that these people be rest assured by knowing that the ideology we are following is more close to the Quran and Hadith. And to know that the scholars of whom we do Taqleed are highly knowledgeable than us and they had the better understanding of religion (Deen), there is no other choice but to have faith in them and in that is the security and good for us. Also will come to know that in the name of Saheeh Hadith and Weak (zaeef) Hadith some people are cheating us, it is required to be alert and save Ummah from this.
