What is this promotion about? The aim of the promotion is to allow customers to collect all the letters in the word SMILE for a chance to win a weekly prize as well as be entered into a grand draw Prepaid & Postpaid customers who are purchasing a 4G handset with a 4G plan will also be entered into the weekly and grand prize draws respectively. Postpaid customers would be entered into the grand and weekly draw once they have paid their bill th on time starting from Oct 15 invoices. Each $50 worth of their full bill payment gives a customer one entry into the prize draws (see below) ( E.G. $100 PAYMENT = 2 CHANCES) How it works For every cumulative top up of $50 daily , each prepaid sub would receive 3 letters from the word SMILE Letters would be issued within 30 mins of topping up once the $50 criteria is met What do I win? TERMS & CONDITIONS: 1. Both Digicel prepaid and postpaid customers can participate in Digicels Christmas Smile promotion ( the Promotion) to win one (1) of five (5) grand prizes (Grand Prizes) or one (1) of six (6) weekly prizes ( Weekly Prizes) between 2nd November, 2012 and 26th December, 2012 (the Promotion Period) as follows : Grand Prizes: i) First Prize: Five Hundred Thousand Dollars ($500,000.00) in cash. ii) Second Prize: Two Hundred Fifty Thousand Dollars ($250,000.00) in cash. iii) Third Prize: One Hundred Thousand Dollars ($100,000.00) in cash. iv) Fourth Prize: Seventy Five Thousand Dollars ($75,000.00) v) Fifth Prize: Seventy Five Thousand Dollars ($75,000.00) Weekly Prizes: i) A Weekly Prize of Ten Thousand Trinidad and Tobago Dollars ($10,000.00) in cash and a Smart Phone, the type and value of which shall be at Digicels sole discretion. A total of six (6) Weekly Prizes will be awarded over the Promotion Period. PRIZE(S) 2. Prepaid Customers who top up with a cumulative of $50.00 daily would receive three (3) letters from the word SMILE via text/sms message to their Digicel handset. The customers who have collected all the letters in the word SMILE during the Promotion Period will earn one (1) entry in the drawing to win a Weekly Prize or Grand Prize (collectively referred to as a Prize(s)). 3. Postpaid customers earn one (1) entry in the drawing to win a Prize(s) for every $50.00 paid towards their bill, subject to their bill being paid in full (including all arrears and other outstanding amounts) and on time during the Promotion Period. 4. Customers that purchase a 4G handset along with a 4G Data plan during the Promotion Period will earn one (1) entry in the drawing to win a Prize(s). 5. The winners of the Weekly Prizes will be randomly chosen from all the qualifying entries for both Digicel postpaid and prepaid customers. The draws for each of the Weekly Prizes will take place on the following dates during the Promotion Period: 5. 16 , 23 , 30 November, 7 , 14 , 21 December, 2012. 6. The winners of the Grand Prizes will be randomly chosen from all the qualifying entries for both Digicel th postpaid and prepaid customers. The drawing of the Grand Prizes will be held on 26 December, 2012 and will be supervised by independent auditors Price Waterhouse Coopers including the selection of the winning mobile numbers and the placing of the calls to the Winners.

7. After a winning Digicel mobile number is randomly chosen, Digicel will place a call to the selected number. Digicel will only make one (1) attempt to call the selected number. If no one answers that call, then another number will be selected. 8. The person identified as the owner of the mobile telephone (by answering the call) shall be deemed the winner (the Winner). If in Digicels sole opinion the information given when Digicel placed the call to identify the Winner turn outs to be false, then Digicel reserves the right to have the award returned to it by the purported owner and then to give the award to the rightful owner of the mobile telephone associated with the winning mobile number selected. 9. Digicels decision as to the Winners shall be final. 10. Customers are entitled to as many entries as they qualify for during the Promotion Period, based on the Terms and Conditions herein. 11. Bonus or free credits do not apply to the cumulative Top Up of $50 which is required for entry into the Promotion. CONDITIONS OF ENTRY 12. To enter and be eligible to win a Prize(s): You must be a legal resident of Trinidad & Tobago You must be 18 years of age or older You must own a Digicel prepaid or postpaid mobile telephone on which you can be contacted 13. Persons in any of the following categories are NOT eligible to participate or win a Prize(s): Digicel Business account holders; Any person who at any time on or after 2 November, 2012 was or is a director, officer, employee, agent of Digicel (Trinidad & Tobago) Limited or any of their respective parent, subsidiary, or other affiliated companies, franchisees or service agencies or independent contractors; Individuals engaged in the development, production, advertising or distribution of materials for the Promotion (collectively the Promotional Entities); and Persons who are or purport to be immediate family members (defined as biological parent, stepmother, step-father, sister, brother, daughter, son or dependent or spouse of any of the foregoing) of any person in any of the preceding categories, regardless of where they live, or who reside in the same household as any person in any of the preceding categories (i.e., who have nd lived in the same household for at least three (3) of the twelve (12) months preceding 2 November, 2012 whether those persons are related or not). 14. Participants acknowledge that compliance with these Terms and Conditions including all eligibility requirements is a necessary pre-condition to a Prize(s) being awarded to them. For removal of all doubt, participants who have not complied with these Terms and Conditions are subject to disqualification. 15. Winners may be required to provide Digicel with proof that he/she is the authorized account holder/owner of the mobile number associated with the selected winning entry before a Prize(s) is given to him/her.

16. Disputes regarding top-up entries: In the event of a dispute as to who topped-up the mobile telephone, the entry will be deemed to have been submitted by the authorized account holder of the mobile phone number that was topped-up. Authorized account holder is defined as the natural person who is assigned to a mobile phone account by the wireless provider, telecommunications carrier or other organization responsible for assigning mobile phone numbers for the submitted mobile number. 17. Digicel reserves the right in its sole discretion to cancel, modify or suspend this Promotion at any time, if fraud, technical failures, including any network server or hardware failure, viruses, bugs, errors in programming, or any other errors or other causes beyond the control of Digicel corrupt the administration, security, integrity or proper conduct of the Promotion. 18. Digicel does not warrant that access to or use of the Digicel service will be uninterrupted or free of any of the events stated below, due to the nature of computer and wireless communications. Digicel and the Promotional Entities are not responsible for any problems that may arise, including but not limited to: lost, interrupted, inaccessible or unavailable networks, or other connection, availability or accessibility problems arising in connection with or over the course of the Promotion; or communications failed, jumbled, scrambled, delayed, or misdirected computer, telephone or cable transmissions or hardware or software malfunctions, failures or difficulties; or failure of personal computers and/or software and hardware configurations, any technical malfunctions, failures, or difficulties, printing errors, clerical, typographical or other error, offering or announcement of a Prize(s) or in a Prize(s) notification documents; or for any errors of any kind in connection with the Promotion, whether human, mechanical, clerical, electronic, or technical in nature; or the incorrect or inaccurate capture of information, or the failure to capture any information in connection with the Promotion. 19. Any attempt by an entrant or other individual to deliberately undermine the legitimate operation of this Promotion, including but not limited to any fraudulent claims, may be a violation of criminal and/or civil laws in the countries where the Promotion is being run. Should such an attempt be made, Digicel reserves the right to seek remedies and damages from any such individual, to the fullest extent permitted by law, including criminal prosecution. 20. Participants engaging in any of the foregoing activities in (19) above may be disqualified and shall forfeit the Prize(s) won. 21. In the event that analysis reveals more than five (5) Grand Prize Winners or six (6) Weekly Prize Winners, there will be a random drawing amongst all eligible claimants to award the Prize(s). In no event shall Digicel be liable for more than the relevant Weekly Prizes or Grand Prizes available under these Terms and Conditions. 22. In the event of any conflict with any promotional details contained in these Terms and Conditions and promotional details contained in point of sale, television and print, advertising, promotional packaging and other promotional media, (Promotional Materials) the details of the promotion set forth in these Terms and Conditions shall prevail. 23. The invalidity or unenforceability of any provision of these Terms and Conditions shall not affect the validity or enforceability of any other provision. In the event that any provision is determined to be invalid or otherwise unenforceable or illegal, these Terms and Conditions shall otherwise remain in effect and shall

be construed in accordance with their terms as if the invalid or illegal provision were not contained herein. Digicel employees are not authorized to waive, modify or amend any provision or provisions of these Terms and Conditions in any manner whatsoever. 24. All entrants agree to take part in any promotional, marketing or publicity activities or events reasonably requested by Digicel and consent to the use and disclosure by Digicel in any form of media of their names, likenesses and/or general areas of residence without compensation or further reference.
