The district confirmed that this had occurred and determined that the teacher had done so in response to insistence and because of her understanding that this instructional strategy was encouraged by both the principal and the teachers campus instructional team. TEA believes that this contrived technique results in students being done a great disservice by their teachers.
This test-preparation strategy, when employed at this crucial elementary-level checkpoint, is a misguided practice.
Thank you for your districts report regarding a possible testing irregularity that occurred during state-mandated testing. The security task force has reviewed this documentation and has recommended that no further action be taken by the Student Assessment Division.

The following incident was reported to the Texas Education Agency (TEA) and required corrective action to be taken at the local level:
Incident ID: 110425160 Campus: Boles Junior High Persons Responsible: Matthew Franks, Lisa Hurley, Fernando Benavides Administration Month: April Year: 2011 Grade: Test: TAKS (Acc) Subject: Reading Incident Description: Campus testing coordinator Matthew Franks inappropriately directed test administrator Lisa Hurley to help him erase responses recorded on students answer documents during the 2011 grade TAKS reading test after learning that the students had received test booklets. According to a district investigation, Ms. Hurley realized the students had been given test booklets after the first of the answer documents had been collected. Mr. Franks did not notify or seek guidance from the district testing coordinator once he learned of the incident. Instead, the investigation showed that he enlisted Ms. Hurley to assist him in erasing the students answers so that the answer documents could be reused with test booklets. When Principal Fernando Benavides was eventually contacted about the incident, the district report indicates that he instructed the students to re-bubble the answer documents as they had originally been filled out, further compromising the materials. The documentation indicates that Mr. Franks, who admitted to the tampering, was reprimanded and the tests submitted for scoring. Test administration manuals state that when a students answer document becomes unusable, test administrators must obtain a replacement answer document and transcribe the contents of the original onto the new answer document. Mr. Frankss actions went beyond the scope of procedures governing this test administration and could have compromised the integrity of the assessment and resulted in the invalidation of students tests.
Test administration manuals clearly define the responsibilities of all testing personnel before, during, and after test administrations, and by signing an Oath of Test Security, individuals acknowledge that they will comply with all the requirements of the testing program.

Violations of this nature and severity could result in a referral to the Division of Educator Standards and Certification for consideration of enforcement actions. However, the Student Assessment Division security team has reviewed the documentation provided and is recommending that no further action be taken. Please make certain that all future district and campus training includes comprehensive instruction on proper test administration and the handling of test materials. Districts are required to administer all assessments in strict accordance with prescribed procedures. TEA contacted the Dallas ISD district testing coordinator and requested her to investigate the incident and submit her findings to TEA. To date, no report, no statements, and no district determination have been received by TEA. In the absence of this information, TEA cannot determine whether or the extent to which any testing irregularities occurred.

The district reported to TEA that the Evaluation and Accountability Department had identified, through anomalies studies conducted after test results were received, that this classroom had shown unusually high test score gains and merited further investigation. To support the districts investigation, TEAs test security staff noted - through a visual inspection of these students test materials - evidence supporting that they may have been assisted. TEA sought further information and documentation from Dallas ISD on several occasions, but efforts to secure the districts cooperation were not successful. Due to non-responsiveness on the districts part, TEA is unable to make a final determination concerning the severity of this allegation. Through a review of the documentation submitted, TEA test security staff did determine that campus testing coordinator Beverly Lockridge improperly trained test administrators to write students names on their test booklets and test booklet numbers on their answer documents. Ms. Lockridge further directed test administrators not to read aloud the section of the required, scripted directions that instruct examinees to perform those tasks. TEA does not discourage districts from implementing local measures designed to reduce or eliminate errors; however, consideration must be given to whether any of these measures contradict existing test procedures. All tests must be administered in strict accordance with the instructions contained in the test administrator manuals, and no individual may change, alter, or modify scripted test directions.

She wrote the items on the board and engaged these classes in conversation about the assessment in a post-test review, solving the test items and asking the students to approximate their scores. In her statement, Ms. Davis confirmed the discussion of at least 40 confidential test items but asserted that she was unaware that she was not permitted to discuss the assessment once the test session had been completed. She further declared that she had failed to thoroughly read her manual and stated that both her teachers assistant and a special education teacher were present during the discussions, yet neither individual expressed concern about or attempted to intervene in the activity. The district report did not include statements from these individuals. Test administration manuals clearly define the responsibilities of all testing personnel before, during, and after test administrations. Ms. Davis affirmed when she signed the Oath of Test Security that she had undergone training and had read, understood, and complied with the procedures governing this assessment. The contents of secure test booklets and student responses are considered secure materials at all times. Test administration procedures do not permit test administrators to take notes on secure test items during a state-mandated assessment or discuss this confidential test content at any time; doing so can compromise the validity of the test administration and the students scores. Ms. Davis admitted actions gave her access to confidential test content, including possible field-test items that might appear on future versions of the assessment, and were clearly prohibited.

Specifically, had reported to CTC Mayo and DTC Reed belief that the scores noted on Confidential Score Report were not accurate or reflective of abilities and may have been falsified or inflated. further reported that had requested but had not been provided by teacher/TAKSAlt test administrator, Connie Gibbs Toczik, the official documentation forms supporting the high observation scores in mathematics and reading that are required to be maintained by the campus. In November 2011, Karen Byers submitted an online incident report form to TEA related to this matter, but it did not include the required statements from the individuals involved or a determination regarding the validity of the TAKSAlt results attributed to The description in the report indicated only that Ms. Mayo and Ms. Gibbs were now at other schools, Ms. Gibbs was on maternity leave, and the current CTC at Emmett J. Conrad High School affirmed that there were no TAKS-ALT papers/forms from Spring 2011 in classroom or cumulative folders. In December 2011, TEA contacted Ms. Byers to inquire about the required documentation and information that had not been included with the online submission. Ms. Byer responded only that Ms. Gibbs Toczik was still on maternity leave and that two other employees had not yet provided statements. Ms. Byers subsequently sent an email update on 1/31/12 indicating that Ms. Gibbs Toczik had changed names, switched schools, and then taken a long leave of absence, making it difficult to obtain a statement. The email did not include any information regarding the status of the districts investigation into the alleged inflated or falsified TAKSAlt results or the statements that were to be obtained from the other involved individuals.

No other contact or updates from the district were received by TEA, and in October 2012 another follow-up call was placed to Ms. Byers requesting the missing information and documentation. No response was received, and a written request was then sent to DTC Robert Mount asking for a statement from test administrator Connie Gibbs Toczik regarding the required observation forms that would substantiate statements from any other individual involved in or possessing knowledge of this potential irregularity, and the districts determination in this matter. The request also included a ten-day timeframe to provide the requested information and a notification that the districts superintendent would be contacted for assistance in the event that a response to this request was not received. On December 18, 2012, an email was received from DTC Mount indicating that, The Dallas ISDs Office of Test Security has been unable to obtain a statement from Connie Gibbs Toczik or any other information pertinent to [th]is incident. Therefore, the Office of test security has closed the investigation with a determination of Unfounded Procedural Violation with a lack of supporting evidence. As a result of the districts inability to obtain and provide the requested, required supporting documentation and information, TEA is unable to determine whether or to what extent Connie Gibbs Toczik or Emmett J. Conrad High School personnel participated in any testing irregularity. Samuell High School, that associate principal Felicia Johnson had removed TAKS testing materials from the campus during the past three years and had tampered with them. In response, the district coordinator submitted documentation and included an unsigned, undated statement from Michael T-K Dang, who identified himself as an associate principal during the years in question. Mr. Dang asserted that all test materials had been kept in a secure location with limited access and at no time were they removed from the campus. In her statement, Ms. Johnson also denied that any removal of materials or tampering had occurred. She declared that the accusation against her was retaliatory in nature and cited her observation of a mathematics teacher/test administrator as he allegedly viewed a secure test booklet during his 2011 grade 10 TAKS mathematics test session. The accused teachers statements and written reprimand were included in support of - TEA assumes - Ms. Johnsons denial of tampering. However, the mathematics teachers statement reflects his assertion that he did not view the booklet. This conflict was not resolved, by way of a clear district determination requested by TEA, in the information forwarded by the district, nor was the required corresponding online incident report form submitted to record the teachers alleged viewing of the test booklet. Incident ID: 100420179 Campus: Eastern Hills Elementary Person Responsible: William Osborne Administration Month: April Year: 2010 Grade: Test: TAKS Subject: Reading Incident Description: In April 2010, test administrator William Osborne violated state-mandated testing procedures when he enforced students use of testing strategies and may have provided examinees with unallowable assistance during the grade TAKS mathematics and reading assessments. In their statements, students wrote that Mr. Osborne had assisted them by while statements submitted by other examinees and test session monitors reflect that these individuals did not observe him assist any student. Mr. Osborne confirmed in writing that he had indicated by touching students test materials that they were to show evidence of working out their answers to test questions; however, he denied helping any examinee. The TAKS test administrator manual clearly defines the responsibilities of all testing personnel before, during, and after test administrations, and Mr. Osborne affirmed when he signed the Oath of Test Security that he had undergone training and had read, understood, and complied with the procedures governing these assessments. Test administration procedures do not permit test administrators to direct students to use strategies during a state-mandated assessment. Doing so can compromise the validity of the test administration and the students scores. Further, the contents of secure test booklets and student responses are considered secure materials and may not be viewed at any time without specific authorization. Mr. Osbornes admitted actions were prohibited and may have led to an appearance of impropriety.

Violations of this nature and severity could result in a referral to the Division of Educator Certification and Standards for consideration of enforcement actions. However, test security staff have reviewed the documentation provided and are recommending that no further action be taken by the Student Assessment Division. The district subsequently submitted findings that substantiated the allegations based on interviews with the students and a review of their written statements. TEA test security staff conducted a materials inspection of these students tests and compared the findings to information and claims in student statements. Specifically,
Test security staff has determined that Eddie Arellano did communicate with students in a way that went beyond what is permitted by stipulated testing procedures and deviated from the required, scripted test directions that are spoken to examinees during a test session. Incident ID: 120515119 Campus: Ridglea Hills Elementary Person Responsible: Ann Rossberg, Jennifer Bass Administration Month: April Year: 2012 Grade: Test: STAAR Subject: Incident Description: Grade teachers Ann Rossberg and Jennifer Bass inappropriately solicited confidential April 2012 State of Texas Assessments of Academic Readiness (STAAR) grade test information from their students during the week following the administration of this assessment. Specifically, both teachers implemented a lesson plan created by Ms. Rossberg that involved instructing their students to write down from memory the secure STAAR test items that the students believed had been difficult and easy. This error was discovered when Fort Worth ISD investigated the classroom activity after it was reported to the district by TEA assumes that both Ms. Rossberg and Ms. Bass were trained and oathed test administrators who had participated in 2012 STAAR testing. Documentation provided for review reflects that Ann Rossbergs lesson plan included the topic titled STAAR testing evaluation along with instructions to Write what you thought was hardest and easiest question . She asserted in her written statement that she had submitted the lesson plan to an unspecified individual and had received no feedback indicating any problems with it. The district report did not include information regarding who reviewed or approved this lesson or failed to recognize its inappropriate nature. Ms. Rossberg further declared that she understood state testing rules and claimed that she did not compromise those rules. Jennifer Bass confirmed in her statement that she followed the lesson plan, but she did not clarify why she believed this activity was permitted. Both individuals wrote that they were trying to prepare future students for testing.

The test administrator manual clearly stipulates that no person may view, reveal, or discuss the contents of a secure test booklet before, during, or after a test administration unless specifically authorized to do so. The actions of Ann Rossberg and Jennifer Bass in soliciting this information from examinees gave them unauthorized access to secure test content, including fieldtest items that could appear on future versions of the grade STAAR assessment.
Test administration manuals clearly define the responsibilities of all testing personnel before, during, and after test administrations, and by signing an Oath of Test Security, individuals acknowledge that they will comply with all the requirements of the testing program. Further, the coordinator also wrote and bubbled in the corresponding booklet number on each students answer document. TEA does not discourage districts from implementing local policies designed to reduce or eliminate test distribution errors; however, these measures should not conflict with existing, required assessment procedures. Procedures for administering TAKS tests are clearly outlined in the test administration manuals, where scripted instructions specifically direct test administrators to tell examinees that they will write their names on their booklets and their booklet numbers on their answer documents and monitor students as they complete these activities. All tests must be administered in strict accordance with the instructions contained in these manuals, and no individual may change, alter, modify, or circumvent the scripted test directions.

Although requested, a letter from this individual clarifying her actions was not provided to TEA for review. TEA does not discourage districts from implementing local policies designed to reduce or eliminate test distribution errors; however, consideration must be given to whether any of these measures would contradict or deviate from existing assessment procedures. Procedures for administering TAKS tests are clearly outlined in the test administration manuals, where scripted instructions specifically direct test administrators to tell examinees that they will write their names on their booklets and their booklet numbers on their answer documents. All tests must be administered in strict accordance with the instructions contained in the test administrator manuals, and no individual may change, alter, or modify the scripted test directions.
The Student Assessment Security Task Force has completed its review of the above incidents and is recommending no further action be taken by the Student Assessment Division. Please make certain that all district and campus training includes comprehensive instruction on proper test administration and the handling of test materials. Districts are required to administer all assessments in strict accordance with prescribed procedures. Incident ID: 110521191 Campus: Grapevine Middle School Person Responsible: Ruth-Ann Jones Administration Month: April Year: 2011 Grade: Test: TAKS (Acc) Subject: Mathematics Incident Description: Non-certified special education aide Alex King, under the supervision of campus testing coordinator Ruth-Ann Jones, inappropriately solved and marked responses to confidential test items contained in the secure booklet he and co-test administrator Judy Balunda were issued to conduct an oral administration of the 2011 grade TAKS Accommodated mathematics assessment. It was further identified through the districts investigation that Ms. Balunda did not use the test administrators booklet for the oral administration and, instead, read directly from test booklet. Statements reflect that Mr. King's actions were discovered when Ms. Balunda returned to the testing area to retrieve the test administrators booklet that she had failed to account for when checking in her materials. The documentation submitted does not address why Ms. Balunda did not notice Mr. King's actions at any time prior to collecting the test administrators booklet. Access to secure test content through an oral administration is granted solely to meet the needs of students who qualify for this type of accommodation. Test administrators are provided specific instructions for administering a test in this manner and are not permitted to deviate from these directions unless specifically authorized to do so. The directions do not authorize anyone other than examinees to respond to test items, and they do not permit test administrators to solve, analyze, or score the assessment items they have seen.

The campus coordinator did not issue to a test administrator the required needed to conduct an administration of the TAKS science assessment. According to the district testing coordinator, information pertaining to this irregularity surfaced during an investigation of another alleged impropriety at this campus. The district report indicates that the test administrator attempted to request the but was informed by the campus coordinator that it was not necessary due to the level of scheduled to receive. The coordinator then inappropriately directed the test administrator to provide any test booklet. No information that addresses this error was included in the campus coordinators statement. Assessment procedures clearly stipulate that an test administrators conducting must be issued to
The Student Assessment Security Task Force has completed its review of the above incident and is recommending no further action be taken by the Student Assessment Division. Please make certain that all district and campus training includes comprehensive instruction on proper test administration and the handling of test materials. Incident ID: 100511254 Campus: Wilson Middle School Persons Responsible: Jennifer Beale, Cynthia White, and Robert McKlintock Administration Month: April Year: 2010 Grade: Test: TAKS Subject: Incident Description: Following the administration the 2010 grade TAKS assessment, test administrators Jennifer Beale, Cynthia White, and Robert McKlintock inappropriately divulged and discussed a specific, secure test item in a public media forum. This irregularity was discovered and reported by a colleague who saw the social media postings made by Ms. Beale, Ms. White, and Mr. McKlintock. Documentation submitted reflects that Ms. Beale posted the initial comment and stated that examinees had during her test session. Both Ms. White and Mr. McKlintock responded with similar posts, and Ms. White then publicly confirmed what the All three individuals then engaged in further discussion of the and the TAKS test. The TAKS test administrator manual clearly indicates that the contents of secure test booklets are considered to be confidential and that testing personnel are not permitted to discuss or reveal this content at any time regardless of the manner in which this information may be obtained. Doing so can compromise the validity of the test administration and/or the contents of any items that might appear on future assessments. Ms. Beale, Ms. White, and Mr. McKlintock affirmed when they signed the Oath of Test Security that they had read, understood, and complied with the procedures governing this assessment, and they were responsible for knowing that their actions were clearly prohibited.

Violations of this nature and severity could result in a referral to the Division of Educator Certification and Standards for consideration of enforcement actions. However, test security staff have reviewed the documentation provided and are recommending that no further action be taken by the Student Assessment Division.
