Azi W/O Late Abdul Aziz Sheikh, ii/ Mohammad Rafiq, iii/ Manzoor Ahmad Sheikh and iv/Mushtaq Ahmad Sheikh sons of late Abdul Aziz Sheikh, residents of Shallapora Allouchabagh, Srinagar do hereby declare on oath as under: 01/ That deponents are the only legal heirs of the deceased namely Abdul Aziz Sheikh S/o Khazir Sheikh R/o Shallapora Allouchabagh Srinagar who had the Pension A/C No. 0004040600000033 and S/B A/C No. 0004SB12549 left behind an amount of Rs. 24,678/- and Rs. 2,68,075/- (total Rs. 2,92,753) with the J&K Bank B/O S. R. Gunj, Srinagar and the said account holder died on 6.9.2012. 02/ That the deceased left behind only the deponents above named as surviving legal claimants/heirs as the deponent No.1 happen to be the widow and deponents ii to iv sons of the deceased. 03/ That in case the said amount is claimed by any other person/s as legal heir/s of the deceased, in such eventuality we shall be jointly as well as severally liable and responsible to repay the said amount towards the bank together with interest forthwith to the bank.

This deed of Relinquishment is executed today on this the 6th day of Oct. 2012, by: 1/ i/ Mohammad Rafiq, ii/ Manzoor Ahmad Sheikh and iii/Mushtaq Ahmad

Sheikh sons of late Abdul Aziz Sheikh, residents of Shallapora Allouchabagh, Srinagar (hereinafter jointly called the ELINQUISHERS/SURRENDERERS (which expression shall include their legal heirs, successors in interest, assigns, administrators, executors, legal representatives and nominees) in favour of Mst. Azi W/O Late Abdul Aziz Sheikh R/O Shallapora Allouchabagh, Srinagar hereinafter called the administrators, executors, legal representatives and nominees); Whereas, Abdul Aziz Sheikh S/o Khazir Sheikh R/o Shallapora Allouchabagh Srinagar was holding the Pension A/C No. 0004040600000033 RELINQUISHEE / SURRENDEREE (which expression shall include his legal heirs, successors in interest, assigns,

and S/B A/C No. 0004SB12549 left behind an amount of Rs. 24,678/- and Rs. 2,68,075/- (total Rs. 2,92,753/-) in the said accounts with the J&K Bank B/O S. R. Gunj, Srinagar in the said account hereinafter for the sake of brevity called the Bank has expired on 06.09.2012 (hereinafter for the sake of brevity called Deceased Account Holder) is survived by the Relinquishers and Relinquishee as the only true and genuine legal heirs; Whereas, the Relinquishee is the mother of relinquishers and as such do not desire to claim any amount or interest in the said deceased account which at present is showing a credit balance of Rs. 2,68,075/- plus interest thereon, and desire that the said amount plus upto date interest thereon be given to the Relinquishee by the Bank. NOW THIS DEED OF RELINQUISHMENT WITNESSETH AS BELOW: Pursuant to said agreement, the Relinquishers do hereby surrender & relinquish all their claims, rights, interest, title, demands and shares in the said deceased account in favour of Relinquishee and the Relinquishee is hereby fully empowered & authorized to receive the full proceeds of the said deceased account on his own behalf and to sign any voucher, withdrawal or paper or document in this regard with the Bank & to utilize the proceeds thereof in any manner whatsoever without any let or hindrance from the Relinquishers and the bank shall be fully discharged in making payment on the strength of these persons and that the relinquishers shall have no claim whatsoever against the Relinquishee or the Bank and that this Deed shall be conditionally and irrevocably binding upon the Relinquishers.
