A RESOLUTION OF THE CITY OF PELICAN BAY, TEXAS, TARRANT COUNTY,


STATE OF TEXAS, ESTABLISHINGRULES REGARDINGTHE USE OF EXCESSIVE
FORCEDURINGNONVIOLENTCIVILRIGHTSDEMONSTRATIONS.

WHEREAS,the City of Pelican Bay, Texas, is a participantin the Texas CommunityDevelopment


ProgramOCDP) and a recipientof TCDP grantfunds; and

WHEREAS,it is a conditionof the TCDP contractbetweenthe Office of Rural CommunityAffairs and the
City of PelicanBay, Texas,that a resolutionestablishingrules regardingthe use of excessiveforce during
nonviolentcivilrightsdemonstrations be passedduringthe contractperiod;and

WHEREAS,it is within the power and properresponsibilityof governmentto preventthe use of excessive

Section1:
That the City of PelicanBay, Texas, adopts a policy of prohibitingthe use of excessiveforce by
the law enforcementagencieswithinits jurisdictionagainstany individualengagedin nonviolent
civil rightsdemonstration.The City also prohibitsthe physicalbarringof any entranceor exit of
sucha facilityand will enforceall applicablestatelaws regardingsame.

ARTICLEII
Section1:
Any personfound to be violatingany provisionsof this resolutionshall be served by the City with
written noticestatingthe natureof the violation.

Section2:
Any personguilty of this violationshall be guilty of a misdemeanor,and on convictionthereof
shall be fined in the amount not exceedingone hundreddollars ($100.00)for each violation.
Eachday in whichany suchviolationshallcontinueshallbe deemeda separateoffense.

Section3:
Any personviolatingany of the provisionsof this resolutionshallbecomeliableto the City for any
expense,loss, or damage occasionedthe City by reasonof such violation.
