Time Allowed: 3 Hours. Note:- 1. Attempt both the questions. 2) Questions carry the marks indicated against them. Q.No.1

During the year 2011 Pritam Singh the complainant, was running a licenced Restaurant L-2 in thei premises situated at Khalini right below the liquor vend. People used to consume alcohol in these premises. At about 6.15 P.M., accused Nearinder @ Sonu came there. He conosumed liquor and after sometime left the Premises. At about 8.30 P.M., he returned with his accomplices. All of them consumed liquor in the premises. At that time Narinder @ Sonu questioned the complainant as to why he had not permitted him to consume liquor in the premises on the previous day. Hardly had the complainant retorted by saying that there was no vacant place in the premises and at this, aforesaid, Narinder Picked up an empty bottle of beer and struck a blow therewith on his head, and As a result thereofo the blood starting oozing out from his head. His Accomplices had also joined Narinder in giving severe beating to the Complainant. After the assault the accused left the premises leaving behind the Complainant. He was taken to the I.G.M.C. Shimla by his son & wife for Medical treatment. On receipt of the information about the incident, S.I. Rameshwar Sharma went to the hospital & recorded the statement of the Complainant. A report was made in the daily dairy register of PS East Shimla & The matter was left pending for the receipt of the final opinion of the Radiologist, which was received on 12/ 09/2007 & a formal F.I.R. under Section 323, 325 read with Section 34 was registered at the police station East Shimla. The investigation was conducted by ASI Prem Lal who prepared the Side plan, took into possession the blood stained shirt of the complainant, the Bottle of beer & a copy of excise license pertaining to premises vide seizure Memos, obtained the MLC including the opinion of the radiologist, recorded the Statements of the necessary witnesses. The identity of the remaining accused Was also established & thereafter formally arrested them for offences. After Completion of the investigation the challan was put in the court against the Accused person for the commission of the offences punishable under section 323, 325 read with section 34 IPC in the Court. The learned court of the Judicial Magistrate Shimla framed the charges against all the accused. The accused Pleaded not guilty to the charges so framed & the prosecution examined 9 PWs & recorded the statements under Sections 313 Cr.P.C. ( case file added)

-2a) On the basis of the aforesaid evidences, write a judgement duly supported by Reasons for the findings? On the basis of record, as above, draw a notice Under section 111 Cr.P.C. against Madan Lal, Jitender Kumar, Nek Ram and Paras Ram (15 marks) b) On the basis of the above record of the Police Ld.SDM issued show cause notice as per reply B-8. Thereafter, SDM recorded the statements, B-9 to B-12, Write the reasoned order on the basis of the statements recorded and the Material on record. Sh.Suresh Kumar S/o Sh.Narinder Kumar, who has purchased the entire share Of Sh.Kanshi Ram S/o Sh.Babu Ram out of the Khata/ Khatauni No. 108/278 Kita 17 measuring 26-17, as entered in Jamabandi for the year 2005-06 of Revenue village Kothi Mandalgarh Tehsil and District Kullu, field an Application u/s 123 of H.P. Land Revenue Act, 1954 for the partition of the Aforesaid land. Sh.Kirpa Ram and Bansi Lal brothers of Sh.Kanshi Ram seller Raised the question of title on the ground that there was a private partition Between the parties. The other ground to resist the partition was that both the Brothers had developed the land by way of planting apple orchard and hence Claimed that settlement of account must precede the partition.The AC Ist Grade Kullu accepted the plea of the respondents and asked Sh.Suresh Kumar to file a Petition before him as he had decided to proceed as Civil Court. Sh.Suresh Kumar petition placed reliance of his pleadings on the grounds that possession Of one co- sharer is possession of all . He further asserted that since no effect Had been given to the private partition, if any, and enteries of revenue record Which carry presumption of truth made no mention of such partition. He Further claimed that both the defendants in the petition had taken the benefits Of the land of their brother Shri Suresh Kumar who remained out of village for His job. The defendants re-iterated their stand as taken in thei partition Application and claimed that they had informed the Patwari concerned Regardingi the private partition. They also stated that there was every likehood That the revenue functionaries hardly take cognizance of spot position and Arbitrarily insert enteries without informing the parties. They also cited the Case titled as Baleshwar Tiwari (dead0 by LRs & other V. Sheo Jatan Tiwari And others and others, 1997) 5 SCC 112 wherein the Honble Supreme Court Had held: Enteries in Revenue Record is the paradise of Patwari and the tiller of the Soil is rarely concerned with the same, so long as his possession and Enjoyment is not interdicted by due process and in course of law, he is Least concerned with the enteries.

1. In View of the above facts and some hints on pleading of the parties, write a Judgement as AC Ist Grade exercising the powers of Civil Court to decide the Question of title. (45 marks) 2. Write order sheets of the day of the proceedings. Q.No.2 (15 marks)

The land comprised in Khasra No.2621/1656, 2622/1656 and 2671/2234 Kita 3 Measuring 6 bigha 7 bishwa situated in village Bhatian, Pargana Plassi, Tehsil Nalagarh District Solan is owned by the State of Himachal Pradesh which has Been encroached upon by Shri Ram Lal S/o Roshan Lal of village Plassi. The Patwari reported to the AC Ist Grade Nalagarh about this encroachment hence Notice under section 163 of Land Revenue Act was issued against him asking Shri Ram Lal as to why he may not be proceeded under section 163. Sh.Ram Lal appeared before the AC Ist Grade on the appointed day and submitted a Written reply to the notice stating therein that his possession over the land in Question was since his forefathers time. On this ground he took the plea that He has become the owner of the land in question by way of adverse Possession. The statement of Patwari concerned was recorded on behalf of the State. He stated that while conducting the Girdawari for the Kharif crop he Found Shri Ram Lal to be in unauthorized possession of land in question by Sowing maize crop over it. During the proceedings, of the case Sh.Ram Lal Produced two witnesses in his favour. Both of them in their examination in Chief stated that the possession of the respondent is long standing. However, in Cross examination they were evasive of the duration of encroachment. Moreover, their age being less than 35 years of age they could not authenticate The possession beyond 30 years. 1. On the basis of above facts of the case write a detailed order for the ejectment Of the encroacher from the land in question. (30 marks) 2.
